MONDAY, JANUARY 10, 2005 - 6:00 P.M.
ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE CITY COMMISSION WITH REGARD TO ANY
MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR
SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDING IS MADE WHICH
RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED.

DANIA BEACH, FLORIDA URGING THE BROWARD COUNTY
COMMISSION TO DELAY PLACEMENT OF THE "SLOT MACHINES"
REFERENDUM BALLOT QUESTION BEFORE THE COUNTY
ELECTORATE UNTIL WRITTEN AGREEMENTS BETWEEN EACH
PARI-MUTUEL FACILITY AND EACH HOST CITY (DANIA BEACH,
HALLANDALE BEACH AND POMPANO BEACH) HAVE BEEN
EXECUTED; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.

RESOLUTION NO. 2005-007
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA URGING THE BROWARD COUNTY COMMISSION TO
DELAY PLACEMENT OF THE "SLOT MACHINES" REFERENDUM
BALLOT QUESTION BEFORE THE COUNTY ELECTORATE UNTIL
WRITTEN AGREEMENTS BETWEEN EACH PARI-MUTUEL FACILITY
AND EACH HOST CITY (DANIA BEACH, HALLANDALE BEACH AND
POMPANO BEACH) HAVE BEEN EXECUTED; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to a constitutional amendment approved by the state electorate in
November, 2004, Broward County voters are authorized to vote in a Countywide referendum to
determine whether they approve of placement of slot machines at pari-mutuel facilities existing
in the County; and
WHEREAS, despite a number of meetings conducted with Broward County
representatives, pari-mutuel facilities' representatives and representatives of the cities in which
each affected facility exists, i.e., Dania Beach, Hallandale Beach and Pompano Beach, no
agreement has been reached which addresses the impacts the host cities would sustain if the
machines are authorized; and
WHEREAS, the impacts sustained by each City are unique and significantly affect public
health, safety and welfare, since there are impacts associated with increased traffic,police and fire
(including EMS) responses, possible infrastructure improvements, permitting, development and
occupational license fees as well as other impacts and local concerns; and
WHEREAS, implementing legislation required to be adopted by the Florida Legislature is
not in place and cannot be adopted until the Florida Legislature convenes for its 2005 Session; and
WHEREAS, without clear direction from the implementing legislation, the host cities are
unable to negotiate and execute meaningful agreements with their respective pari-mutuel
facilities, since subjects that may be preempted, such as authority for imposition of municipal
license fees applicable to each machine, are unknown, and such revenues, or alternative revenues,
would be needed by the cities to help defray the costs associated with slot machines' impacts if
approved by the electorate;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City Commission of the City of Dania Beach, Florida urges the
Broward County Commission to delay placement of the "slot machines" referendum ballot
question before the County electorate until written agreements between each pari-mutuel facility
and each host city(Dania Beach, Hallandale Beach and Pompano Beach)have been executed.
Section 2. That the City Clerk is directed to furnish certified copies of this Resolution to
each of the Broward County Commissioners as well as each member of the Broward County
Legislative Delegation.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
