A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, SETTING FEES FOR THE TRANSPORT OF PATIENTS TO LOCAL HOSPITALS BY THE CITY OF DANIA BEACH FIRE-RESCUE DEPARTMENT; PROVIDING FOR A "COMPASSION POLICY"; PROVIDING,- FOR A "RESIDENT ONLY POLICY"; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. ' WHEREAS, CMS (Centers for Medicare and Medicaid Services) has mandated changes in the structure of transport fees with said changes to become effective January 1, 2005; and WHEREAS, it is necessary to comply with said mandate; and WHEREAS, the city wishes to provide a "Compassion Policy" allowing options for ' the payment of said transport fees; and WHEREAS, the city also desires to provide a "Resident Only Policy" pertaining to the payment of transport fees. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the following fees for the transport of patients to local hospitals by the City of Dania Beach Fire-Rescue Department be and the same are hereby approved: ADVANCED LIFE SUPPORT II $550.00 plus $9.00 per mile ADVANCED LIFE SUPPORT I (Emergency) 1 $450.00 plus $9.00 per mile 1 BASIC LIFE SUPPORT (Emergency) $450.00 plus $9.00 per mile Section 2. That the "Comp Y"Compassion Policy""allowing options for the payment of said` transport fees, a copy of which is attached hereto, is hereby approved and the appropriate city officials are hereby authorized to execute same. rResolution No. Section 3. ANSBRO CITY ATTORNEY ' 2 Resolution No. ATTACHMENT "A" CITY OF DANIA BEACHrMs ' COMPASSION POLICY DRAj61 Centers for Medicare and Medicaid services (CMS) Manual section 2309.4 provides that: A [State or Local government] facility which reduces or waives its charges for patients unable to pay, or charges patients only to the extent of their Medicare and other health insurance coverage, is not viewed as furnishing free services and may therefore receive program payment. OVERVIEW Dania Beach Fire Rescue has approved uniform policies and procedures for the determination of"unsponsored charity care". These policies and procedures shall be applicable effective January 1, 2005. Unless a patient has been rated financially indigent or a reduction consistent with the financially indigent patient or an estate representative has been established, the patient or other responsible party under applicable contracts, laws, or regulations, is fully expected to pay the entire bill in a timely manner. No patient account(s) will be considered for reduction without the proper written request and/or documentation from the patient, legal representation, or family member. All patient accounts must be reviewed uniformly by definition of the components of un- sponsored charity care. This shall be accomplished by the Dania Beach Fire Rescue Transport Reimbursement Executive Board. This board shall consist of the city attorney, finance director, and the EMS Coordinator. DEFINITIONS AND POLICY tUnsponsored Charity Care Financially Indigent Unsponsored charity care shall include unreimbursed services to tthe financially indigent. Financially indigent shall mean uninsured, or underinsured patients with no obligation or a discounted obligation to pay for services rendered based on Dania Beach's formal eligibility which may include: (a) income levels; or (b) other criteria for determining a patient's inability to pay that are consistent with the service's mission and established policy. The Department of Health and Human Services Poverty Guidelines shall serve as an index for the threshold below which patients receiving care from Dania Beach Fire Rescue are deemed financially indigent. Charity Care Determination No patient shall be awarded any write-off financial or otherwise without the approval by the Dania Beach Fire Rescue Transport Reimbursement Board. The determination may tbe made after review of documentation of a hardship as submitted by the patient. In order to facilitate the review process, the Transport Reimbursement Board may examine copies of recent Federal tax returns, itemization of sources of revenue for the current year and anticipated expenses, and any other documentation which may prove evidence of hardship. All information submitted will be kept confidential to the extent provided by law. ' Contractual Adjustments Contractual Adjustments to commercial contracts and/or Medicare shall not be counted as unsponsored charity care. Bad Debt Bad debts shall not be counted as unsponsored charity care. Bad debts shall include the uncollected billed charges for services rendered to patients who do not qualify under the definition of unsponsored charity care. Contractual adjustments shall not be considered bad debt. These are the procedures to be followed by ADPI [Advanced Data Processing Incorporated] in billing City of Dania Beach resident patients transported by Dania Beach Fire Rescue: Resident of Dania Beach: any person whose mailing address is in the City of Dania tBeach or who could,with appropriate proof, show that they are a resident of Dania Beach without a mailing address. The term "resident" shall not include a person whose residence address is temporarily at a nursing home or a hospital unless such person is otherwise a resident of the city. A person shall be considered a resident of the City if they reside continuously at the nursing home for more than [1] year. PROCEDURES: The EMS staff shall determine resident status based on the above criteria prior to the transport billing report being submitted to ADPI. The EMS staff will indicate the mileage, medication given and determine if the call is BLS, ALS t or ALS lI. City residents will not be billed directly; their insurance companies will be billed in all cases. If there is a supplemental policy, this will also be billed. City of Dania Beach employees will not be charged for transport services. I sincerely hope we accomplished your goals and objectives. During our meeting we discussed several issues that would assist the city in attaining their financial goals, including: ✓ Increasing the city's BLS, ALS1, ALS2, and Mileage fees to the new ADPI regommended fees (see attached). This would ensure the maximum reimbursement from all insurance carriers as well as bring your fees inline with the market. ✓ Eliminate the oxygen fee and roll into base fees. ✓ Adopt a"Compassion" Policy for indigents. This allows the city to forgive debts for those patients who truly cannot afford to pay their bill. ✓ Develop a"Resident Only" Policy, which would bill insurance only for city residents and allow the city to bill non-residents directly. Prior to implementing this policy, ADPI highly recommends waiting until we have finished researching this policy's effect on private insurance companies. ✓ To ensure the highest possible reimbursement for auto accidents, it is critical to t obtain the police report and send to ADPI as soon as possible. If this does not occur in a timely manner the hospital may be able to exhaust the PIP portion of a patient's auto policy (normally $10,000) prior to the city's bill being paid. ik I N �� In addition to the above, ADPI has already begun researching another source of potential revenue by charging for additional items related to motor vehicle accidents such as the cleaning of spills and debris, extrication of entrapped individuals, extinguishments of fires, and render other safe services or hazardous situations that may occur at the scene of motor vehicle accidents. As soon as we have completed our research on the above I will notify Captain Caruso of our findings. If there are any additional items that should be on the list above please do not hesitate to contact me. Ansbro, City Attorney DATE: December 6, 2004 RE: Proposed "New" City Charter; Ordinance Adopting Ballot Questions and Proposed Charter Attached is a revised version of the proposed "new" Charter, containing the recommendations made during the previous three workshop meetings. The principal changes are identified below: 1. Page 2, Section 3 of Ordinance, "Notice of Election": this now lists the new additional ballot questions, which are discussed below. 2. Pages 3-6, Section 4 of Ordinance: ballot questions have been revised and several have been added, as discussed below. 3. Page 12, Charter, Part I, Article 2, "Powers of the City", subparagraph (e) pertaining to "civil service": this has been revised and condensed to reflect the existence of current system as established by the Commission last year. 4. Pages 14-15, Charter Part I1, Article 1, "City Commission", Section 6, "Selection of Mayor and Vice-Mayor": while the election of the mayor remains unchanged, the wording for the election process for the vice-mayor has been modified. 5. Pages 15-16, Part 1I, Article 1, Section 8, "Limitation of powers": two different alternatives are presented for your consideration to address the matter of communications between elected officials and any employees of the City, including the City Manager. The second alternative would allow the Commission to enact a "communication policy" by Mayor and Commission December 6, 2004 Page 2 ordinance, to address "authorized and unauthorized communication procedures". This would give future City Commissions flexibility to modify such procedures from time to time, rather than await referendum approval. 7. Pages 22-26, Part II, Article 5, "Initiative and Referendum": As discussed by the City Commission, the initiative .and referendum process which appears in the current Charter is being retained, with some additional language and revisions for clarification purposes. For the sake of convenience, this portion is shown in a "strike-through" and "underline" format to show you the proposed modifications. 8. Page 28, Part II, Article 6, "Meetings of the City Commission", Section 7 "Certain Action at a Special Meeting": this has been revised to address issues raised at the last City Commission workshop, as to employment decisions affecting the City Manager or City Attorney. If the last sentence is not what was intended, it can easily be modified or removed. 9. Pages 31-32, Part II, Article 3, "City Manager", Section 2, "Absence or disability": this provision has been expanded to allow for a temporary "Acting City Manager" designation by the City Manager for a period not exceeding 15 calendar days. 10. Pages 32-33, Part III, Article 3, Section 3, subparagraph (a) of "Right of City to enter into contract of employment" (with the City Manager): This provision has been modified to: • provide for a maximum three year contract, the term of which cannot be extended; • provide that severance pay cannot ever exceed the amount payable under the contract for its remaining term (e.g., if ten months of the contract term remain when removal is desired, the severance could not exceed what would otherwise be payable for that period). Subparagraph (b) of this provision, which applies to a City Manager appointment without a contract, has been clarified to specify that despite any provision in this Section which is or may appear to be to the contrary, a City Manager can be removed without cause at any time by a four-fifths vote. Please review subparagraph (d) carefully, to confirm that it meets your intent, as to performance reviews and removal upon a three-fifths vote under certain circumstances. 11. Pages 36-37, Section 4, "Powers and duties" of a City Manager, subparagraph (j) has been modified to refer to a "monetary threshold" to be established by ordinance, which will limit the spending authority of a City Manager without City Commission approval (currently, $15,000.00). The provision also now codifies the current practice of allowing "piggyback" contracts for items competitively bid by another governmental agency, to include such bids which are no older than one year, unless such a bid was extended, with all original bid conditions in place. Again, a monetary threshold would be established by ordinance for 2 Mayor and Commission December 6, 2004 Page 3 such purchases and require a four-fifths City Commission vote if the limit were to be exceeded (the Charter Review Board had remained $50,000.00; the "monetary threshold" is recommended, since the Charter will not be readily amendable. Additionally, the purchase restriction will not apply to "cost recovery" matters such as those incurred by developers whose projects require outside landscaping review, traffic analysis, engineering review or legal work. 12. Page 37, subparagraph (e): A provision has been added to authorize the use of facsimile signature on checks, subject to the "monetary threshold" ordinance to be adopted. 13. Page 41, Part IV, "Finances and taxation", Article 4, "Transfer of Funds": provides that the City Commission shall be notified by the Finance Director on a quarterly basis of any "transfer of funds from one fund to another", subject to a monetary threshold to be established by ordinance. 14. Page 42, Part IV, Article 7, "Internal Management and Procedures Audit": per the last workshop, this provision, formerly proposed to be deleted by the City Commission, has been restored, to require such an audit to be undertaken at least once every five years. 15. Pages 42-43, Part V, Article 1, "Sale of property" has been revised to specify that vacations of streets, alleys and utility easements are not subject to the "declaration of surplus property" procedures, unless any such land is "contiguous to any park". 16. Page 44, Section 3, "Protests" has been revised to provide that "five percent", rather than 15 percent of the registered voters, can petition the City Commission to object to a land sale, and effectively subject the sale to a special election vote. 17. Pages 46-49, Article 2, "Leases", Section 1, "Power", subparagraph (b), and (c): both provisions will now require leases to be approved by ordinance, after two public hearings, notices of which must be published at least ten days before each such hearing. 18. Page 50, Article 3, "Contracts", Section 2 (b): will require a four fifths City Commission vote for any agreement involving Airport land. An authorizing ordinance will be required, with two public hearings and publication of notice as mentioned above before each hearing. 19. Pages 50-51, Section 2 (c): Any agreement, commitment or any other action pursuant to which the City will become obligated to spend City funds in excess of one million dollars will require a four-fifths vote, again subject to an authorizing ordinance with two public hearings and two notice publications. 566.028 TJA:slw 3
