HomeMy WebLinkAboutR-2007-051 Rolando Balance Variance RESOLUTION NO. 2007-051 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY ROBERT ROFFEY ON BEHALF OF THE PROPERTY OWNER ROLANDO BALANCE, FROM CHAPTER 28, "ZONING", ARTICLE 4, "DISTRICT REGULATIONS","SCHEDULE OF LOT,YARD AND BULK REGULATIONS", FOR PROPERTY LOCATED AT 2600 EAST MARINA DRIVE(RAVENSWOOD ESTATES MOBILE HOME PARK), IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4, "District Regulations", sets the lot, yard and bulk regulations for the City of Dania Beach; and WHEREAS,Robert Roffey on behalf of the property owner Rolando Balance,applied for a variance(VA-05-07)for the placement of a mobile home with a 2.8 foot side yard setback(Chapter 28,"Zoning",Article 4,"District Regulations","Schedule of lot,yard and bulk regulations",requires a minimum side yard setback of four (4) feet in the R1-T zoning district); the subject property is located at 2600 East Marina Drive (Ravenswood Estates Mobile Home Park), Dania Beach; and WHEREAS, the Planning & Zoning Board on February 21, 2007, recommended that the City Commission grant variance request VA-05-07,based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-05-07, for a variance as described above from requirements in Chapter 28,"Zoning",Article 4, "District Regulations","Schedule of Lot,Yard and Bulk Regulations", of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit "A", is approved subject to Fire Marshal approval of the 2.8 foot side yard setback. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on March 14, 2007. Planning &Zoning Board City Commission To whom it may concern: Please accept this application for a zoning variance for my home at 2600 East Marina Drive. I am requesting that you allow one comer of the home to extend beyond the property setback line as shown on the attached plans. The lot is pie shaped, narrowing considerably at the street, while the rear of the lot is quite large. The rear of the home is right on the utility easement line, and the opposite front comer is at the driveway. This variance will not cause me to infringe upon any other property.
