A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY ED DARLING ON BEHALF OF
NASSAU DEVELOPMENT CORPORATION,FROM CHAPTER 28,"ZONING",
ARTICLE 5, "SUPPLEMENTARY LOT REGULATIONS", FOR VACANT
PROPERTY LOCATED AT 45 NW 14T" AVENUE, DANIA BEACH;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 5,
"Supplementary Lot Regulations", prescribes the lot size and area requirements within the City of
Dania Beach; and
WHEREAS, Ed Darling is requesting variance (VA-35-07) for the following:
1. to allow the construction of a single family home on a lot that is 4,750 square feet in
area(Chapter 28, "Zoning",Article 5,"Supplementary Lot Regulations"requires lots
to be no less than 6,000 square feet in the RD-8000 Zoning District); and
2. to allow the construction of a single family home on a 50 foot wide lot (Chapter 28,
"Zoning", Article 5, "Supplementary Lot Regulations" requires that lots shall not be
less than sixty (60) feet in the RD-8000 Zoning District),
for vacant property located at 45 NW 141h Avenue; and
WHEREAS,the Planning&Zoning Board on August 15,2007,recommended approval of
the variance request,based upon the criteria set forth in Section 10.13 of Article 10, of Chapter 28,
"Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-35-07, for a variance from requirements in
Chapter 28,"Zoning",Article 5,"Supplementary Lot Regulations",of the City Code of Ordinances is
approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
