HomeMy WebLinkAboutR-2007-157 Approving Spiece Variance Schedule of off-street parking requirements 105 SW 1st Court RESOLUTION NO. 2007-157 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE VARIANCE REQUEST SUBMITTED BY ROBERT SPIECE, FROM CHAPTER 28, "ZONING", ARTICLE 6.21 "SCHEDULE OF OFF-STREET PARKING REQUIREMENTS", FOR VACANT PROPERTY LOCATED AT 105 SW 1sT COURT, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 6.21, "Schedule of Off-Street Parking Requirements", prescribes the parking requirements for single family homes in the City of Dania Beach; and WHEREAS, Robert Spiece is requesting variance (VA-21-07) to be allowed to maintain pavers in the swale area for automobile parking measuring 37.5 feet in width,(Chapter 28,"Zoning", Article 6.21, "Off-Street Parking", states that maximum width allowed is 15 feet), for property located at 105 SW I"Court; and WHEREAS,the Planning&Zoning Board on August 15,2007,recommended approval of the variance request, based upon the criteria set forth in Section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-21-07, from requirements in Chapter 28, "Zoning", Article 6.21 "Schedule of Off-Street Parking Requirements", of the City Code of Ordinances is approved subject to the following: 1) Compliance with drainage requirements of the Public Services Director. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on September 11, 2007.
