Roll Call : Present: Mayor: Jdmes Adams Vice Mayor: John Bertino Commissioners: Jean Cook Robert Donly Howard Hirsch City Attorney: Frank Adler City Manager: Richard Marant Building Official : Paul Maxwell Deputy City Clerk: Mary Jabalee Police Chief: Rudolf Rigo Zoning Consultant: Luther Sparkman A motion was made by Commissioner Donly, seconded by Commissioner Cook to approve the minutes of the regular meeting of January 22, 1980, and the special meeting of January 28, 1980. The motion passed unanimously. 1. Public Hearings: a) City Attorney Adler read the title of an ordinance requiring the posting of gasoline prices. A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to pass this ordinance on second reading. Commissioner Cook stated that she did not think this ordinance was in com- pliance with State Statutes and that she would vote no. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - no Mayor Adams - yes Commissioner Donly - yes b) City Attorney Adler read the title of an ordinance pertaining to traffic codes. A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to pass this ordinance on second reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes c) Mayor Adams opened the public hearing on a variance request by the Bank of Hallandale and Trust Company for the property located at 1990 Stirling Road to allow the construction of a ground supported sign larger than 50 square feet. Mark Campbell representing the Bank of Hallandale and Trust Company read the petition for variance. A motion was made by Commissioner Cook, seconded by Commissioner Donly to grant this request. The motion passed on the following roll call vote: d: C3: U}Yy, Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes d) Mayor Adams opened the public hearing on a special exception request by Frank Mirrer for the property located at 1502 South Dixie Highway to allow a paint and body shop. Commissioner Hirsch reported that Mr. A. J. Ryan had requested that the Commission continue this item until the next meeting. A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to continue this item until February 26, 1980. After discussion, Com- missioner Cook withdrew her second to the motion and therefore, the mo- tion died for a lack of second. A motion was made by Commissioner Donly, seconded by Commissioner Bertino to deny this special exception request. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - no Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes e) Mayor Adams opened the public hearing on a variance request by Gerald Simpson for the property located at 1437 NW 10 Street to allow a screen room enclosure with insufficient setbacks. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to grant this variance request. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes f) Mayor Adams opened the public hearing on a special exception request by Maurice Trembaly to allow a movie theater at 265 South Federal Highway. Several residents spoke against this request. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to deny this request based on the grounds of geography. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes g) Mayor Adams opened the public hearing on a variance request by Roderick Daise for the property located at 1006 NW Second Street to allow the con- struction of a single family residential addition within five feet of the side property line. ` A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to grant this variance request. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes City Commission -2- February 12, 1980 2. Receipt of bids for Houston Park boat docks. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to close the bidding. The motion passed unanimously. A motion was made by Commissioner Bertino, seconded by Commissioner Cook to have the City Manager open the bids. The motion passed unanimously. City Manager opened the bids and read them aloud as follows: James Busshouse & Associates, Inc. $81,850 Baker Marine Enterprises, Inc. $39,600 Webb General Contracting, Inc. $87,389 McGeddy International $49,200 A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to turn the bids over to the City Manager for recommendation paying special attention to Baker Marine. The motion passed unanimously. 3. A motion was made by Commissioner Cook, seconded by Commissioner Donly to refer the request by Robert Whitmire to vacate an easement on Griffin Road to the Planning and Zoning Board for their recommendation. The motion passed unanimously. 4. Attorney Clarke Walden appeared before the Commission to present Mr. A. J. Roddy's plans to develop his land south of Houston Park and presented a proposal to have a feasibility study made on Mr. Roddy's property along with the City's property adjacent to Mr. Roddy's property. Commissioner Hirsch stated that he was interested in the proposal and that he would like a complete report as to the possible end result, what the approximate cost would be and what the City would gain by this proposal . A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to Grant City Manager Marant authority to call a workshop on the above when more information is available. The motion passed unanimously. 5. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to advertise for bids for water main replacement and resurfacing of alley serving SW 14 Street and SW 15 Street and alley serving SE 3 Street and SE 3 Terrace. The motion passed unanimously. 6. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to accept City Manager Marant's recommendation and appoint John Vollman to the Police and Fire Pension Board. The motion passed unanimously. 7. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to accept City Manager's recommendation and reject the bid for the auto lift for the City garage. The motion passed unanimously. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to authorize the City Manager to obtain quotes on an auto lift. The motion passed unanimously. 8. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to put the item concerning consideration to advertise for bids the garbage and trash collection specifications on the February 26, 1980, agenda and that a workshop be scheduled for February 18, 1980, at 8:00 p.m. The motion passed unanimously. 9. City Attorney Adler read the title of an ordinance updating the permit fee schedule. A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to pass this ordinance on first reading. Citizens' Comments: Viola Kelly representing the Retired Citizens Club, the Garden Club and the Women's Club inquired about the use of the City bus. City Manager Marant informed her that the bus is no longer of any service and that he is checking into the possibility of purchasing another used bus. Paul DeMaio inquired about getting a movie screen for the Commission Chambers for the retired citizens monthly movies. City Manager Marant informed Mr. DeMaio that he was in the process of trying to have a screen installed. Kurt Ely suggested putting repairs of auto equipment out to bid. He also suggested that many people are not aware of the parking ordinance that was passed tonight. He also mentioned that the entrances to Pic-n-Pay Super- market are toonarrow. Charles DeMuzzio stated that the gates in front of Pic-n-Pay is a way of keeping carts off the streets. Commission Comments: Commissioner Hirsch asked Fire Chief Jewell about the problem of the entrances to Pic-n-Pay. Commissioner Hirsch was informed that the Building Department and the Fire Department had checked this problem out and it was in compliance with the code. Commissioner Hirsch asked that Chief Jewell give a report to the City Manager and that the City Manager bring back a report to the next meeting. City Manager Marant suggested that citizens should come to him with complaints. The Commission asked City Attorney Adler to confirm their appearance at the Ves trial next week. Meeting adjourned.
