Roll Call: a€ Present: Mayor: James Adams Vice Mayor: John Bertino Commissioners : Jean Cook Robert Donly Howard Hirsch City Attorney: Frank Adler City Clerk: Wanda Mullikin City Manager Richard Marant - Police Chief: Rudolf Rigo Building Official: Paul Maxwell 1 Zoning Consultant: Luther Sparkman A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to approve the minutes of the November 13 , 1979, meeting as corrected. The motion passed unanimously. ( Item 1 . A motion was made by Commissioner Hirsch, seconded by Commissioner 4 ) Bertino to appoint Mrs. Loretha Waiters as a member of the Planning and Zoning Board as recommended by Commissioner Donly. The motion passed unanimously. ( item 2 . Public Hearings: 1) a) Mayor Adams opened the public hearing on a special exception request by John Hille for the property located at 1502 South Dixie Highway to allow a paint and body shop in a C-3 zone. A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to defer this item until the Planning and Zoning Board has made a recommendation. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes b) Mayor Adams opened the public hearing on a variance request by Jack Besner for the property located on NW 13 Avenue north of Dania Beach Boulevard to allow the construction of a triplex on a lot with insufficient setbacks and insufficient street right-of-way and to waive the required platting procedure. The motion passed on the following roll call vote : Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes Regular Commission Meeting -1- December 11 , 1979 c) Mayor Adams opened the public hearing on a variance request by Douglas Richards for the property located at 274 SW 9 Steet and zoned RD-6000 (duplex) to allow the construction of a duplex on a lot of insufficient width. Mr . Daniel Vecchio of 278 SW 9 Street came forward to speak in opposition of this variance. A motion was made by Commissioner Donly, seconded by Commissioner Bertino to approve this request subject to the parking being put in the rear and additional landscaping. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - no Commissioner Donly - yes d ) The City Attorney read the title of an ordinance approving the plat entitled "The Gaddis Plat. " A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to pass this ordinance on first reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes e) Mayor Adams opened the public hearing on a variance request by Mr. & Mrs. Cereghino to allow an addition of a cabana room to an existing nonconforming use (a mobile home) located in the Hitching Post Trailer Park at 945 South Federal Highway. A motion was made by Commissioner Bertino, seconded by Commis- sioner Hirsch to grant this request. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes f) Mayor Adams opened the public hearing on a variance request by ocean Way Marina to allow the construction of an awning 80 feet by 20 feet--which does not meet the required setbacks of the assigned zoning district--for the property located at 1430 Griffin Road and zoned C-2. A motion was made by Commissioner Cook, seconded by Commissioner Donly to grant this request subject to obtaining a permit. A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to grant this request subject to the five foot setback being designated and maintained as a sidewalk. A motion was made by Commissioner Hirsch, seconded by Commissioner Donly to pass this ordinance on second reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes k) City Attorney Adler read the title of an ordinance amending Ordinance No. 90 increasing the maximum allowable outstanding promissory obligations to a sum not to exceed $500,000 . A motion was made by Commissioner Donly, seconded by Commissioner Cook to pass this ordinance on second reading. A motion was made by Commissioner Hirsch, seconded by Commissioner # 2 ) Bertino to readvertise for a public hearing in order to have any change made to a variance granted to Caesar Favarato on November 13 , 1979. The motion passed unanimously. Item 4 . A motion was made by Commissioner Bertino , seconded by Commissioner -3) Donly to table a request by Arnold Skoller for an occupational license to operate as a pawn broker and to have this item put on the agenda of January 8 , 1980. The motion passed unanimously. Regular Commission Meeting -3- o ember 11, 1979 , 5 . A motion was made by Commissioner Bertino, seconded by Commissioner Kirsch to approve the Amended Project Agreement between the City - and the Department of Natural Resources for a 90 day extension per- taining to the Houston Park boat docks. The motion passed unanimously. 6 . A motion was made by Commissioner Donly, seconded by Commissioner Cook to approve the Amendment to Agreement #79-1601 with Broward Employment and Training Administration to transfer Title VI funds to Title II . i The motion passed unanimously. 7 . A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to instruct the City Attorney to draw up an ordinance updating the City' s permit fee schedule and have this ordinance put on the agenda for first reading on January 8 , 1980. The motion passed unanimously. B . A motion was made by Commissioner Cook, seconded by Commissioner Donly to appoint Fire Chief Eugene Jewell as Acting City Manager from December 13 through December 26 , 1979. The motion passed unanimously. 9 . A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to give the employees Monday off before New Year's Day , but this additional holiday is not to be set as a precedent. The motion passed unanimously. 10 . A motion was made by Commissioner Hirsch, seconded by Commissioner Donly to approve the bills as paid for the month of November, 1979. The motion passed unanimously. 11 . Citizens ' comments : Kurt Ely questioned a portion of Ordinance No. 100 pertaining to vehicle service establishments with regard to paint and body shops. Mr. Ely also complained about the trash around town not being picked up. COMMISSION COMMENTS A motion was made by Commissioner Cook, seconded by Commissioner Donly to declare an emergency the adoption of a resolution rati- fying and confirming the action of the City Commission on July 10 , 1951 , vacating and exchanging property located on NW 3rd Avenue between John B. Gregory and Iola Gregory and the City of Dania. The motion passed with Commissioner Hirsch voting no. A motion was made by Commissioner Bertino, seconded by Commissioner Donly to adopt this resolution after being properly prepared by the City Attorney and signed by the Mayor. The motion passed with Commissioner Hirsch voting no. Meeting adjourned.
