Dania City Commission

A motion was made by Commissioner Donly, seconded by Commissioner Bertino
to excuse Commissioner Hirsch.
The motion passed unanimously.
Mayor Adams presented a certificate from the City of Dania and the Dania
Police Department to Broward Linen Service thanking them for the service
rendered during the recent hurricane alert.
A motion was made by Commissioner Bertino, seconded by Commissioner Cook to
approve the minutes of the workshop meeting and regular meeting of September
11, 1979.
The motion passed unanimously.
1. Public Hearings.
a) Ted Baldaga of Stutsman Associates opened the second Public Hearing of ;
Dania' s Land Use Plan. He stated if the Commission approves the plan, it
will be submitted to the Broward County Planning Council. There will be
two Public Hearings before the Planning Council for certification and one
Public Hearing before the County Commission and back to the City of Dania
for final adoption.
Mervin Span stated there is not enough commercial property being left
in the West side of the City. Mr. Maxwell indicated that the property
that Mr. Span is referring to is shown on the City's zoning map as
commercial , but there were some errors on the Land Use Plan being submitted
to the County.
A motion was made by Commissioner Bertino, seconded by Commissioner Cook
to make the Land Use Plan submitted to the Planning Council consistent
with the City zoning map on NW 1st Street, Dania Beach Blvd., and a portion
of 5th Avenue South of Dania Beach Blvd.
The motion passed unanimously.

A motion was made by Commissioner Bertino, seconded by Commissioner Cook
that the parcel of land on NW 2nd Street adjacent to Collins Elementary
t` School be submitted as low median 10 (10 units per acre) , consistent with
our present zoning.

A motion was made by Commissioner Bertino that the property directly
north of the Audubon Society property be brought into compliance with
M', the residential zoning directly to its west.
The motion was seconded by Mayor Adams.
The motion passed with Commissioner Donly voting no.

consistent with our present zoning.

Edward Kryling represented landowners seeking an amendment to the Land
y Use Plan for the property located at 1401 N.W. 1st Street. This is shown
as residential on the Land Use Plan. They asked the Commission to desig-
nate this as commercial property.

The commission took no action on this.
Mr. Fred Flanders, representing Broward County Audubon Society wished to
clarify the proposed zoning designation of the Audubon Society property.
He was told the proposed zoning is designated 'park' .
Mr. A. J. Ryan spoke about two parcels of property. Lot 8, Tigertail
Grove resubdivision, designated on the Land Use Plan as 10 units per acre
residential , which he claims is inconsistent with the land to the south,
which is industrial and to the west which is commercial and to the east
which is industrial. He requested that the property in question either
be designated 16 units per acre or be split so that half is industrial
and half be designated 16 units per acre.
A motion was made by Commissioner Bertino, seconded by Commissioner Donly

to leave the zoning as designated by the nd Use Plan.
The motion passed unanimously.
Mr. Ryan classified the area in the NE corner of the intersection of
I-95 and Stirling Rd. as the most inconsistent use of the Land Use Plan.
He requested the land be designated industrial .
A motion was made by Commissioner Donly to change the zoning on the
Land Use Plan for this portion of land from low median 10 residential to
industrial.
The motion was seconded by Commissioner Cook.
Mr. Richard Wells stated that they were assured by the Commission, when
their property was annexed, that it would remain residential.
Commissioner Cook withdrew her second.
A motion was made by Commissioner Bertino to leave this property as it
is presently on the Land Use Plan and that we look toward the possibility
of a new zoning classification. The motion was seconded by Mayor Adams.
The motion passed with Commissioner Donly voting no.

City Clerk Wanda Mullikin read a letter from Mr. Clarke Walden on behalf
of Bo-Mark Development Corp. , requesting multi-family residential zoning
on the property legally described as:
East 'j of the southeast 4 of the southeast 4 of the northeast 4
of Section 3, Township 51 South, Range 42 East.
No action was taken by the Commission on this.
A motion was made by Commissioner Bertino, seconded by Commissioner Donly
that the Commission pass the Land Use Plan on second reading.
The motion passed unanimously.
b) City Attorney Adler read the title of a new sign ordinance.
A motion was made by Commissioner Bertino, seconded by Commissioner
Cook to adopt the ordinance on first reading.
The motion passed on the following roll call vote:
Commissioner Bertino - yes Commissioner Donly - yes
Commissioner Cook - yes Mayor Adams - yes
It was suggested by City Attorney Adler to declare this an emergency
item since people are requesting sign permits, and pass the ordinance on
first and second reading.
A motion was made by Commissioner Bertino to declare an emergency item
to have the second reading of this ordinance. The motion was seconded
by Commissioner Cook.
The motion passed unanimously.
A motion was made by Commissioner Bertino, seconded by Commissioner
Donly to adopt the ordinance on second reading.
The motion passed on the following roll call vote:
Commissioner Bertino - yes Commissioner Donly - yes
Commissioner Cook - yes Mayor Adams - yes
A motion was made by Commissioner Bertino, seconded by Commissioner
Donly to rescind the moratorium on signs since there is a new sign
ordinance.
The motion passed unanimously.
2. No action taken by the Commission on this item. Since the passage of the
new sign ordinance, a sign permit may be obtained in the usual way,provid-
ing the sign is in compliance with the ordinance.

A motion was made by Commissioner Bertino, seconded by Commissioner Donly
to waive replatting procedures.
The motion passed unanimously.
6. Mr. Marant reported that there is no mandatory requirement that any candi-
date for election to the City Commission either serve himself or appoint
anyone to serve for him on the proposed Advisory Committee on Election
Laws. He apologized for indicating that it was mandatory.
A motion was made by Commissioner Cook to continue to the next meeting any
action on the proposed Advisory Committee on Election Laws.
The motion died for lack of a second.
A motion was made by Commissioner Bertino to direct the City Attorney to
draw up a resolution regarding the Advisory Committee on Election Laws
and that it be put on the next agenda for action, and if adopted, a copy
of the resolution be sent to the Attorney General .
The motion was seconded by Commissioner Donly.
The motion passed unanimously.
7. A motion was made by Commissioner Bertino, seconded by Commissioner Cook
to approve the bills as paid for the month of August, 1979.
The motion passed unanimously.
8. Citizens Comments' :
Mr. Gregory Griffith objected to the absence of a road and street sign
along SW Fourth Court where he rents a warehouse. He questioned why a
Certificate of Occupancy was issued without a road. Mr. Marant reported
that a street sign had been on order from the County for some time.
Commission directed City Manager Marant to determine why the Certificate
of Occupancy had been issued without a road being constructed.
Many citizens were in the audience to inquire about the status of the old
Dania Elementary School .
City Manager Marant was instructed to terminate the lease on the school
with the Broward County School Board.
Michael Dascher commented on the tearing down of the building and sugges-
ted that the building not be torn down while a survey of the old buildings
is going on.
The workshop on charter change scheduled for October 2 at 8:00 p.m. was
changed to October 2 at 5:00 p.m.
City Manager Marant thanked the Commission for their cooperation with him
during his first year.

Approval of the minutes of the workshop meeting of September 11 and the
regular meeting of September 11, 1979.
1. Public Hearings:
a) Second hearing on Dania's Land Use Plan.
b) First reading of new Sign Ordinance.
2. Request by Howard Geist of Hollywood Signs to be able to obtain a permit to
allow an advertising sign.
3. Request by Bundy Signs to be able to obtain a permit for a pole sign at
Hansell Tire Company at 2000 Stirling Road.
4. Request by Mel-Web to be able to obtain a permit for a pole sign at 1401
North Federal Highway, Unlimited Rent-a-car.
5. Request by Jacques Gallet to waive replatting procedures in order to
vacate an alley in Block 4 of North Wyldwood Park located in the 1200 block
of North Federal Highway.
