Invocation. Pledge of Allegiance. Roll Call . Approval of the minutes for the regular meetings of August 14 and August 28. 1979. 1. Public Hearings: a) Request by Kay Francis for property located at 221 SEr2nd Terrace for a variance to allow a family counciling practice in an RS-6000 (single family residential ) zone. The Planning and Zoning Board at their meeting of September 4, 1979, recommended that the Commission deny this request. EXHIBIT: Notice of Hearing b) Request by Guilda Bryant for the property located on the SE corner of Sid 8 Avenue and West Beach Boulevard for a variance to allow construction of a duplex on a lot of insufficient width and square footage. Subject property is zoned RD-6000 (duplex). The Planning and Zoning Board recommended that ® the Commission approve this request. Roll Call : Present: Mayor: James Adams Vice-Mayor: John Bertino Commissioners: Jean Cook Robert Donly Howard Hirsch City Manager: Richard Marant City Attorney: Frank Adler City Clerk: Wanda Mullikin Building Official : Paul Maxwell Zoning Consultant: Luther Sparkman Absent: Police Chief: Rudolf Rigo A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to approve the minutes of the Regular meeting of August 14, 1979 and August 28, 1979. The motion passed unanimously. 1. Public Hearings: a) Kay Francis requested a variance to allow a family counciling practice in an RS-6000 (single family residential ) zone. The Planning and Zoning Board at their meeting of September 4, 1979, recommended that the Commission deny this request. She presented signatures of neighbors who did not oppose her request. A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to deny the variance. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes b) A variance was requested by Guilda Bryant to allow the construction of a duplex on a lot of insufficient width and square footage located on the SE corner of SW 8th Avenue and West Beach Boulevard zoned RD-6000, duplex. The Planning and Zoning Board recommended that the Commission approve this request. A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to grant this variance. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes c) Ted Baldaga of Stutsman Associates opened the Public Hearing on Dania's Land Use Plan. He stated that this was the first of two Public Hearings, the second to be held September 25, 1979 at Dania City Hall at 8:00 PM. F_ih 4. A request by Sidney Rubenstein of H & S Auto Parts to be able to obtain a permit to allow an advertising sign at 250 S. Federal Highway. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to allow a permit to install the signs providing they comply with the new sign ordinance. The motion passed unanimously. 5. Request by Attorney Jesse Diner, representing Mr. & Mrs. John Rule, of R & R Guest Home, Inc. , 719 SW 5th Street, to reopen the Public Hearing on the variance previously requested by Mr. & Mrs. Mule to allow adult congregate living at this address. A motion was made by Commissioner Donly, seconded by Commissioner Bertino to grant the request for a rehearing, and to waive the filing fee. It is Mr. Diner's contention that due to the fact that there was an existing occupational license allowing apartment dwelling at this address, it was not necessary to file the original petition to allow adult congregate living. Mr. Adler stated a unanimous vote was necessary to grant a rehearing. The motion failed with Commissioner Hirsch and Mayor Adams voting no. 6. Attorney Clark Walden requested a workshop to discuss amending the City Charter in reference to bidding procedures. A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to set up a workshop meeting to discuss amending the City Charter only in regards to the granting of franchise priviliges to private utilities within the City of Dania. The motion passed unanimously. Workshop to be scheduled October 2, 1979, at 8:00 PM. City Manager and City Attorney to present proposed charter amendment for review by the Commission. 7. City Attorney Adler reported that unless there is a special exemption, social security must be paid on all employees, part-time or full-time. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to properly amend Ordinance #347 to read that the City wishes to cover part-time positions retroactive to January 1, 1975. The motion passed unanimously. 8. City Manager Marant recommended the appointment of Mary Jabalee to the position of Deputy City Clerk. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to adopt a resolution appointing Mary Jabalee to the position of Deputy City Clerk. Vice Mayor Bertino pointed out that in no way is this position considered to be a direct line ascending to the position of City Clerk. The motion passed unanimously. 9. A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to adopt the resolution approving agreements for road construction, traffic way illumination and traffic ways beautification for County Road Bond Project #4124, Stirling Road. The motion passed unanimously. Y3 Regular Meeting - 3 - September 11, 1979 'rl u .v. Edward Kryling, representing Edward Williams, requested the rezoning of property- located at 14 NW 1st St. to Commercial . Mervin Span spoke in favor of the proposed Land Use Plan. A. J. Ryan represented owners of property located at the NE corner of the intersection of I-95 and Sterling Rd. He spoke against the Land Use Plan. Mr. Maxwell reported on the Trafficways Plan. The Planning Council has requested input from the Commission on Dania Beach Blvd. from Bryan Rd. to Federal Hwy. The Council has requested we either change the right of way by reducing it 60 or 70 feet or to retain the 110 feet right of way. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to retain the 110 feet right of way. The motion passed with Commissioners Cook and Donly voting no. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to close the Public Hearing. The motion passed unanimously. d) City Attorney Adler read the title of an ordinance adopting the annual Sewer Fund budget for 1979-80. A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to adopt the ordinance on second reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes e) City Attorney Adler read the title of an ordinance adopting the annual Water Fund budget for 1979-80. A motion was made by Commissioner Donly, seconded by Commissioner Hirsch to adopt the ordinance on second reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes 2. A request was made for a donation to the Starting Place. A motion was made by Commissioner Bertino, seconded by Commissioner Donly to deny this request. The motion passed unanimously. City Manager Marant suggested that requests for donations should be submitted in early June and let the Commission decide at that time what they want to do so that it can be programmed into the budget. 3. A request was made by LaPointe Advertising, Inc. to allow an advertising sign on Griffin Road at I-95. A motion was made by Commissioner Hirsch, seconded by Commissioner Donly to approve the request. A motion was made by Commissioner Hirsch, seconded by Commissioner Donly to adopt the resolution and addendum as explained by City Attorney Adler and Commissioner Bertino. r The motion passed unanimously. 11. Mayor Adams read a proclamation declaring September 29 and 30, 1979 as Pioneer Days in the City of Dania, Florida. 12. Citizens Comments: There were no Citizens Comments.
