Roll Call : Fi4 Present: ' Mayor: 'James Adams Vice Mayor: John Bertino s' Commissioners: Jean Cook Howard Hirsch City Manager: Richard Marant City Attorney: Frank Adler Police Chief: R. Rigo Building Official : Paul Maxwell Zoning Consultant: Luther Sparkman Absent: City Clerk: Wanda Mullikin Commissioner: Robert Donly A motion was made by Commissioner Bertino, seconded by Commissioner Hirsch to excuse Commissioner Donly. The motion passed unamiously. The American Legion post #304 presented the Archibald Black award for outstanding policeman of the year to Cpl. Timothy Cates, and the A. J. Ryan, Sr. award to Insp. John Roberson, as the outstanding Fireman of the year. A motion wasmade by Commissioner Bertino, seconded by Commissioner Hirsch to approve the minutes of the June 26,1979 meeting. The motion passed unamiously. 1. Mr. Roman Moran represented Mr. Herbert Penn, Jr. in presenting his request for a variance to allow the construction of a school of sign painting and commercial art in an RS-6000 zone. Property is located on the southwest corner of Phippen Rd, and Southwest Tenth St. Commissioner Hirsch spoke in favor of Mr. Penn and the academy. A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to approve the variance. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes b) Mayor Adams opened the public hearing on a request by Frederick A. Gunter for a variance to allow the construction of a sun deck, sun roof, carport and whirlpool with insufficient setbacks on property located at 344 NE 2nd Court and zoned RS-8000. The zoning board requested that this be postponed. A motion was made by Commissioner Cook, seconded by Commissioner Bertino to continue this matter to the July 24 meeting. The motion passed unamiously. N c) Mayor Adams opened the public hearing on a request by Mr. Eric D. -`- Kuritzky for a variance to allow the issuance of an occupational license for business telephone only, from a residential address, located at 287 SE 8th St. a Commissioner Hirsch made a motion, seconded by Commissioner Bertino, to approve this variance on a year to year basis as per the Zoning Board's >4; ' + recommendation. S'L f•' d) Mayor Adams opened the hearing of a request by Mr. Frank Marano for a variance to allow an automobile rental agency in a C-2 zone, located at 1421 North Federal Highway. - " A motion was made by Commissioner Bertino, seconded by Commissioner Cook to grant this variance. The motion passed on the following roll call vote: 9Tf:C ,rr Commissioner Bertino - yes Commissioner Hirsch Commissioner Cook - yes Mayor Adams - yes - yes e) Mayor Adams opened the public hearing on a request by Mr. John :.: DeBartolo for a variance to allow a duplex on a lot of insufficient width .!cTU s at 290 SW 9th St. : A motion was made by Commissioner Cook, seconded by Commissioner Hirsch ar lit to grant the request. 4 The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes f) Mayor Adams opened the public hearing on a request by Mr. John Bertino to allow the construction of a single family residence with insufficient 3 setbacks at 211 SE 2nd Terrace. Commissioner Bertino indicated that he was stepping down from the Commission and abstaining from voting on the matter as he has personal interest in it. A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to allow this variance. The motion passed on the following roll call vote: Commissioner Cook - yes Mayor Adams - yes Commissioner Hirsch - yes g) City Attorney Adler read the title of an ordinance amending the 1978-1979 Sewer Fund Budget. A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to adopt this ordinate on second reading. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes h) City Attorney Adler read the title of an ordinance amending the 1978-79 Water Fund Budget. A motion was made, seconded by Commissioner Bertino to adopt on second reading the ordinance amending the Police & Fire Pension Ordinance N132. "P C01110S5i0ner Bertino requested that the pension committee obtain insured funding to guard againist any catastrophe. City Manager Marant stated he would meet with Fire Chief Jewell and come up with something workable. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes N Commissioner Cook - yes Mayor Adams - yes 2. Mayor Adams opened the discussion on consideration and possible action on the request by the firm of Fromberg, Fromberg, and Roth, PA for amendment to the City's Master Land Use Plan concerning the old Stirling Golf Course directly west of sw 12th Ave. A motion was made by Commissioner Hirsch, seconded by Commissioner Bertino to table this as the principals did not appear. The motion passed unamiously. e, 3. Mayor Adams opened the discussion on consideration and possible action on the proposed agreement between Robert J. Graf and the City concerning Town & Country Estates No. 1. Mr. Dixon Thomas represented Robert J. Graf in this matter. Mr. John Farina presented the City's recommendation concerning water & sanitary sewer installations. A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to table this matter for further discussion. Commissioner Hirsch wished to amend the motion to allow for a workshop after City Manager Marant, Mr. Graf, Mr. Thomas, and Mr. Farina have met to workout the details. The motion passed unamiously. 4. Mr. Maxwell presented the following schedule of dates for public hearings to rezone certain lands to C-2, C-3, C-4 & I-G: Aug. 7, 1979, Hearing before the Planning & Zoning Board Aug. 14, 1979, hearing before the City Commission. Aug. 28, 1979, 2nd hearing before the City Commission. Hearings to be advertised on Aug. 7 & 23, 1979. A motion was made by Commissioner Cook and seconded by Commissioner Hirsch to approve the dates. The motion passed unamiously. 5. Mr. Maxwell presented his recommendations of an alternative construction control line. Commissioner Bertino made a motion, seconded by Commissioner Hirsch to adopt staff's recommendation as our proposal for the construction control line, that being the red line drawn on a map from the State of Florida, Dept. of Natural Resources, photographed Sept. , 1974. The motion passed unamiously. 6. A motion was made by Commissioner Bertino, seconded by Commissioner Cook to approve the bills for the month of May & June, 1979. Commissioner Bertino made a motion, seconded by Commissioner Cook to C =, , approve the Summer Youth Employment Agreement. ° The motion passed unamiously. B. There were no Citizens Comments. Mayor Adams opened the discussion on possible approval of an agreement between Broward County and City of Dania and Davidson Lumber Co, for City of Dania to accept Building permit applications from Davidson Lumber Co. Mr. Jack Grant appeared in behalf of Davidson- Lumber Co. :i. A motion was made by Commissioner Cook, seconded by Commissioner Bertino F: to accept the agreement with the understanding that the water wells be installed and that Davidson Lumber shall install all water lines and fire hydrants required by the City and to connect said lines to the City's water system. } Mr. Adler authorized the agreement to be signed by the Mayor and City Clerk. 'N The commission agreed to schedule budget meetings with department heads on Monday, July 16, starting at 9 AM. {` A motion was made by Commissioner Bertino, seconded by Commissioner Cook r. to declare the Little League World Series request an emergency item as they need the money to get started. The motion passed unamiously. ,_. A motion was made by Commissioner Hirsch, seconded by Commissioner Cook, to donate $250 to the Little League World Series. The motion passed with Commissioner Bertino voting no. Commissioner Cook requests placing an 'attractive nusiance' ordinance on the 7/24/79 agenda. Meeting adjourned.
