Roll Call : Present: Mayor: John Adams Vice Mayor: John Bertino Commissioners : Jean Cook ' Robert Donly Howard Hirsch City Attorney : Frank, Adler City Manager: Richard Marant Building Official : Paul Maxwell Zoning Consultant: Luther Sparkman Police Lieut : V . Johnson Absent : Police Chief: R. Rigo City Clerk: Wanda Mullikin City Manager Mdrant presented certificates of commendation to three citizens for their outstanding help in apprehending a purse snatcher . A motion was made and seconded to approve the minutes of the regular meeting of May B, 1979. The motion passed unanimously. A request was made and granted to hear Item 4 first . 4 . Attorney Philip Shailer appeared on behalf of Florida Coast Bank and Balmoral Ind . Corp . to request the vacating of certain streets and alleys in the Plat of North Wyldwoode Park Subdivision and that the submission and approval of a new plat be waived. A motion was made and seconded to grant this request. Motion passed unanimously. 1 . Public Hearings : a ) The second reading of an ordinance approving the Plat of Lone Star was continued until the plat is presented in the final form. A motion was made and seconded to place this on the agenda for the June 12 , 1979 regular meeting . Motion passed unanimously. b ) Mayor Adams opened the public hearing on the request of Mr. John Bartley for a variance to allow two duplexes on lots of insufficient size at 245 & 249 SW 7th St. Dr. Keen Garvin and several other residents of the area voiced objections to this variance. Mr. Carl Zenobia spoke in favor of the variance. All paved parking to be centered between these two lots with two parking spaces to be on the front of each lot and two spaces to be in the rear of each lot . 2. Extra landscaping in front on both lots . 3 . Nine foot side setbacks on the east side of L-12 and 9 foot setbacks on the west side of L-13 . Motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - No Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes c) Mayor Adams opened the public hearing on the 2nd reading of the ordinance amending Water Ordinance No . 62 by asking City Attorney Adler to read the title . A motion was made by Commissioner Cook to adopt on second reading the ordinance amending Hater Ordinance #62 , seconded by Commissioner Donly and passed on the following roll call vote : Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes d) Mayor Adams opened the public hearing on the 2nd reading of the ordinance amending Sewer Ordinance No. 63 by asking City Attorney Adler to read the title. A motion was made by Commissioner Bertino to adopt the ordinance on 2nd reading . Motion seconded by Commissioner Hirsch. Motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Hirsch - yes Commissioner Cook - yes Mayor Adams - yes Commissioner Donly - yes 2 . Mr. David Norton of Davey Insurance Co. presented a proposal on the rates for the proposed automobile insurance . Mr. Odis Carlan of Fred S . James Co. stated that his proposal was not quite ready. The commission , on a motion by Commissioner Hirsch , seconded by Commissioner Cook directed Mr. Carlan to present his proposal to the City Manager by Friday , May 25 and that the City Manager review the proposal and present his recommendation to the commission at a special meeting on May 29, 1979 at 7 : 30 PM prior to a workshop. 3 . Mr. Carl Zenobia stepped forward to again remind the commission that he had appeared before them a year ago to request that the drainage problem on the corner where he resides in the SE section of Dania be corrected. After much discussion , a motion was made by Commissioner Bertino , seconded by Commissioner Donly to direct the City Manager to work with and direct our City Engineer to come up with a comprehensive drainage plan for the Southeast section , to put it in financiable phases to indicate which should be paid for by future development and which should be paid for by the city and to have that section which is near Mr . Zenobia ' s corner be the beginning points of our project and have it ready for next budget. Motion passed with Commissioners Cook and Hirsch voting no . Regular Meeting -2- May 22 , 1979 ti 4 . (This item moved to beginning of meeting. ) 5 . City Manager Marant presented quotations of interest rates from the Dania Bank, The Bank of Hallandale and Trust and the Atlantic National Bank , for a $250 ,000 loan for a 5 year term , to eliminate the infiltration into the Sanitary Sewer System. City Manager Marant recommended that the city borrow the money from the Dania Bank because of the lower interest rate of 5?% and that the other terms are better because the city is already doing business there . Motion was made by Commissioner Bertino to accept the Dania Bank proposal and the Hallandale Bank proposal both for $250 ,000 each to work on our sewers . Motion died for lack of a second . A motion was made by Commissioner Cook , seconded by Commissioner Donly to accept the Dania Bank' s proposal at the rate of 51z% interest. The motion passed unanimously. Commissioner Bertino made a motion to , if at all possible, also accept the proposal with the Bank of Hallandale at 5 3/4% . Motion died for lack of a second. Commissioner Hirsch asked City Manager Marant to tell the commission what these monies will do for the people in this city . City Manager outlined the need for action independent of any grants . Therefore the city proposes to spend $250 ,000 or parts of that money to work in areas that were not scheduled to be done with grant money. If we were to get into areas scheduled to be covered by grants , we would be risking the possibility of losing the grant allocation for the repair and maintenance of the areas that have already been laid out to be fixed . We would expect to have the work completed 1 year from the time it was started . We would expect, within a year to be able to reduce the sanitary sewer cost to the citizens of Dania , and at the same time, with the savings from 1 ,000 ,000 gallons in infil- tration , repay the loan and set up a sinking fund for continued inspections and repairs . Mr. Farina mentioned considering that the contractor that is awarded the bid be required to provide a quarantee for 4 years to repair any recurring leaks at no additional cost. 6 . Motion was made by Commissioner Donly and seconded by Commissioner Hirsch to approve the bills paid for April , 1979 . Motion passed unanimously . 7 . City Manager Marant made a request to replace and install water lines along and across Federal Highway during the widening of U S 1 by D.O. T. Motion was made by Commissioner Donly and seconded by Commissioner Hirsch to grant the request. Motion passed unanimously. 8 . Citizens Comments : Mr. Larry Kempler, 1st Vice Prssident of Dania PTA came forward with a complaint about the Old Dania Elementary 3 - gfw:.5; School as to the danger to children and the dangerous t , overhang in the rear of the building . .: City Manager Marant stated that unless something , in the way of a grant, is done in the next two weeks , he and Mr. Maxwell will recommend that the building be torn down . hr, . y � Commissioner Donly recommended that on the next agenda E`< that the item read , consideration and possible action on r s, cancellation of the lease with the School Board of Browar County for the Dania Elementary School and a further recommen- dation to the school board that the building be demolished P4" immediately . t . City Manager Marant requested the city attorney to speak to Mr . A . J . Ryan about the Venezio case for the purpose of concluding same as soon as possible. Mayor Adams reminded the commission of a public hearing on the alignment of Griffin Rd . from 95 to U .S. 1 on Wed . 5/23/79. Commissioner Cook reminded the commission of a meeting of the Dania Historical Society 5/24/79 at 7 :30 PM. Meeting Adjourned .
