A motion was made by Commissioner Donly, seconded by Commissioner Cook to
excuse Commissioner Hirsch from this meeting. Motion passed unanimously.
Commissioner Cook made a motion, seconded by Commissioner Bertino to approve
the minutes of the regular meeting of April 10,1979. Motion passed unanimously.
4 1 . Public Hearings:
a) Second reading of an ordinance approving the plat of Lone Star.
Due to the fact that the plat was not ready for final approval ,
Commissioner Bertino made a motion to continue this hearing until
the May 8th meeting. Motion seconded by Commissioner and passed on
the following roll call vote:
Commissioner Bertino - yes Commissioner Donly - yes
Commissioner Cook - yes Mayor Adams - yes
b) Second reading of an ordinance approving the plat of Schoell Subdivision.
City Attorney Adler read the title of this ordinance.
Mayor Adams opened the public hearing. There were no comments from the
public on this ordinance. Mayor Adams closed the public hearing and opened
it to the Commission for discussion and action.
Commissioner Donly made a motion to accept the ordinance on second reading
approving the plat of Schoell Subdivision. Motion seconded by Commissioner
Cook and passed on the following roll call vote:

2. Citizens Comments:
Ms. Robin Skelly, President of the Dania Antiques Dealer Association re-
quested that D.O.T. be contacted to install signs along Federal Highway and
other areas of the City that would indicate municipal parking. She also re-
quested that the State be requested to supply green signs along I-95 and on
U.S. 1 to indicate Dania as the Antique Center of the South.
City Manager suggested that the Antique Dealers Association submit something such
as a written petition to his office and that he would forward it to D.O.T.
along with a letter from the City in an attempt to procure these signs.
Mr. Otis Skinner of Cozy Cove Marina complained because the City Code
Enforcement had stopped him from washing boats behind his property due to
complaints from adjoining property owners.
The Commission instructed City Manager Marant, Code Enforcement Officer
_ Nick Villa and City Attorney Adler, if needed, to work this problem out with
with Mr. Skinner.

A citizen from the N. W. area of the City inquired as to the status of the
proposed locks in the Dania Cut-off Canal . City Manager Marant suggested that
he come to his office and review the materials available on the project.
3. City Manager Marant recommended that the City reinstate the Florida Power
and Light utility tax fee to the Dania Bank as of the first of this year (1979).
Mr. Dixon Thomas of Walden and Walden law firm was present to present the Dania
Bank' s position in this matter which was to pay the tax effective April 1 , 1979
with no back taxes to be paid. City Attorney Adler advised that he did not be-
lieve that the City could collect the tax retro-actively. Commissioner Donly
made a motion to reinstate the City utility tax collection from the Dania Bank
as of April 1 , 1979. Motion seconded by Commissioner Cook and passed unanimously.
It was requested that the administration request a print-out from the Fla.
Power and Light of all customers in the City of Dania exempt from this tax.
4. City Manager Marant pointed out that he had discussed the drainage problem
on the Dania Bank property with Mr. Clarke Walden. and City Engineer John Farina
as to who would be responsible for the cost to correct it. It was City Manager
Marant' s understanding from City Engineer John Farina that the Dania Bank would
be fully responsible for payment of this project. City Manager Marant re-
ported that in a conversation with Mr. Clarke Walden and Mr. Martin Wyneken of
the Dania Bank that they felt that this cost should be divided between the City
of Dania, the Dania Bank and the adjoining property owners, with each paying 1/3.
After further discussion, the Commission agreed to wait and enter into a
regional drainage district, possibly a special taxing district to correct the
drainage problem on the whole east side of Dania.
5. Personnel Administrator Charlene Moore presented the City Personnel manual
for approval . Commissioner Cook made a motion, seconded by Commissioner Donly
to approve this manual . Motion passed unanimously.
6. Public Safety Officer Nick Villa presented the Commission copies of the
City Safety Program for their review.
7. Commissioner Bertino made a motion, seconded by Commissioner Donly to
amend resolution no. 314 to remove the restriction on the number of members
to be appointed to the Dania Community Clean Up Committee.
8. City Manager Marant recommended that Mr. Young Tindall be appointed as
Legal Advisor to represent other City employees pertaining to Hall vs. City
of Dania. A motion was made by Commissioner Bertino, seconded by Commissioner
Donly to appointment Mr Tindall to represent the City employees in this suit.
Motion passed unam mousy.
9. The Commission unanimously voted to continue action on the Auto Insurance
proposals to May 22, 1979 on a motion by Commissioner Donly seconded by
Commissioner Bertino.
COMMENTS-
City Manager Marant reported that the City would be taking a census in
May and asked the press to publicize this to make more people aware of what
the City will be doing.
City Manager Marant asked for the Commissions direction as to the City
supplying a grave site for Lucille Benson. The Commission asked that the City
Attorney bring back a legal opinion on this at the May 8th meeting.
City Attorney Adler presented the amendments for the shelters and ad-
vertising on them. City Attorney Adler recommended that before the City
approves the shelters that they first require approval from D.O.T. for all
the locations.
City Attorney Adler reported that the City had received an adverse
ruling on the "Doggie Bag" in that the City should not have denied them the
right to sell beer and directed the City to issue them a permit in order for
them to get a beer license.

Commissioner Bertino reported that he had contacted the animal control
section of Broward County and that they had offered to train anyone that the
City might want to designate as an animal control person in the proper control
of animals; and that the County had no objections to the City having their own
Animal Control person. This will be put back on the agenda after further re-
search of ordinances from other cities: who have their own animal control person.
Commissioner Bertino reported that he had looked into a possible grant to
turn the old Dania Elementary School into a recreation facility in the event
that the structure proves to be sound. This is to be determined by the Fire
Chief, Building official , and the City Engineer.
Commissioner Cook reported that she had contacted Senator Childs Administrative
Assistant in reference to the old Dania Elementary School and had received a re-
sponse indicating that a possible grant may be acquired, but due to the length
of time it may take to acquire this, he suggested, that we check with the County
to see if they have any surplus funds. Commissioner Cook stated that she planned
to meet with the County Commission to check this out.
Commissioner Donly recommended that the City check into the cost of
demolishing the old Dania Elementary School . He suggested that the Commission
consider the possibility of demolishing the building and keeping the columns
in front and creating some type of theme park around them.
Commissioner Donly asked that discussion of the possibility of the City
self insuring in the area of property liability be put on the next agenda with
a recommendation from the City Manager as to his recommendation of this and a
suggested amount of premium to be set aside in the event he felt this feasible
for the City to implement.
Commissioner Donly asked that a workshop be set to evaluate the mid-year
budget report. City Manager to set date.

1 . Public Hearings:
a) Second reading of ordinance approving the plat of Lone
Star. The Zoning Board recommended that the Commission
approve this plat with the stipulation that a site plan
be submitted and that the plat show utility easements
for water lines.
