! . A motion was made by Commissioner Cook, seconded by Commissioner
Donly to approve the Minutes of the Regular Meeting of August 9th,
Special Meetingsof July 21st and August loth and the Workshop
Meetings of August 4th, 1st and 16th. The motion was carried by all.
2 . Citizens' Comments
Mr. A. J. Ryan representing Mrs. Baker asked the Commission to
reconsider a variance request for Mrs. Baker at the next regular
commission meeting.
A motion was made by Commissioner Cook, seconded by Commissioner
Hirsch to reconsider Mrs . Baker's variance request at the next
regular meeting. City Attorney Adler would give a legal opinion
reconsidering this variance before the next meeting.
Mr. Pete Prossic spoke to the Commission regarding proper
licensing of trailers in Dania. City Attorney Adler informed
the Commission that he would call the State Licensing Inspector
to see if trailers are licensed properly in the City of Dania.
Mr. Prossic also asked the Commissioners if the Fishing Pier
is generating any profit for the City. Mayor Bertino informed
Mr. Prossic that figures would be available when the lease
expires . Also Commissioner Cook asked City Manager Lassiter
to provide figures of the cost of repairs on the pier since
the beginning of the lease.
Prossic asked the Commissioners if the city had any trees
'available to plant on loth Street. County Commissioner Ken
Jcnne spoke to the Airport Liaison Committee and informed them
that this would be permissible. Mayor Bertino stated that
trees may be made available for approximately $4.00 per tree
and that he agrees that it would be very attractive.

Mr. Walter Childers commented that the hugs are not- being
,prayed properly east of Federal Highway. fie also informed
the Commissioners that weeds along 3rd Avenue and the Golf
Course are waist high and the ditch needs to be cle,ined up,
Mayor Bertino stated that there is progress being made to
start cleaning up the areas that are not being taken care of,
2 (A) A motion was made by Commissioner Donly, seconded by Commissioner
Adams to consider as an Emergency Item a Resolution citing Mr.
Thomas E. Littrell, Building Official, for a job well done . The
motion passed unanimously.
After City Attorney Adler read the body of the Resolution
to the Commission citing Building Official Littrell for Merit-
orious Service, a motion was made by Commissioner Donly, seconded
by Commissioner Cook to adopt this Resolution. The motion was
carried by all.
3 . A motion was made by Commissioner Hirsch, seconded by Commissioner
Cook to change the meeting date of the next regular meeting from
September 13th - September 12th. The motion was carried by all.
4. Mayor bertino announced that August 30th and September 12th will
be the dates of the Public Hearing for the first and second
reading of the budget, and the proposed milage increase.
5 . City Manager Lassiter informed the Commissioners, for their
information, that the firm of Spina & Romano that had been
retained as Auditors for the City of Dania have dissolved
their partnership. Messrs . Spina & Romano spoke to the Commissioners
,ind stated that since Mr. Spina had retained the Audit for the
City of Dania since 1968 that the City should continue with
Mr. Spina's firm.
A motion was made by Commissioner Cook, seconded by Commissioner
Donly to continue the 1976/77 Audit with Mr. Spina's firm. The
motion was carried by all.
6. Mr. Tom Esposito spoke to the Commissioners regarding an easement
that he would like to have moved.
City Attorney Adler stated that he would like to prepare an ordinance
amending the charter that will make it possible to relocate a utility
easement within a platted subdivision without having to replat the
whole subdivision.
A motion was made by Commissioner Cook to refer this to the City
Attorney to draw up an ordinance that will be in proper form in
ord_r that Mr. Esposito will be able to move an easement 7' west
located on Lots 12, 13, 16 & 17 of Block 3 Dania Highlands PB 87
Page 1 and any request for future relocating of utility easements .
The motion was carried unanimously.
7. Mr . Cary Winningham of Broome & Farina was not present to discuss
the bids of modification of Dania Fishing Pier. City Manager
Lassiter informed the Commission that he had spoken to Broome &
Farina and they requested a postponement of opening the bids
until the meeting of September 12th.
A motion was made by Commissioner Hirsch, seconded by Commissioner
Cook to extend the time of receipt of bids for modification of the
Fishing Pier until the date of September 12th. The motion was
carried by all.

The motion was carried by all.

9• The mayor opened the Public Hearing on the second reading of
the ordinance approving the Plat of Powell Brothers Barge
Terminal.
After City Attorney Adler read the preamble of the ordinance
approving this, a motion was made by Commissioner Cook to
adopt on second and final reading the ordinance approving
Powell Brothers Barge Terminal.
The motion passed on the following roll call vote:

10. City Manager Lassiter opened discussion on the new Employee Health
Insurance Plan and informed the Commission that it would be beneficial
to consider this plan. Mayor Bert

A motion was made by Commissioner Donly, seconded by Commissioner
Adams that the City Administration enter into an Agreement with the
new insurance company to provide these rights for the employees
as soon as possible; and that the members of the Insurance Committee
receive a letter of commendation from the Commission. The motion
was carried by all.
City Manager Lassiter read the names of the Committee Members:

Mr. Melvin Harris - Recreation Department
Mrs . Vi Cooper - Public Works Department
Chief Eugene Jewell - Fire Department

11. Mr. Murray Goodman was present to submit to the Commission the
ratification of the P.B.A. Contract.
A motion was made by Commissioner Donly, seconded by Commissioner
Ilirsch to accept and sign this P.B.A. Contract between the P.B,A.
and the City of Dania and to publicly thank Mr. Goodman for doing
a fine job in negotiating this contract. The motion was carried
by all.
12. After City Attorney Adler read the title of the ordinance revising
197G/77 Water Budget, a motion was made by Commissioner Donly,
seconded by Commissioner Cook to adopt on first reading the
ordinance revising the Water Budget for 1976/77 and reducing
apprcpri.ations from a total of $475,606 to $467, 744.

Cook to adopt the resolution eliminating rates on sewer service.
The motion was carried unanimously.

Agreement with Broward County.

Cook to sign the Trafficways Agreement.

Addendum
1G• Mayor Bertino opened discussion regarding amendments to ordinance
#132 - Police & Fire Pension.
City Attorney Adler read the ordinance and explained the changes
being made.
A motion was made by Commissioner Donly, seconded by Commissioner
Hirsch to declare as an emergency item the readings of the amendments
to the Police & Fire Pension. The motion was carried by all.
This was considered an emergency in order to protect the city from
any liabilities that might arise.
A motion was made by Commissioner Cook, seconded by Commissioner
Donly to adopt on first reading the ordinance amending ordinance
#132 - Police & Fire Pension.
The motion passed on the following roll call vote:

A motion was made by Commissioner Cook, seconded by Commissioner

City Man,,yt<r Lassiter brought up discussion of Acting Police Chief
w' Rudy Rigo'ssalary. The Mayor instructed City Manager Lassiter
to have this item put on the agenda for the next meeting and to
have City Attorney prepare a Resolution.

City Attorney Adler was instructed by the Commission to look into
the insurance that covers public officials against liability suits. f`
City Attorney Adler brought up discussion of a Bottle Club to
be opened at The Hut. Commissioner Hirsch suggested putting this item
on the next agenda for discussion. y
City Attorney Adler suggested amending ordinance #100 to provide
for building on a single unplatted lot.
