Littrell s '•z K. ;, r ,. �µ A motion was made by Commissioner Donly, seconded by Commissioner _ F Kirsch to excuse Commissioner Adams from this meeting. The motion rwf was carried unanimou ly• 1. Publt Hearings a) A request by Attorney A. J. Ryan to re-schedule the Public Hearing of a special ex eption of Radio Station WAVS to allow a radio station and 3 towers to be constructed in an RM Zoning District was made be- cause Attorn.:y Ryan felt he did not have enough time to prepare a presentation at this time. A mo tfcn was made by Commissioner Cook, seconded by Commissioner ilirsch to defer this Public Hearing until July 26, 1977 and to charge Mr. Ginsberg (petitioner) an additional filing fee. commissioner Hirsch and Commissioner Cook voted yes, while Commissioner Donly and Mayor Bertino no; therefore, the motion did not pass. In the absence of Commissioner Adams, Attorney Ryan then requested that the petitioner have the benefit of a full commission and requested that this Public Hearing be postponed until August. Attorney Ryan's request was denied by the Commission and at that point Attorney Ryan then withdrew the request for a special exception. Emergency Item A motion was made by Commissioner Donly, seconded by Commissioner cook to declare as an emergency item discussion of a motion was carried by placed on Mr. Robert McCoys property. City Manager Lassiter informed the Commission that the total amount of tho lien is $398.06 and that the lien has been on this property for three years because of non-payment of a delinquent water bill. A motion was made by Commissioner Hirsch, seconded by Commissioner Donly to charge Mr. McCoy, Mr. Blackman and Mr. Nuby the amount of $398.06 plus 10% interest amounting to $438.06 plys disconnection charge to be paid within 90 days. The motion was carried unanimously. �:r OWN LIM s ! b) After City Attorney Adler read the preamble of the ordinance amending I:t ordinance no . 100, a motion was made by Commissioner Cook, seconded by rc ;, x Commissioner Donly to adopt on second reading an ordinance amending ordinance no. 100 concerning C-1 and C-2 zoning. r..?; Site motion passed on the following roll call vote: Commissioner Cook - Yes Commissioner Hirsch - Yes s' Commissioner Donly - Yes Mayor Bertino - Yes t"i Y t c ) After City Attorney Adler read the preamble of the ordinance changing F the general fund appropriations, a motion was made by Commissioner Donly, seconded by Commissioner Cook to adopt on second reading the ordinance amending City Budget for Fiscal Year 1976-77. The motion passed on the following roll call -vote: ! Commissioner Cook - Yes Commissioner Hirsch - Yes Commissioner Donly - Yes Mayor Bertino - Yes SAS 2 . Lassiter, Sr. City Clerk: Wanda Mullikin City Attorney: Frank Adler Absent: Vice Mayor: James Adams Discussion of City Insurance Coverage. Mayor Bertino opened discussion of the law that was passed recently by the Legislature which limits the amount of liability coverage a municipality is required to carry. The law states the limited amount of liability is $50,000.00 per person and $100,000.00 per Occurence. City Attorney Adler expressed his interpretation of the law and informed the commissioners of a meeting of Public Attorneys of Broward County where a discussion involving this new law was discussed and he advised the commissioners not to take any action in reducing insurance coverage at this time. Mr. Frank Porto, Davey Insurance Co. and Mr. Odis Carlan, Fred S . James Co. were also present and advised the commission nct to make any changes at this time .
