Duncanson Vice Mayor: John Bertino Commissioner: John Kay City Manager: John Lassiter { City Clerk: Wanda Mullikin City Attorney: Jack Milbery Building Official: Tom Littrell Zoning Consultant: Luther Sparkman 1. }Toward Hirsch' s resignation. Mr. Hirsch appeared before the Commission and asked that his letter of resignation be rescinded so that he might remain on the Planning and Zoning Board. A motion was made by Vice Mayor Bertino, seconded by Commissioner Kay to not {; accept Mr. Hirsch' s resignation. The motion passed by a E ti unanimous vote. 2 . Mayor Duncanson opened the public hearing on the 1st reading of an ordinance rezoning the area south of the Dania Cut Off Canal east of U. S. Highway N1. Attorney Clarke Walden representing several citizens presented a letter (attached) 'r of objections to the method of notice given to the citizens in reference to the public hearing. City Attorney Milbery stated that in his opinion all requirements for advertising set in the State Statute were met and could see no problem with taking action on the ordinance. Mayor Duncanson asked for comments from the Commission and the audience. Vice Mayor Bertino and Commissioner Kay had major changes they would like to see made in various areas. City Attorney Milbery suggested that if the ordinance was going to be changed in order to avoid substantially any legal problems, that they take no action on the ordinance and re-set the ! dates of the public hearings. Therefore , the Commission instructed Building Official Littrell to cancel the public hearing on January 26th and a workshop was set for January 19th after the special meeting. 3 . A motion was made by Commissioner Kay, seconded by Vice Mayor Bertino to adopt the resolution authorizing the proper officials to execute the Local Public Works application forms. Motion passed on a unanimous vote. 4. A motion was made by Vice Mayor Bertino, seconded by Commissioner Kay authorizing proper officials to apply for the Comprehensive Planning Program grant. The motion passed by a unanimous vote. S . A motion was made, sustained and passed unanimously to adjourn. Roll Call Present: Mayor: Robert H. Duncanson Vice Mayor: John Bertino Commissioners : Robert Donly John Kay City Attorney: Jack Milbery City Manager: John Lassiter City Clerk:. Wanda Mullikin City Attorney Milbery read the title of an ordinance for first reading proposing to annex an area into Dania and setting a date for a referendum on the annexation. Assistant City Manager Marant presented a study of the cost of annexing the area. After discussion, the Commission concurred that due to the fact that the reeuirements for annexation has changed considerably the staff was unable to complete an in-depth cost study. Therefore, Vice Mayor Bertino made a motion, seconded by Commissioner Kay, to not pass this ordinance and that the admin- istration conduct a three stage cost study of the area west to State Road 7. The motion passed on the following roll call: Mayor Duncanson - yes Vice Mayor Bertino - yes Commissioner Kay - yes A motion was made , sustained and passed unanimously to adjourn.
