DANIA CITY COMMISSION
OCTOBER 26 , 1976
Invocation by Reverend Van Arsdale of Dania Heights Baptist Church.

1 . Minutes A motion was made by Commissioner Adler, seconded by
Vice Mayor Bertino to approve the minutes of the following
meetings :
Special Meeting, October 7th
Regular Meeting, October 12th
Workshop Meeting, October 18th
The motion passed by a unanimous vote.
2 . Housing Authority Commissioner Donly made a motion to pass a
resolution establishing a Dania Housing Authority in accordance
with Florida Statute 421-04 . Vice Mayor Bertino seconded.
The Mayor appointees (5) to this board would be each Commiss-
ioner' s selection. A roll call vote was taken.

Vice Mayor Bertino - yes
Commissioner Adler - yes
Commissioner Donly - yes
The Mayor asked that names be submitted to him by Friday and
that the City Manager notify Commissioner Kay.
3 . Antique Car Show A motion was made by Commissioner Adler, seconded
by Vice Mayor Sertino to approve a request from the Dania Business
Society to erect a tent at Frost Park on January 21st-23rd for an
antique car show. The motion passed by a unanimous vote.
4 . Citizens Comments Pete Prossic and a representative of the Danians
asked about the wording of the referendum items on the November
ballot concerning its simplicity. A representative from Meadow-
brook Lakes complained about the sewer charges for condos. The
City Manager was asked to check into the matter.
5 . Mr. Paul Herman requested the Commission to declare a resolution
of necessity for the construction of water and sewer lines and
an alley between S. E. 3rd Avenue and S.E. 4th Avenue and S.E. 4th
Street and S. E. 3rd Place. The Mayor asked that Mr. Herman get

with Mr. Lassiter and give him a list of all the things he would
like to do, with alternatives, with or without the alley and the
Commission would take up the matter again at their next meeting.
5 . Water Fluoridation Mr. Milbery said he had written the General
Counsel of t e ounty and hadn' t received an answer yet, as to
whether the City was required by law to use fluoride in its water.
A motion was made by Vice Mayor Bertino , seconded by Commissioner
Donly to table this item. The motion passed unanimously.
6 . Public Hearing (con' t. from 10/12/76 meeting) Consideration and
action on a request by "Something Different , Inc. " at 1301 So.
Federal Highway for entertainment.. Mr. Milbery read a letter
which listed conditions for the owner, Mr. Pallazotto, to follow
in order to be granted this special exception. Vice Mayor Bertino
made a motion to add another stipulation and that was that no
exterior sign other than the written word to indicate the type
of entertainment. The motion died for lack of a second. A motion
was made by Commissioner Adler, seconded by Commissioner Donly,
to allow the special exception use with the conditions as written
up by the City Attorney. The motion passed with a 4-1 vote.
Vice Mayor Bertino voted no. (Conditional letter attached. )
7 . Dania Jai Alai A motion was made by Commissioner Donly, seconded
by Commissioner Adler to accept the proposal by Dania Jai Alai to
pave the east swale area of Frost Park and install parking meters.
Jai Alai will pay to have this done and turn the meter revenue
over to the City. The motion passed unanimously. John Knox,
promotion manager of Jai Alai was present and the Commission
requested him to look into the possibility of paving Northeast
First Street' s Swale area, at least part of it at Frost Park's
south side.
Ba. Consideration and possible action on termination notice of
existing garbage contract. A motion was made by Commissioner Adler,
seconded by Commissioner Donly, that the termination notice of
existing garbage contract be given to the contractor. The motion
passed unanimously.
Bb. A motion was made by Commissioner Donly, seconded by Commissioner
Adler to approve the proposed amendments to the present garbage
contract. Commissioner Donly withdrew his motion. The City Attorney
advised the Commission that he was just to bring these amendments
to the Commission this meeting and they would approve them next
meeting. The City Attorney also sent a copy to the contractor.
9 . A motion was made by Vice Mayor Bertino, seconded by Commissioner
Donly, to pass the resolution approving the 11201" Facilities Plan.
The motion passed by a unanimous vote.
10 . Ordinance-Emergency Consideration and possible action on an
orTnance increasing rates and charges for sewer service. A
motion was made by Commissioner Donly seconded by Vice Mayor
Bertinoto declare this an emergency. 'his will go into effect Nov. 1st .

A motion was made by Vice Mayor Bertino, seconded by Commissioner
Donly to pass this ordinance on first reading.

11. Ordinance-2nd Reading The Mayor declared the public hearing
opened. A motion was made by Vice Mayor Bertino, seconded by
Commissioner Adler to pass on second reading an ordinance pro-
viding for licensing of medical rescue technicians in the City
of Dania. The motion passed unanimously.

1.2 . A motion was made by Vice Mayor Bertino, seconded by Commissioner
Donly, to accept the City Manager and Police Chief' s recommendation
to purchase two portable radios on State contract bid price. The ==
motion passed unanimously.
13 . Commissioner Donly recommended and made a motion that George Thomas
of 35 Northwest 6th Avenue be appointed to the DARCOM Board.
Commissioner Adler seconded and the motion passed unanimously. u
lk. Bid Awarding A motion was made by Commissioner Adler, seconded is
by Commissioner Donly to accept the City Manager' s recommendation v
to award the bid for the 50 ton water cooling tower to Meyer's
Air Conditioning Co. in the amount of $5,192. 00. The motion fi
passed unanimously.
15 . Proposals Consideration and possible action on advertising for
firm proposals for the operation of the tennis courts at Frost
Park. Mr. Tomaini said he would like to see the City's tennis
courts remain free to the public, and under the direction of
the Recreation Department. The Commission agreed and no action fi
was taken on this matter.
16 . Surplus Property The City Manager presented the Commission with
a lest of property owned, but no longer useful to the City. A
motion was made by Commissioner Adler, seconded by Vice Mayor
Bertino to declare this property surplus and for it to be
put out for bid. The motion passed unanimously.
17. Public Works Act Application Commissioner Donly made a motion
seconded by Vice Mayor Bertino that we apply for funds through
the Public Works Act, and that our first priority be additional
administration space (city hall) , and that second be either the
million gallon water tower, construction of a second floor at
the fire house or expansion of the senior citizen's building.
The motion passed unanimously.
18 . A motion was made by Commissioner Donly, seconded by Vice Mayor
Bertino to pass the resolution adopting agreement #7652-16
between the Broward Manpower Council and the City of Dania.
The vote passed unanimously.
19 . Mr. Littrell, Building Official, had requested the Commission' s
permission to hire a part-time building inspector until he
recuperates from his illness. A motion was made by Commissioner
Donly, seconded by Commissioner Adler to instruct the City Manager
to look into the situation and administratively handle the problem.
The motion passed unanimously.
20. Comments Mr. Milbery said the appeal date for the beach parking
snot was November 5 and since this was the last meeting before
that date , he would like the Commission to declare this an
emergency item so he could appeal that portion which has to do
with the constitutionality of the ordinance. A motion was made
by Vice Mayor Bertino, seconded by Commissioner Donly, to declare
this an emergency item. The motion passed unanimously. A motion
was made by Commissioner Donly, seconded by Vice Mayor Bertino
to give Mr. Milbery authority to appeal the suit. The motion
passed unanimously. Vice Mayor Bertino said he had a request from
O1sen' s principal to have a policeman in front of the school from
2 : 15 to 2 : 30 p.m. as he is concerned about( e traffic

RE: Special exception for entertainment
Gentlemen:
As a result of your "request at the October 12, 1976 Commission
Meeting, I would recommend for consideration the following motion
to grant an entertainment special exception at the location of
1301 South Federal Highway, Dania, Florida.
I would recommend the motion as follows:
That a special exception use for entertainment shall be
granted to the site located at 1301 South Federal Highway,
Dania, Florida, being lots 1-13 & 18-23 of Block 3, Dixie Way,
subject to the following conditions:
(a) The only entertainment permitted shall be musical,
instrumental and vocal.
(b) The music shall not be discernible outside of the
building on the site.
(c) The only ingress and egress for motor vehicles
shall be by way of Federal Highway all other areas of the site
shall be closed to adjoining stre s or alleys by beautified
barriers such as trees, shrubbe , planters and similar restraints
to vehicle traffic.
