Consideration and possible action of reassignment of Captain Ton 's lease Captain Joseph Dellaera appeared before the commission to present three pro- posals to the City for leasing the property along the intracoastal waterway. The Mayor pointed out that the City is now seeking proposals for the overall beach area including the Ocean Protein area and, therefore, it wouldn't be advisable to lease this property on a long term basis. Commissioner Kay made a motion, seconded by Commissioner Donly to terminate the lease with Captain Tony and have the City Attorney proceed with collec- ting the $1300 in arrears. Motion passed unanimously. Commissioner Donly made a motion to grant a six month lease with the same terms as Captain Tony's, to be effective on July 15, 1976, and terminate on December 31, 1976. Motion seconded by Vice Mayor Bertino and passed unanimously. 2. Consideration and possible action on a request of Andre Consultants Vice Mayor Bertino made a motion to deny the request of Andre Consultants to hold 12 concerts at the Dania Jai Alai Palace during the period of July 15, 1976, through November 1, 1976, due to the fact that it has not yet been determined whether the Jai Alai building is a safe structure. After discussion, Vice Mayor Bertino withdrew his motion and asked the City Attorney to check into this and report back to the Commission at the July 13 meeting. 3. West well field and transmission line funding The Commission was presented with a proposal to fund a portion of the west well field through negotiating a note with the Dania Bank in the amount of $128,476. Acting City Manager Mullikin presented a report depicting the anticipated cash flow through the water fund for the balance of the fiscal year com- pared to the anticipated expenditures. Based on this report, Acting City Manager Mullikin recommended that the City ask only for a written commit- ment from the Dania Bank granting them a one year option to use this finan- cing if necessary. The Commission agreed with this recommendation. 4. West well field and raw water line bid awarding Commissioner Donly made a motion seconded by Commissioner Kay to award the bid for the west well field to American Consolidated in the amount of $221,476 to be completed within 150 days of signed contract. City Commission -I- June 28, 1976 Nu Mayor Duncanson pointed out that the Commission had not as yet authorized the proper officials to sign the license agreement with Florida Power & Light on the right-of-way of the property for this project. Commissioner Donly then withdrew his motion. Commissioner Donly made a motion seconded by Vice Mayor Bertino to authorize the proper officials to sign the license agreement with Florida Power & Light at a cost of $5 to be paid over a five year period at $1 per year. Motion passed unanimously. Commissioner Donly made a motion, seconded by Commissioner Kay to award the bid for the west well field to American Consolidated in the amount of $221,476 to be completed within 150 days of signed contract. Motion passed unanimously. Mr. Andre, from American Consultants, came late to the meeting due to a hold up in traffic. Commissioner Donly made a motion, seconded by Commis- sioner Kay to reconsider Item No. 2 on the agenda in reference to the con- certs. Motion passed unanimously. Mr. Andre presented his request and Commissioner Donly made a motion, seconded by Mayor Duncanson (after passing the gavel to Vice Mayor Bertino) to grant this request providing that all City requirements for holding these concerts are met. Motion passed on the following roll call vote: Vice Mayor Bertino yes Commissioner Donly yes Commissioner Kay yes Mayor Duncanson yes 5. Discussion and possible hiring of a City Manager Vice Mayor Bertino made a motion, seconded by Commissioner Kay to appoint Mr. Amadeo Tomaini as City Manager for the City of Dania. Mayor Duncanson, after passing the gavel to Vice Mayor Bertino, made a motion to table this until July 6, 1976. Motion failed for lack of a second. The original motion failed on the following roll call vote: Vice Mayor Bertino yes Commissioner Donly no Commissioner Kay yes Mayor Duncanson no Vice Mayor Bertino then made a motion, seconded by Commissioner Kay to appoint Mr. Richard Marant as City Manager for the City of Dania. Motion failed on the following roll call vote: Vice Mayor Bertino yes Commissioner Donly no Commissioner Kay yes Mayor Duncanson no The Commission set a workshop for July 12, 1976, at 8:00 p.m. to review the resumes submitted for the City Manager position. Consideration of a resolution to finance the west wellfield and transmission line project by negotiating a note with the Dania Bank for funding needed in excess of contributions from the City' s water fund, combined utility fund, and retained earnings, under authorization of City Ordinance 90 "AN ORDINANCE AUTHORIZING THE CITY COMMISSION TO ISSUE PROMISSORY OBLIGATIONS" at a rate of 6% annually (APR) with no prepayment penalty clauses.
