Van Arsdale, Dania Heights Baptist Church Pledge of Allegiance Roll Call: Present Mayor: Robert Duncanson Vice Mayor: John Bertino Commissioners: Frank Adler Robert Donly City Manager: John Kooser City Attorney: Jack Milbery City Clerk: Wands Mullikin Police Chief: Fred Willis Building Inspector: Thomas Littrelt Absent Commissioner: John Kay Zoning Consultant: Luther Sparkman Special Recognition Commissioner Donly made a motion, seconded by Vice Mayor Bertinottoo adopt a resolution in memory of Mr. William Jackson, former Mayor and City Commissioner. Motion passed una:imously. Mayor Duncanson presented the resolution to Mr. Jackson's widow, Mrs. William Jackson. 1. Commissioner Donly made a motion, seconded by Vice Mayor Bertino to approve the minutes of the Workshop Meeting of April 19th and the Regular Meeting of April 20th. Motion passed unanimously. 2. CITIZENS COMMENTS: Mr. Pete Prosaic pointed out to the Commission the inconvenience for some citizens of having the Commission Room on the second floor of the building and asked the Commission to took into the possibility of another meeting place. Mr. Pete Prosaic also suggested that the City encourage the County to extend Dania Beach Boulevard further West. Mr. Charles Demussio suggested placing folding chairs in the back of the Commission Room when there is an overflow of people. He also complained about the noise from the air conditioner in the back of the room. Mr. Demussio commented on renovating the old Dania Elementary School building into City Hall. Mr. Murray Sockett of the Dantans complained about the hazard of traffic at Stirling and Griffen Roadr.6 USS Intersections. Mayor Duncanson asked that a resolution be presented for adoption at the May 18th Meeting requesting the County to install signalisation at both of these intersections. 3. Mr. Ken Jenn9,County Commissioner, presented a slide presentation on the history of the airport and the future terminal complex. City Commission -1- May 4, 1976 ti Many citizens were concerned and questioned Mr. Jenne and Mr. Lee Wagner, airport manager, about the future statue of N.W. loth Street. Mr. Wagner explained that according to the present plan N.W. Loth Street will remain as a service road with the connecting road to be built North of 10th Street with a landscaped buffer zone in between. On a motion by Commissioner Donty, seconded by Vice Mayor Bertino the Commission adopted a resolution protesting any development of Ft. Lauderdale - Hollywood International Airport that Mould have any adverse affect on the residents of Dania or on the residential nature of N.W. 10 Street. Motion passed unanimously. 4. Public Hearings - Planning and Zoning a. Mayor Duncenson opened the public hearing which concerns Lot 28, Block 2 of Dania Beach Resub, also known as 234 East Danis Beach Boulevard, the nature of the hearing to consider a petition for variance to Section 32-36 of the Dania Zoning Code. This variance would allow setbacks for apartments to be the same as business setbacks; subject property being in a B-2 zoning. Commissioner Adler made a motion, seconded by Vice Mayor Bertino that this public hearing concerning a variance be approved. Motion passed unanimously. b. Mayor Duncanson opened the public hearing which concerns Lot 13, Royal Palm Vista let Addition, also known as 325 N.E. 5th Court. The hearing is to consider a petition for variance to Section 32-84 of the Dania Zoning Code. This variance would allow a screened swimming pool enclosure to be constructed on part of the required 25' rear setback on a waterway. Commissioner Adler made a motion, seconded by Commissioner Donly that this public hearing concerning a variance be approved. Notion passed unanimously. c. Mayor Duncanson opened the public hearing which concerns Lot 7, Block 46, North Hollywood also known as 24 S.W. 13th Street. The hearing is to consider a petition for variance to Section 32-135-1 as amended by Ordinance No. 39 of the Danis Zoning Code. This variance would allow 4 units to be constructed on a lot which is large enough for 3 units; subject property being in an R-3 Zone. Commissioner Donly made a motion, seconded by Commissioner Adler to table this item due to the fact that the planning and Zoning Board had taken no action on it at their meeting because the petitioner did not appear. Motion passed unanimously. 5. Public Hearings - Ordinance a. Mayor Duncanson opened the public hearing to consider the second reading of an ordinance approving a plat for Robert R. Derector 6 Company at 775 Taylor 'Road. This was approved on first reading on April 20. 1976. Commissioner Donly made a motion, seconded by Comissioner Adler that this erdiance be passed on second and final reading. Notion passed on the following roll call vote: Commissioner Adler - yes Vice Mayor Bertino - yes Commissioner Donly - yes Commissioner Ray - absent Mayor Duncanson - yes b. Mayor Duncanson opened the public hearing to consider the first reading of an ordinance approving a plat known as Royal Palms Vista East, with a lot size variance to Section 32-81 of the Dania Zoning Code. The land is legally described as the 91/2 of the SE1/4 of the SWI/4 of the NW1/4 less the 5131.60' and less the E25' of Section 35, Township SO South, Range 42 East. Commissioner Adler made a motion, seconded by Commissioner Donly that the first reading on this plat be approved. Motion passed on the following roll call vote: Commissioner Adler - yes Vice Mayor Bertino - yes Commissioner Donly - yes Commissioner Kay - absent Mayor Duncanson - yes Second reading of the Ordinance to be at the June lot meeting. City Commission -2- May 40 1976 »a c. Mayor Duncanson opened the public hearing and second reading of an ordinance permitting the keeping of a rabbit as a pet. This was approved on first reading on April 20, 1976, Mrs. Lopes questioned why the rabbit ordinance was originally passed and why it is now z starting up again. Mayor Duncanson explained that in the pest some citizens were abusing the keeping and breeding of rabbits and this was to amend the no-rabbit ordinance to allow the keeping of one rabbit per residence as a pet. Commissioner Donly made a motion, seconded by Commissioner Adler to adopt the ordinance. ' Motion passed an the following roll call vote: x Commissioner Adler - yes Vice Mayor Bertino - yes Commissioner Donly - yes Commissioner Kay. - absent Mayor Duncanson - yes r: d. Mayor Duncanson opened the public hearing and second reading of an ordinance repealing Ordinance No. 22 relating to minimum standards of hygiene for food establishments and providing for the issuance of permits and approvals for such establishments. Commissioner Donly made a motion, seconded by Commissioner Adler that this ordinance be adopted on second and final reading. Motion passed on the following roll call vote: Commissioner Adler - yes Vice Mayor Bertino - yes 4; Commissioner DonLy - yes Commissioner Ray - absent Mayor Duncanson - yes 6. Real Property In considering action on a request of Mrs. Gertrude Temple, the City Attorney presented a quit claim deed to correct an error that was made in prior years when the right-of-way on Mrs. Temple's property was deeded to the City. Commissioner Adler was in doubt as to whether the City could legally grant a quit claim deed due to a similar case he was familiar with in the County. The Commission instructed City Attorney Milbary to confer with Commissioner Adler as to how to correct this error and present it at the May 18th Commission Meeting. Vice Mayor Bertino made a motion, seconded by Commissioner Adler to table this item until the May 18th Meeting. Motion passed unanimously. Mrs. Blandino, purchaser of this property, expressed her displeasure in the delay in correcting this error. 7. Taxicab and Limousine Ordinance City Manager Kooser asked the Commission to consider using the County Ordinance for regulation of taxicabs. Commissioner Adler suggested that we use the language contained in the County Ordinance and establish a new City Ordinance for regulating taxicabs. 8. Bid Award a. City Manager Kooser recommended that we purchase the 21' police patrol boat from Correct Craft for $7,298. He explained that this is not the lowest bid but the best for the City. Since no action on this could be taken until the ordinance concerning Time Financing was considered, the Commission postponed this item until a later date. City Commission -3- May 4, 1976 i v, AINk b. City Manager Kooser recommended that the bid for the repairs to the Modetlo Park Pool be awarded to United Pool for $3,662.00. Mr. Bob LaCroix to install the lights and transformer for $600. On a motion by Commissioner Donly, seconded by Commissioner Adler the Commission agreed that the bid be awarded to United Pool. Motion passed unanimously. 9. Board Appointments There were no appointments to the Dania Architectural Review Commission. Mrs. McMillan had been contacted but was unable to serve due to prior commitments. There were no appointments to the Economic Opportunity Coordinating Croup Board of Directors. Commissioner Adler made a motion, seconded by Vice Mayor Bertino to adopt a resolution to appoint Mrs. June Silvernale to the Broward County Human Relations Commission. Motion passed unanimously. 10. Front End loader Purchase Agreement The consideration of a new financial arrangement to purchase a front end loader for the City of Dania was tabled until a later date. 11. Gift and Gratuities Policy The consideration of gift and gratuities policy of the City was to be presented for consideration as an ordinance at the next meeting. 12. Approval of Bills for April. 1976 Commissioner Donly made a motion, seconded by Commissioner Adler that the bills for April, 1976 be paid. Motion passed unanimously. 13. Time Financing Ordinance City Attorney Milbery presented an ordinance for Time Financing authorising the City Commission to issue promissory obligations to be repaid within a period not to exceed 120 months, setting an Interest Rate not to exceed 1% above the prime at the time of loan and placing a 200,000 dollar limit, on the total of such promissory obligations. Commissioner Donly made a motion, seconded by Commissioner Adler to adopt this ordinance on first reading. Motion passed on the following roll call vote: Commissioner Adler - yes Vice Mayor Bertino - no Commissioner Donly - yes Commissioner Ray - absent Mayor Duncansou - yes Second reading and public hearing to be held at the June 1, 1976 Commission Meeting. COMMENTS: Mayor Duncanson presented a proclamation from the Shriners and declared Friday, May 14 as Shrine Hospital Day in Dania and' Sunday, May 16 as International Shrine Hospital Day.
