WORKSHOP MEETING
DANIA CITY COMMISSION
FEBRUARY 12, 1976

The workshop meeting of the Dania City Commission of February 12, 1976, was
called to order by the Mayor, the purpose of which was to discuss the new
proposed zoning ordinance.
Mayor Duncanson informed all present that the Commission has a lengthy Job
ahead, and that the proposed zoning ordinance should take top priority now.
There are two things to consider: 1. Section 6.30 - Signs,and 2. Coordinat-
ing the new zoning ordinance with a new zoning map It was agreed by all
present that the sign ordinance, Section 6 30, should be exserted from the
zoning ordinance and that a separate ordinance be written at a later date.
Mayor Duncanson stated that the review of the proposed zoning ordinance should
be proceeded page by page.
Luther Sparkman informed the Commission that the Planning & Zoning Board felt
that the new zoning ordinance was basically a good ordinance. The Board
tried to conform this ordinance to fit the needs of the City of Dania, taking
into consideration existing platted lots throughout the City.
Mr. Littrell informed the Commission that he felt that provisions should be
made in the new zoning ordinance to allow business in residential areas as
an accessory use, as a family relationship; Mayor Duncanson agreed.
Mayor Duncanson requested that Jean Cook give the Commission a review of their
workshop meetings on the proposed zoning ordinance. Jean Cook gave the Commission
a review of the Planning 6 Zoning Board Worshop meetings according to their
minutes of November 17, 1975, December 2, 1975, December 9, 1975,
December 16, i975, January 6, 1976, January 12, 1976, January 13, 1976,
January 20, 1976, and February 3, 1976.
Mayor Duncanson thanked the Planning b Zoning Board for their Input into the
proposed zoning ordinance.
Mayor Duncanson expressed his concern of the ommission of printing plants from
all the industrial zones. Tom Littrell informed the Commission that it could
be allowed as an exceptional use by City Commission approval .
Jean Cook informed the Commission that the Planning b Zoning Board felt a 10
foot side yard setback was too restrictive for existing platted lots. Tan
Littrell informed the Commission that a 10 foot side yard setback was stipulated,
taking into consideration dwellings which are built facing the side yard. Mr.
Littrell suggested that a formula be established based on a percentage of the
lot width with a maximum of ten feet. Mayor Duncanson stated that this was a
good point, and he instructed Mr. Littrell to work up a formula which would
apply for the next workshop meeting.
There was a discussion on the number of dwelling units per acre in the multi-
family zoning classification. Commissioner Bertino stated that watever is
established as the criteria per acre can always be taken away by a court decision.

The Commission felt that 1 .5 parking spaces per dwelling unit was too low as per
the Planning b Zoning Board's recommendation of January 12, 1976, and that it
should remain at 2 spaces per dwelling unit.
Jean Cook reported that the Planning 6 Zoning Board felt that on Page 55 of the
new zoning ordinance, Section (d) (1) should be deleted. Mayor Duncanson felt
that possibly another stipulation could be added to monitor such signs instead
of deleting this section altogether.
Jean Cook reported that an Page 61 , c. Distance Between Bulldln s and Driveways,
that twenty-five (25) feet was recommended for change to ten 10 feet. Mr.
Littrell informed the Commission that the reason the requirement was set at
25 feet was due to the fact that at a closer distance, cars pulling up into
parking lots for multi-family dwellings would distrub other tenants/owners.
Tom Littrell questioned the Planning s Zoning Board's reasoning in deleting
Recreation Space on Page 62. Jean Cook stated that the Board felt the criteria
was too high.
Mayor Duncanson questioned the Planning & Zoning Board's reasoning in deleting
,Article 7, Planning Unit Development, from the zoning ordinance. Jean Cook and
Luther Sparkman reported that the Board felt there were no areas in the City
large enough to put into this classification. Mayor Duncanson stated that
Broward County will probably require a PUD classification; it can be a very
useful tool .
The deletion of the public hearing requirements before the Planning b Zoning
Board was discussed at length. It was decided by all commission members
present that it should remain so if it was legally correct. Mayor Duncanson
instructed City Manager, John Kooser, to contact the City Attorney and get
his legal opinion on this matter before the next workshop meeting. Mayor
Duncanson stated that the Planning & Zoning Board will still be consulted in
an advisory manner even though a public hearing is not held before them.
Mayor Duncanson stated that he basically liked the new zoning ordinance; that
it is pretty close to the county zoning.
Mayor Duncanson asked Mr. Littrell to give the Commission a brief review of
the new zoning ordinance.
Mr. Littrelt Informed the Commission that the new zoning ordinance was taken
from other ordinances in the state of Florida and that it does establish
better planning. The criteria established are my own ideas, however, they
can be changed. As many nonconforming uses as possible should be eliminated
when establishing specific criteria. Site plan approval will be by the Building
Official , however, it must also go to the Police Department, Fire Department,
City Manager, and engineering experts (if necessary). This ordinance provides
the necessary criteria for architects to work with.
Mayor Duncanson said he wanted two things: 1. That the sign ordinance
section be deleted from the new zoning ordinance and established as a separate
ordinance at a later date, and 2. Delay the land use assignment until the new
zoning ordinance is passed.
It was suggested that the areas that should be zoned for a lower density but
have previously been assigned a zoning designation under Chapter 32, may apply
a savings clause if permits for land use are filed within two years of the
passing of this Chapter.
