DANIA CITY COMMISSION
DECEMBER 16, 1975

2, The minutes of the Regular Meeting of December 2nd,and.the Special
Meeting of December 5th were. approved on a motion by Commissioner
Bertino seconded by Commissioner Donly.
3, Citizens Comments
c Rev. A.B. Van Arsdale complimented the City Manager and the police
chief and the negotiating team on the negotiations of the police
r contract.
4. Mayor Duncanson opened the public hearing for the second reading
of Ordinance 83 pertaining to collection charges on delinquent
accounts. There were no objectors. After discussion; Mayor Duncanson
declared the public hearing closed. On a motion by Vice Mayor Bertino,'
seconded by Commissioner Donly the commission unanimously decided to
adopt the ordinance on the following roll call vote:
Commissioner Bertino - yes
Commissioner Donly - yes
Commissioner Kay - -yes
Mayor Duncanson - yes
5.8. The following five bids were received for the repair of Modetto
Park swimming pool: Reed, United, Guardian, Florida, Florida Pool
Service. City Manager Kooser recommended that Reed pool be awarded
the bid as lowest bidder. A motion to consider this an emergency item
was made b�! Commissioner Donly and seconded by Commissioner Kay. After
discussion Commissioner Donly made a motion to table this item until
December 22nd special meeting. Motion died for lack of second. Commissioner
Bertino questioned the bidding procedure and it was decided on a motion
by Vice Mayor Bertino, seconded by Commissioner Donly to resdvertise for
bids for January 6th meeting. Motion passed unanimously.
S.City Manager Kooser presented two open proposals for the repair of1he
:'oli.ce Department roof, These were R & J roofing in the amount of
and Apex roofing in the amount of $4,080.00..A motion was,

this an emergency item. Motion passed unanimously. A motion to

seconded by Vice Mayor Bertino.

There was some question as to considerable difference in. the
proposals. A motion to table this item until Monday nights
special meeting of December 22nd was made by Commissioner Donly,
seconded by Vice Mayor Bertino and passed unanimously. This
was done in order'for City,Manager Kooser to have time to check
into the difference in ,bida.
6. The consideration of the drainage problem in the city was brought
before the commission mainly because 'of` the Dania Bank Drainage.
City Manager Kooser to ch'eck` fdrther into this" situation. There
was further discussion concerning the drainage problem in the
Southeast 'section, City attorney,,, Mitliery felt that -since the old
drainage district had been abolished in the city that it would ..have .
to establish a new one, lie pointed out two options in which to
accomplish this. 1.) Set up an area wide, special assessment or 2:)
to set up a drainage district to be funded by' a bond issue. Mr.
Bill Brook reported that"he knew of plane that had been drawn for
this drainage district ,approximately..ten years ago and suggested
that City Manager Kooser and City Attorney Milbery search further.
into their records to see if they could find these, It was generally
decided that the city need a preliminary survey in the most serious
areas as soon as possible;
7, Murray Goodman, representing the Dania Lions Club, asked permission
from the commission to sponsor a Bicentennial contest to creste.a .
new city seal . This seal. to be subject to approval of,.the commissions
Commissioner Kay made a motion to grant this request, seconded by
Commissioner Ronly. There was a question as to the entry fee.
After discussion Mayor Duncanson, upon passing the gavel to Vice
Mayor Bertino, moved to amend the motion by striking from the official
entry form Item #11 which requires an entry fee. Motion passed on
the following roll call vote:
Commissioner Bertino - No
Commissioner Donly - Yea
Commissioner Kay - Yes
Mayor Duncanson - Yes
Vice Mayor Bertino made a motion to amend the motion .to add the city
will allocate $75 for first. prize; $50 for second prize and $25 for
third prize. There was opposition to this amendment snd •Vi•ce Mayor
Bertino withdrew his motiolx. A motion was then made;and seconded"
dto accept the motion as amended. Motion passed unanimously.
S. City Attorney Milbery presented a resolution establishing an .insurance
advisory committee for the city, "Commissioner Donty made. a motion
to amend this resolution to• limit ,the committee to residents of Dania. .
Commissioner Kay seconded the motion. Motion passed unanimously.
A motion was made by Commissioner .Donty, seconded by Commissioner
® Kay to adopt this resolution as amended. Motion passed unanimously.
Commission to present appointments. at the January 6bh meeting. .
9• On a motion,by Commissioner Kays seconded by Commissioner Donly, "
the Commission unanimously, appointed Vice Mayor Bertino and City .
sManager to the Ad Hoc Advisory Committe on Large User Waste water
Agreement.,
10. There was no action taken on the resolution authorizing the proper "
city officials to apply for the State• of "Florida recreational building_
i,nnrnvrment funds. Cit., Manager Kooser reported that the application, .,

ll . Mrs. Schuster questioned the commission as to why her request
for a permit for bingo at the Dania Elementary School carnival
was not on the agenda as she had requested, Due to the lack of
communication she was not notified that her request had been
moved up the the January 6th agenda. On a motion by Vice Mayor
Bertino, seconded by Commissioner Kay, the commission unanimously
declared this an emergency item. Motion was made and seconded
to grant this permit . Vice Mayor Ber.tino made a motion, seconded
by Commissioner Donly, to amend the motion to add that this permit
be contingent on city staff approval . Motion passed unanimously.
A motion by Commissioner Kay seconded by Commissioner Donly to
approve this motion as amended was passed unanimously. Mayor
Duncanson apoligized to Mrs. Schuster for the mix-up,
® 12, The matter of a modified procedure concerning fence variances was
discussed. The,fot.1,owing,actioq was taken: Commissioner Donly
made a motion„ cecondea. by Commissioner Kay to waive the $75 fee
for request of variance for a eii-foot fence until the new coning
ordinance is passed. Motion passed unanimously. Elmer Heisler
asked that the co4isaio� ,take care to define a fence in the
ordinance.
13. in considering the proposal to reimburse Armado Tomaini for
reasonable legal expenses, the commission took the following
action: City Manager Kooser and City Attorney Milbery was
authorized to contact Mr. Tomaini as to an .estimated fee from
® his attorney for the .commission to consider. This information,
to be presented at the Monday, December 22nd special meeting. ,• ''
14, Commissioner Kay made a motion, seconded by Commissioner Donly
not to approve the bills for the month of November,. Motion
failed. Commissioner Kay then.made a motion, seconded by Commissioner
® Donly to approve :the bills as paid for the month of November.
Motion passed unanimously.
Comments
Commissioner Kay commented that he felt that the'vecsntawamp land
® at Houston Park needs to be filled.
Commissioner Kay also reported that the optimist club meeting with
City Manager KooseT, Commissioner Kay and Recreation Director,
Army Tomaini ironed' out the situation of condltione 'At Frost Park, .
® City Manager Kooser reminded the commission of the apecial meeting
Monday, December 22 to consider the Police and fire contracts.
