a. Luther Sparkman spoke on the need for repaving S.E. Second Avenue.
4. On a motion by Commissioner Kay, seconded by Commissioner Donly, the Commission
unanimously voted to approve the minutes of the meetings of April 16, April 21,
April 23 and April 28.
• 5. City Attorney Milbery read the Ordinance to extend discontinuing nonconforming uses.
On a motion by Vice Mayor Bertino, seconded by Commissioner Donly, the Commission
unanimously voted to declare this Ordinance an emergency for the first and second
readings due to the fact that Mr. Glarentzos has waited so long to reopen the pro-
perty as a gas station because of the red tape involved in the zoning. Commissioner
Kay made a motion, seconded by Vice Mayor Bertino, that the Ordinance be passed on
first reading. The vote was unanimous as follows:

Commissioner Kay then made a motion, seconded again by Vice Mayor Bertino, that the
Ordinance be passed on second reading. The vote was unanimous as follows:

A 6. City Attorney Milbery read the Resolution extending a temporary permit to Mr. Glar-
entzos so that his property (Lot 10 and the Ej of Lot 9, Block 48, North Hollywood)
may be used as a gasoline filling station. This Resolution is a companion to the
previous Ordinance. If this Resolution and Ordinance were not adopted, Mr. Glarent-
zos would have to make structural changes to his property in order to comply with the
zoning law. On a motion by Vice Mayor Bertino, seconded by Commissioner Adler, the
Commission unanimously voted to adopt this Resolution. Mr. Glarentzoe was assured
~' that he could now proceed with his plans.

City Attorney Milbery handled the first reading of the Ordinance for the regulation
of bar-b-ques in multiple story buildings. On a motion by Commissioner Donly,
seconded by Commissioner Adler, the Commission unanimously voted to pass this
Ordinance on first reading, the vote being as follows:

8. The Commission discussed the Ordinance repealing existing Chapter 31 and creating a
new Chapter 31 providing for rules and regulations of the manufacture, sale and
distribution of water by the City including rates to be charged. The Commissioners
commented on certain points of the Ordinance that they feel should be corrected.
Vice Mayor Bertino made a motion, seconded by Commissioner Kay, that Section 31-20a
be amended to allow persons to shut off their water in case of extreme emergency.
Commissioner Adler being the only opposing vote, the Commission by majority voted
to accept this motion. Vice Mayor Bertino made a motion, seconded by Commissioner
Adler, that in Section 31-25c the one inch meter deposit be raised from $75.00 to
$80.00. The Commission unanimously voted to approve this motion. Vice Mayor Bertino
also made a motion, seconded by Commissioner Donly, that Section 31-31b be amended to
read that a citizen using a fire hydrant be required to show his permit to water
department employees "and/or citizens". Commissioners Adler and Kay, and Mayor
Duncanson voted against this motion, so the motion failed. Vice Mayor Bertino made
a motion that the minimum water charge be amended to $2.00 for the first 2000 gal-
lons, and 85c for each 1000 gallons over the minimum. The notion died for lack of a
second. Commissioner Kay is opposed to a vote on the Ordinance because he has not
seen any figures. Former Mayor-Commissioner William Jackson made the comment that
from his own past experience he advisee that the Commission check the figures before
taking any action. Mayor Duncanson suggested that the Commission pass the Ordinance
on first reading with the new rates, review the rates at the May 12 workshop meeting
and at the Public Hearing on May 19 the rates could be changed. City Attorney Mil-
bery said that this could be done as long as there are no significant rate increases
8 made at the time of the second reading. Commissioner Kay made a motion to table the
whole Ordinance until these rates can be reviewed. Due to lack of a second the motion
died. Commissioner Donly made a motion, seconded by Vice Mayor Bertino, that the
Commission adopt the Ordinance on the first reading. Commissioner Donly then Come
mented that there needs to be action taken on this Ordinance, and unless he can have
proof of the figures presented to him by the next meeting, he will vote against the
!A Ordinance on second reading. Vice Mayor Bertino voiced the same feelings, and re-
quested that Assistant to the City Manager McNally be present at the next regular
meeting to answer questions. City Attorney Milbery then read the Ordinance by title.

The motion was thus passed by majority vote. Commissioner Adler made a motion to
authorize the City to consult with the City Auditor and the City Engineer for their
opinions on the rate increase. The motion being seconded, the Commission unanimously
voted to accept Mr. Adler's motion.
9, City Attorney Milbery read the Ordinance repealing existing Chapter 24 and substituting
a new Chapter 24 entitled "Sanitary Sewer System' setting forth rules and regulations
for the collection, treatment, and discharge of sanitary sewage and other waste water
within sewer areas including fees and rates to be charged all users by the City. As
in the previous item #8 on the agenda, Mayor Duncanson stated that he feels that this
item needs to be studied further as the Commission has not seen any detailed figures.
Commissioner Kay made a motion to table any action on this item until the Commission

made a motion, seconded by Commissioner Adler, to have the City Auditor and the City

LO. City Attorney Milbery read the Ordinance adopting the Comprehensive Plan and land use
® map. Building Inspector Littrell presented the maps. There were objections to some
of the wording in the Ordinance and corrections were made. Mr. Milbery then read the
revised Ordinance. Commissioner Donly made a motion, seconded by Vice Mayor Bertino,
that the Ordinance be adopted on first reading. The motion was passed by a majority
vote as follows:

® Commissioner Adler stated that he voted no due to his opposition to the low density.
11. City Attorney Milbery read the Nepotism Ordinance by title. On a motion by Commissioner
Adler, seconded by Commissioner Kay, the Commission unanimously voted to adopt the
Nepotism Ordinance on second and final reading, the vote being as follows:

® 12. Mayor Duncanson read the Resolution opposing the recent rate increase of Florida
Power and Light Company. On a motion by Commissioner Adler, seconded by Commissioner
Donly, the Commission unanimously voted to adopt this Resolution.
13. Based on his tabulation of the bids that were received, City Manager Hampton recommends
that the bid for boating improvements at Houston Park be awarded to Hancock Marine
Construction Co. in the amount of $36,010.00. Some items have been deleted from the
original bid specifications which accounts for the lower bid than was originally
submitted. Commissioner Donly made a motion, seconded by Vice Mayor Bertino, to
accept Mr. Hampton's recommendation. The vote was unanimous.
14. The proposal of the South Florida Scouting organization was cancelled because Mr.
e Lippman was unable to attend this meeting.
15. City Manager Hampton requested the Commission's authorization to contact Active
House, Inc, regarding the removal of dead or diseased trees. On a motion by Commis-
sioner Donly, seconded by Commissioner Adler, the Commission unanimously voted to
give Mr. Hampton the authorization.
® in, Mayor Duncanson read the proclamation designating May 11-18 as Juvenile Diabetes
Week, and also a proclamation designating May 17 as Nicholas Polinari Day.

17• Due to relocation for employment purposes, the Streets and Sanitation Committee has
E lost two of its members. Commissioner Kay would like the Commission's approval to
appoint Kathryn Philpart and Norman Schultz to his committee. On a motion by Com-
missioner Donly, seconded by Vice Mayor Bertino, the Commission unanimously
approved the appointment of these two people to the committee.
r. 18. City Manager Hampton requested that special assessment #3-28, in the amount of
$347.67, be written off the books. The statute of limitation has run out on this.
On a motion by Commissioner Kay, seconded by Commissioner Donly, the Commission
unanimously voted to remove this assessment from the books.
19. City Manager Hampton gave a report on the progress of obtaining a school crossing
light on Dania Beach Boulevard. All that is needed now is the County Commission's

1. Mayor Duncanson reminded all that the Dania Community Band will present a free concert
at Frost Park on May 11 at 3:00 P.M.

r 9 2. Commissioner Kay stressed that Building Inspector Littrell needs more help in
preparing zoning maps.
