2. City Attorney Milbery has received information from Clarke Walden regarding the
r Danian's assessments which shows that an assessment was -made on lineal footage but
was never Legally set out in an ordinance as a tax district. If the City has in its
records documentation to show that it was legally only assessed for the first 150
F. feet, then the City can file a lawsuit. The 'condominium owners claim they have paid
their assessment, Mr. Milbery has asked City Manager Hampton to see what documents
4- he can come up with and will report when this information is obtained.

3. City Attorney Milbery reported on the State Paving claim, The State, through a sub-
contractor, damaged City property while doing work in Dania. Thera are witnesses to
the act. Mr. Milbery says the City did not have a contract with State Paving so it
cannot sue for breach of contract. However, the City can sue for personal property
damage, and the suit will have to be brought against the sub-contractor. Mr. Milbery
will proceed as the Commission directs.
4, The Commission discussed an ordinance for grass and lot clearing. Mr. Milbery report-
ed that City Manager Hampton recommends notifying the owner to place the premises
in good condition within ten days, and if this notice is not complied with, the
proper department will be engaged to do so, whether it be the City or an independent
contractor, and the cost will be levied against the property as a lien. City Attor-
ney Milbery recommends setting forth an explicit notification procedure - posting
the property and sending notice to the owner by mail - and also lengthen the time
over ten days. He also does not advise that the City hire an independent contractor,
Mayor Duncanson recommended using the Department of Public Works to do the work.
However, it was pointed out that for large acreage bulldozers would be needed which
Public Works does not have, Vice Mayor Bertino stated that he was under the impression
that this would relate to cleared lots, which brought up the discussion of what size
the lots should be. The Commission decided to discuss this further with the City
Manager and see what other surrounding communities have done about the subject.
5. The Commission discussed revising the City Charter. Among the highlights of the dis-
cussion were the following points:
A. Mayor Duncanson recommends having three Commissioners elected every two years,
51 and having an elected Mayor. This raised much discussion about the pros and cons of
the !ength of one, two and four year terms.
B. It is the general consensus that the Commissioners receive inadequate compen-
sation. It was pointed out that the Charter does not determine the amount of compen-
sation, but rather the Commission decides this. It was suggested that salaries be
;t put to a referendum vote, but this idea seemed unfavorable.

C. The present Charter gives the Mayor a one year term. It was suggested that
it be increased to two years.

E. The power of the City Manager to hire and fire department heads was questioned,

G. Discussion of the eight cent gasoline tax for County Bond Issue was removed from
the agenda as it had been discussed at a previous meeting.
7. The General Employees Retirement Plan was not discussed due to lack of time.
8. Vice Mayor Bertino asked the Commission's permission to look into the possibility
of hiring a dog catcher. He received the Commission's approval.
