SPECIAL MEETING
DANIA CITY COMMISSION
NOVEMBER 12, 1974
7:00 P.M.

2. The meeting was called to order by Mayor Ted Kay for the purposes of
installing newly elected Commissioners John Bertino and Robert Donly
and for th^. orderly transfer of the reins of government. Mayor Kay
asked the Commissioners if they had a comment to make.
Commissioner Adler stated he had enjoyed serving with this Commission
the past two years and looked forward to the next two years with the
newly elected Commissioners.
Vice Mayor Duncanson endorsed the statements made by Commissioner Adler
and further stated that there might have been differences of opinion, but
he recognized the sincerity of all the Commissioners and appreciated their
efforts and the learning process that he had been through. Commissioner
Jackson congratulated the winning candidates and wished them God Speed in
their service to the citizens of Dania. He stated that it had been an
honor and a privilege to have served as Mayor-Commissioner and asked that
the employees be given his thanks for the dedicated work they had done
for the City.
Commissioner Kay stated that the past two years had been enlightening and
9 that he looked forward to a very cooperative commission effort in the
next two years.
Mayor Kay said his farewells and stated that he had been privileged to
serve as Mayor and that Dania would be always close to his heart.
City Attorney then told the Commissioners he had .a letter to read into
the record, the letter recited his years of service with the City and of
the numerous Commissions he had been privileged to work with. The letter
pointed out that he had served the City since 1955, and even though he
was resigning as City Attorney, he would always be available for any advice
or assistance that he might be able to render to the City. Mr. Bertino
and Mr. Donly were then called forward and Mr. Walden then read the oath
of office to them for their acknowledgement: The newly elected Commissioners
signed the oath of office and were seated. The reorganization of the Commission
was then formalized.
On a motion by Commissioner Kay, seconded by Commissioner Bertino, Vice
Mayor Duncanson was nominated for Mayor and elected with Commissioner Adler
voting no. Commissioner Adler then nominated Commissioner Kay for Vice
Mayor, seconded by Commissioner Kay. The vote was Commissioners Adler
and Kay voting yes. Mayor Duncanson, Commissioners Bertino and Donly
voting no. Commissioner Donly made a nation to nominate Commissioner
ilertino as Vice Mayor, seconded by Commissioner Bertino. The vote was
unanimous.
Mayor Duncanson, Vice Mayor Bertino and Commissioner Donly introduced
the members of their families who were present. Each of the newly
elected Commissioners then stated that they would be available to the
citizens for suggestions and would do their best to serve the City and
its needs.
Commissioner Adler then commented that the election was over and the
Cornmission would work together on what is best for the City. Mayor
Duno--inson thanked Commissioner Adler for these comments and nothing
further to come before the body, the meeting was adjour d.

Gentlemen:
In the early part of the year, I submitted my resignation
as city attorney of City of Dania. At the meeting of the city com-
mission held on January 21, 1974 , I was honored by the refusal of
the commission to accept the resignation. However, at such meet-
ing , I did state as a matter of record that I desired only to serve
out the remainder of my term in office and that I would not accept
reappointment as city attorney after the 1974 general election.
I am not entirely certain as to what is the correct pro-
cedure to follow in stating my position at this time. However,
if a formal letter of resignation is required, then I respectfully
advise that I do hereby resign my position as city attorney to take
effect immediately.
As I have informed the city clerk on serveral occasions dur-
ing the past year, we have been making a thorough review of all of
our internal records since 1968 to make certain that same coincide
absolutely with the various agendas and minutes of the zoning board
and the city commission. We had made periodic verifications of a
like nature with the late Mary Thornhill while she served as city
clerk until 1967 . We selected Povember, 1968, as a beginning date
for the current verification because this was at about the point in
time that Municipal Code Corporation began working on the city's
records in a project which lasted for almost three years and which
led to the present 1971 Code of Ordinances.
As of today, we have reviewed and reconciled all of our

records with the various agendas and minutes of the city to about
'Y July, 1974 . We have spent most of our time since July, 1974 , in
® working daily on the comprehensive zoning ordinance which was just
adopted as of October 30, 1974 . It will require about one or two
weeks to complete our review from July, 1974 , to date. We perhaps
i have i handful (that is, about six or seven) routine ordinances or
resolutions adopted since July which require minor revisions or
® modifications as the result of some change suggested or authorized
at some recent city commission meeting. We will submit drafts of
such items, in final form, within the next week or so and will ask
'K Mayor Kay to sign any of such items which were passed or adopted
before this date.
® I mention the above review only to indicate my position that
the city' s legal affairs are in an excellent and current condition as
of this date. We are handling a few law suits involving the city.

a matter of days . Therefore, with your permission, I shall complete
the details regarding the particular suit. We shall continue making
appearances in any other suits until such time as the city commission
employs new counsel and so that a substitution of counsel may be made.

torney . Mr. Dubow indicates that he is willing to serve temporarily
at the next few meetings, if you ask him to do so. He is fully
qualified in municipal matters and will be glad to be of assistance
to the new commission. However, he emphasizes very strongly that
he does not desire the position of city attorney under any circum-
stances and is willing to serve only temporarily if such service
will be of assistance to the city while it interviews applicants
• for the position.
I was appointed to the position of city attorney as of July
1 , 1955, when my brother resigned to accept an appointment as one
of the local circuit judges. I take a great deal of pride in be-
ing able to say that I am only the third city attorney who has
® served City of Dania since 1927 when it dis-annexed itself from
City of Hollywood. I have been unanimously appointed to the posi-
tion by 17 successive city administrations. I have had the privilege
of serving under something like 35 different commissioners, all of
c,•hom rendered outstanding and loyal service to the city. Therefore,
it is frankly with a degree of emotional feeling that I now leave
O the position after almost 20 years of employment. It has been a
great honor for me to have had the opportunity to be of service to
the community.
I wish each member of the new commission every success in
office. I assure each that I will always be available to give any
0 lavice or assistance that may be requested regarding city matters.
