2. The City Attorney read the new zoning code ordinance on second and final
reading. There was much explanation of the historical background to the
® need for the new zoning code which will provide for future land use and
activities in the City. Some dlscussionvas had on the need to place a
limitation on the rights under the grandfather clause for approved develop-
ments which might not completely meet the requirements of the new code.
On a motion by Commissioner Adler, seconded by Commissioner Jackson, the
ordinance was amended to require that a permit must be issued and substantial
q construction started within three years from the approval of the site plan.
The amendment was adopted by unanimous vote. The Vice Mayor passed the
gavel 'to Commissioner Adler and made a motion that the M-17 and M-15 be
removed from the code. The motion died for lack of second. On a motion
by Commissioner Adler, seconded by Commissioner Jackson that the zoning
code as amended be adopted. A roll call vote was taken and Vice Mayor
qq� Duncanson voted No. The other three Commissioners voted Yes.
3. The City Attorney called the Commissioners attention to a letter he had
sent them concerning a suit the City is involved in which is the result
of a accident at Northwest IOth Street and the railroad.
