REGULAR MEETING
DANIA CITY COMMISSION
JUNE 5, 1974
I . Invocation by Clarke Walden.
2. Pledge of Allegiance.

4. On a motion by Commissioner Adler, seconded by Commissioner Kay, the
Commission unanimously approved the minutes of May 20th.
5. City Attorney reported that the question of collecting due assessments will
be finalized within the next two weeks after he had conferred with the
City Manager.
6. City Attorney presented a resolution requesting assistance from the State
of Florida in development monies for the planned development of the Southeast
ten acre park. On a motion by Commissioner Jackson, seconded by Vice Mayor
Duncanson the resolution passed unanimously.
7. City Attorney presented a resolution requesting Broward County to enter into
an agreement with the City of Dania for certain work to be done by Cbuntyforces
in the City parks. The City Manager was told to negotiate an agreement and
bring it back to the Commission for final approval . On a motion by Commissioner
Kay, seconded by Vice Mayor Duncanson the resolution was passed unanimously as
amended.
8. City Attorney presented an ordinance on first reading which would authorize
the City Manager to handle condemnations of property, yet provide for the
�► property owner to have an appeal to the City Commission if he disagreed with
the action of the City Manager. On a motion by Commissioner Adler, seconded
by Vice Mayor Duncanson, the Commission unanimously passed on first reading
the ordinance.
r 9. City Attorney requested that the resolution to bill for trash removal and
delinquent occupational licenses be continued until the next meeting because
of the question of placing the billing on the routine water bill .
i 10. City Attorney presented an ordinance concerning fences and permits for same.
After much confused discussion the ordinance was not considered.
It . City Attorney requested the forms for applications for variance permits and procedures be

12. City Attorney presented an ordinance to establish fire zones in the City.
upon the roquest of Mayor Kay, this was tabled to the next meeting for
Mayor Kay to report on his recommendation.
I . ordinance was read on second reading which prohibits unauthorized persons
from opt:ning the valves or making connections to the fire hydrants of the
t'ity. On a motion by Commissioner Adler, seconded by Commissioner Kay,
the Commission passed this ordinance on second reading.

IA. City Attorney presented an ordinance which would require streets to be
60 feet in width in all new plats of subdivisions. On a motion by Commissioner
Adler, seconded by Commissioner Kay, the Commission unanimously passed this
ordinance on first reading.
15. City Manager reported to the Commission as per their Instruction, that
Attorney Shahood had filed with the Manager's office a letter outlining
the conditions of operation of antique car repair business by Wayne Dunham.

16. The City Manager reported to the Commission that he had discussed the question
�• ® of insurance for the protection of the City in instances where adjacent
property owners had placed obstructions in•the swale area. The Manager had
talked to the City's insurance advisor and reported that home owners insurance
had been extended to cover this situation, but was advised the best policy
would be for the City to require permit and that monies collected for said
S permit be used to pay for a general insurance plan for the City. No action
was taken, but a motion by Commissioner Kay, seconded by Commissioner Adler
' was made to table this until the next meeting when Mayor Kay will report thereon.
17. City Manager reported that Public Works Director Brice would provide a report
fo the Commission in writing on the progress in keeping up vacant properties
in the City.

18. Request the Recreation Corporation of America to have the zoning hearing for
Drexel on the Pirate's World property set for public hearing was tabled
t- until the next regular meeting. On a motion by Commissioner Adler, seconded
by Vice Mayor Duncanson, the Commission unanimously voted to table this
until the next regular meeting.
19. City Manager reported that the master zoning map being prepared by Mr. Wiggins
is expected to be completed around June IOth.
20. Comm. Adler recommended that Milton Jones be appointed to the Charter Review
Committee. Commission agreed with this selection. Commissioner Adler then
brought to the attention of the Commission that the Little League World Series
will be held again in Broward County and that the City of Dania had contributed
$300.00 last year and requested the same amount be allocated for this play-off.
The idea was approved but it was suggested that this be an item on the agenda
of the IOth for final action.
® 22. Commissioner Jackson commented on the improvements in the Police Department
and gave credit to Chief Willis for his efforts in reorganizing this department.
23. Commissioner Kay reported that the Chamber of Commerce will appear before the
Commission at the meeting of June 17th to discuss the removing of parking from
Federal Highway. Commissioner Kay also asked the City Attorney If he had
finalized his research on the one percent Impact fee. The City Attorney
stated he would give them his answer at the next meeting.

Dear Mr. Hampton:
. in a recent telephone conversation we discussed the possibility
of the City granting permission to property owners to place
various styles of concrete objects on the edges of swales
extending from their sidewalk to the street and the affect this
may have upon the City' s Liability Insurance.
® The Liability Coverage in force does protect the City against
claims involving a condition in the premises of the City which
would include the sidewalks and swales and although there is
no restriction in the policy, it is conceivable that these
concrete items could create an additional hazard and, therefore,
wo feel that it should be held under some form of control and
® suggest that the City require. a Permit prior to allowing anyone

to place any obstructions on the City Properth: It may be further
advisable to also specify that the property owner assume liability
and hold the City harmless against claims up to a designated amount.
Since most Homeowner' s Policies are written at a minimum of
$25,000 Liability, this may be an adequate figure to consider. The
Homeowner' s Policy automatically extends to cover any contractual
obligation assumed in connection wi+-h +-ho nromicas of the named
insured.
