Kay Vice Mayor: Robert Duncanson Commissioners: Frank Adler William Jackson ® John Kay City Manager: Woodward M. Hampton City Clerk: Wanda Mullikin Acting City Attorney: Lavon Ward 2. Mayor Kay called the meeting to order at 6:35 P.M. Purpose of the meeting ® was to discuss two items: 1 ) A resolution to authorize the City Clerk-Auditor to take the Commission meeting tapes to a commercial professional firm for reproduction. 2) Special City Attorney Lavon Ward to report on the question of time to secure the additional 5% for the petitioners who are seeking to have ® Ordinance 32 repealed. The City Manager explained the need for adopting a resolution which would authorize Commission tapes to be removed from City Fiat] for reproduction and the cost to he paid for by City Attorney Clarke Walden. The City Manager read the resolution in total and on a motion by Vice Mayor Duncanson, ® seconded by Commissioner Adler, the resolution passed unanimously. Special Attorney Ward made his recommendations concerning Ordinance 32 and the related petition to repeal . He presented a written report to the Commission and recommended that the City present this question to the courts for a declamatory opinion. A motion was made by Commissioner Jackson, seconded by Commissioner Kay, that Attorney Ward be retained by the City to present to the courts the question of the validity of Ordinance 32 and for an interpretation of the Charter provisions concerning the initiative and referendum as applied to zoning ordinances. The vote was unanimous. ® On a motion by Commissioner Adler, seconded by Commissioner Kay, the Commission approved unanimously to have Attorney Ward prepare the proper petition for the petitioners for the additional 5% according to the provisions of the City Charter.
