The vote was unanimous. A motion was made by Vice Mayor Duncanson, seconded by Commissioner Jackson to approve the bills as paid for the month of December. The votc: was unanimous. ® I,. the City Manager presented the request by Holliday and Associates to clarify the projected zoning of the property on the north side of S.W. 3rd Street, west of Federal Highway. The consensus of the Commission is that the property will be zoned 'under the new zoning as projected for similar business use as present zoning is. 1. Jacques Gallet requested clarification of the projected zoning use of his property. His intent appears to be that he would build apartments at N. E. Ist Avenue and 1st Street. The property Is presently zoned 13-2 and apartments could now be built, however, the Commission pointed out that under the proposed business classifications that pyramid zoning is prohibited, i .e. no apartments in business zoning. Mr. Gallet will appear before the Commission later on definite use request. B. City Manager reported that Frank Fasce is to appear before the Zoning Hoard January 8th and later to be heard before the Commission. Al- this point the City Manager presented a request by H 8 H Crane, the low bidder on the water plant improvements, for an increase of 11 ,400. in the bid price due to an increase in equipment to be furnished by Infilco, After a lengthly discussion, on a motion by Vice Mayor Duncanson, seconded by Commissioner Jackson, the Commission denied the request and stated that the bidder should have provided for this possibility in his bid. ® Hoisy Inters appeared before the Commission to discuss crime incidents primarily in the black section of the City of Dania. He requested the Commission to study the problem of crime and to initiate programs that would strengthen the effectiveness of the Police Department to the bcnefit of the total community. The City Commission authorized a work- shop meeting for Monday,January 14th at 7:00 p.m. and the public is invited to attend. 10. Representatives from the D.O.T. discussed the congestion of traffic on U.S. I , the noed for new signals which would require realigning traffic lanes and removal of parking on U.S. I . On a motion by Commissioner Adler, seconded by Commissioner Jackson, the Commission authorized the City Attorney to draw a resolution incorporating the request of the Department of Transportation as outlined in their Irrfter of December 18, 1973, from District Traffic Engineer, John Wilson. It . The City Attorney presented a repealing ordinance to Ordinance 14, th.? IN open space surcharge. On a motion by Commissioner Jackson, seconded by Vice Mayor Duncanson, the Commission authorized a resolution of condemnation for two houses at 1127A Y, 13, Griffin Road, the owners are M. Fridovich-Martin Invesfrrient Co. of fort Lauderdale. 14 . City Panager reported on the excessive costs for construction of paddluball couris and recommended that this be deleted from our rocroation and physical fitness program and that other programs be devised. The Commission agreed with this suggestion. 1'�. The City At tornoy presented a resolution to authorize a certificate of indebtedness to secure the payment for a ten acre tract of land in the Southeast section of the City. Description on file with the City Attorney. The certificate is to be secured by a pledge of the llorida Power 8 Light francise monies sufficient to cover the yearly payments. 16. City Attorney presented on first reading an ordinance to regulate and proserve trees in the City of Dania. On a motion by Commissioner Jackson, seconded by Vice Mayor Duncanson, the Commission passed the ordinance on first reading. O I /. Thu Commission authorized the City Manager to have the house at 48 S.W. 4th Stroet demolished and removed and the cost to be assessed to the property. This was on a motion by Commissioner Jackson, seconded by Vice Mayor Duncanson. s18. City Attorney presented an ordinance to amend and clarify the phasing out- of non-conforming uses. The City Manager suggested that the time for phasing out of the non-conforming buildings be set at six months rather than a year. On a motion by Vice Mayor Duncanson, seconded by Commissioner Jackson, the Commission passed the ordinance on first reading with the suggested change. The vote was unanimous. Ifs. Second reading on the multiple and single family zoning was continued until the commercial zoning ordinances are set for public hearing. :O. Ordinance to annex the Ocean Waterways trailer park was tabled pending the aci ion of the State Legislation on annexation of the western areas. The first reading of ordinance concerning completion of remodeling of Old buildings or their demolition was continued until January 21st. 2.". The first reading of amendment to ordinance requiring 30% of registered voters to initiate a petition was tabled until the meeting of the 14th 'S on a motion by Vice Mayor Duncanson, seconded by Commissioner Jackson. 7 On a motion by Commissioner Adler, seconded by Commissioner Jackson, the Commission passed a resolution giving Fire Inspector Ed Moore the ; ,-.wer of arrest. The vote was unanimous. 24. A motion was made by Commissioner Jackson, seconded by Vice Mayor Duncanson to pass on Ist 8 2nd readings, the ordinance to amend Ord.397 (No Wake Ordinance.) . the vote was unanimous. ZS. A motion was made, sustained and carried to table the discussion on T-Y Park. i,. City Attorney Clarke Walden commented on a written letter of resignation he had submitied to the Mayor and Commissioners. He stated his resignation will be effective April I, 1974, and in the meantime he would riive assistance and advise on securing a replacement. He further sifted that he would give of his time to properly orient his replacement. ' lln stated that he would comment further on his reasons for. said resig- nation and his appreciation in serving the City at his last meeting before the effective date. The Comnissioners stated they would make their comments at that time also. City Commission Meeting -2- January 7, 1974 �f '7. Commissioner Jackson made .n 1ndepth statoment of his concern with the working and coverage of the Grand Jury report. Ile stafod he hopod 111" City Attorney would reconsider and not let criticism influence him. Commissioner Jackson went into detail on his repufation from his youth to now in the City of Dania and openly requested that his life be looked a-I because he had done nothing wranq, but work for the best for the City of Dania. Mayor Kay recited in detail his contact with the State Attorney's office and fhal ho volunteered to talk with them on matters that were being looked into in the City of Dania. He stated he had been ;incero and honest in all of his efforts and that he worked for the best interest of the City and would continue to live here and make this his home. Commissioner Adler went more into detail on the reasons why a person should serve his community and that he was shocked -to find that after eighteen years of public service that he had been a part of a criticism. He stated that he believed in the Grand Jury and that his only understanding of their part was that they were advised by an inexperienced, young attorney. Ife stafed he is a part of the City of Dania and will remain here .If his home. Vice Mayor Duncanson said that he didn't feel like a shiny knight, but felt in his heart that every man serving on fhe Commission was honest.
