MAY 7, 1973

4. A motion by Commissioner Kay, seconded by Commissioner Duncanson
to approve the minutes from the meeting of April 16th was passed.
5. A motion by Commissioner Kay, seconded by Commissioner Duncanson
to approve the bills as paid for the month of April was passed.
G. 8 :05 p. m. Final action by Commission to annex property referred to
as the Berry Tract was deferred until the next meeting.
7. 8 :10 p. m. Final action by Commission to annex property on Stirling
Road was deferred until the next meeting.
8. 8: 15 p. m. Bids for miscellaneous pipe; to extend a 12" water line
from Gulfstream Road east to the City limits and a 4" pipe to run
from the City limits east to the inland waterway was deferred until
the next meeting since no bids had been received.
9. 8: 20 p. m. The bids were opened for paving at Frost Park. On a
motion by Commissioner Jackson, seconded by Commissioner Kay the
bids were turned over to the City Manager for his tabulation and
recommendation. The motion passed.
1C. 8: 25 p. m. Continuation of public hearing on the application of
Gulf Oil Company for a variance permit from April 16th. The represent-
ative for Gulf Oil presented his petition for reopening the service
station as a non-conforming use. The City Attorney ruled that in his
legal opinion there had been no abandonment even though the station
had been closed since last October. The City Manager disagreed and
pointed out that the ordinance provides that when a service is not
rendered then the use is abandoned and that to abandon a use does
not require that the building or structure should be removed or
partially removed. A motion was made by Commissioner Jackson,
® seconded by Commissioner Kay to permit the reopening of the station
and instructed the City Attorney to rewrite the ordinance and
clarify what is meant by abandonment. The motion passed.
CITY MANAGER'S REPORT
® 1. Commission approved the City Manager's request for condemnation
and removal of the following five structures located at:
Parcel in W2 of NW, of 3-51-42 lying south of S.W. 4th Street
bounded on the south, east and west by Block 9 College Tract
2nd addition; 30 S.W. 4th Avenue; 29 S.W. Sth Avenue; 715
N.W. 1st Street and; 212 N. Federal, and gave to the City Manager
the discretion on removing people out of two structures within
axeasonable time.
Commissioner Adler made a motion to authorize the City Manager to
advertise for bids for 1400 ft. of 6" pipe to replace the deterio-
rated water line along 7th Street east from 3rd Avenue to Sth Avenue,
and also to authorize the City Attorney to draw a resolution for the
assessment of the cost to the adjacent property owners and set June 4th
for a hearing on objections to the assessments. Commissioner Hay
seconded, the motion passed.
3. The Commission authorized the Manager to notify our Legislative
Delegation that we oppose any expansion of multi-county planning
functions, except for water management and flood control.
4. On a motion by Commissioner Adler, seconded by Commissioner Kay
the City Manager was authorized to sell the benches from the
Commission Room as surplus to the needs .of the City.
5. On a motion by Commissioner Jackson, seconded by Commissioner Kay
the City Manager was authorized to sell our surplus police cars
when the new fleet is fully operational.
6. On a motion by Commissioner Kay, seconded by Commissioner Duncanson
the Manager was authorized by emergency to purchase an 85 hp motor
for our police boat in the amount of $1,270. 00, less possible trade-in
of old motor.
7. On a motion by Commissioner Kay, seconded by Commissioner Jackson
the Manager was authorized to advertise for bids to purchase a car
for Mr. Walker, Building Inspector and that the car be equipped for
supplemental use by the Police Department.
8. Commissioner Kay made a motion to authorize the Manager to advertise
for bids for a package treatment plant with a capacity of from one
million to 1. 2 million gallons , with the total estimated cost for
the plant, foundation, modifications to our system and necessary
equipment not to exceed $800,000.00. Commissioner Jackson seconded.
There were four ayes, Commissioner Duncanson voted no.
9. The City Manager brought to the attention of the Commission the
increase in the cost of living this budget year. The increase has
been approximately 4. 7%• Commissioner Jackson suggested that a
cost of living formula be set up in the next pay plan. The Commission
asked the Manager to bring back to them the cost for meeting this
year's increase for their information.
10. On a motion by Commissioner Duncanson, seconded by Commissioner Adler
a resolution was passed requesting the Florida Governor's Council
on Criminal Justice to assist the City of Dania in purchasing radio
equipment by making a grant to the City.
11. A motion was made, sustained and passed to authorize the City Manager
to bill the Dania Nursing Home for costs the City has in servicing
this facility.
12. Commissioner Duncanson was appointed as voting representative to
the Broward County League of Cities.
13. The Commission passed on all three readings an ordinance requiring
the underground wiring in new subdivisions of electrical and commun-
ications lines ; and providing that all ordinances or parts of ordin-
ances in conflict herewith be repealed to the extent of such conflict;
14. Commissioner Adler made a motion, seconded by John Kay to pass on all
three readings the ordinance for a non-exclusive franchise for the
Florida Gold Coast Cable TV. The motion passed.
1S. The City Attorney reported to the Commission on the progress in settling
the condemnation cost of Right-of-Way for A-1-A at the corner of Federal
® Highway and A-1-A. This has been a long and tedious negotiation.
The City Attorney and the City Manager have coordinated their efforts

�? and various meetings have been held in an attempt to arrive at an
} equitable settlement for the City. He pointed out that he should
be able to settle the land costs with the Oil Company for less than
$16,000. 00 and then for the appraisers and the attorneys for the
Oil Company, the cost should be less than $5,000.00. The Commission
congratulated the City Attorney and Manager for the good job and
authorized them to bring the negotiations to a close as soon as
possible.
