The City Attorney, Clarke A. Walden, conducted the meeting in order
to rule on any legal questions, at the request of Mayor William Jackson.
Mr. Walden explained that the Charter provides for the removal of
Department Heads,(Section one of Article Ten) that the Department Heads
serve at the pleasure of the city, and may be removed at any time, even
after serving six months. If removed after six months, the officer may
request a public hearing, in which the City Commission is not required
to present any evidence.
Mr. Baxter did serve as Chief of Police for more than six months,
and within five days did request a hearing, but then requested that it
be postponed. Mr. Baxter requested this hearing tonight. Mr. Reasbeck
stated that Mr. Baxter had a presentation he would like to make.
Mr. Edward Baxter read a prepared statement of his position to the
Commission, as it related to his removal as Chief of Police.
Mr. Reasbeck then wished to present two motions to the Commission,
to the effect that the dismissal of Edward Baxter was illegal and that
he should be reinstated.
Mr. Walden stated that any alleged fiiolation of the Sunshine Law
was immaterial, and that the action of the Commission •in dismissing
Edward Baxter was proper.
After listening to Mr. Reasbeck and Mr. Baxter, No action was taken
® by the Commission, and the Resolution of Dismissal of June Third, the
Dismissal of Edward Baxter as Chief of Police of the City of Dania,will
stand as final.
