-- 4. Commissioner Salvino made a motion to accept the minutes of the
meetings of June 30th and July 6th. Commissioner Waiters seconded.

5. Department of Transportation. A representative of the Fort Lauderdale
Office presented to the Commission the general outline of the federal
r� program for assistance to the State and local governments, in highway
and street construction. The Commission approved this concept and
principle, yet at the same time does not endorse the pairing of Dixie
Highway and 21st Avenue of Hollywood, insofar as dumping the tremendous
• load of north bound traffic into S. W. 4th Avenue of the City of Dania.
Commissioner Kelly made a motion to draw a resolution confirming this
Position. Commissioner Waiters seconded. There were four ayes.
6. Commissioner Salvino made a motion to approve the bills for the
month of June, 1971. Commissioner Waiters seconded. There were four ayes.
7. Commissioner Waiters made a motion to pass on second reading the
ordinance to rezone to R-1 parcels of land west of Phippen Road and
between S. W. 3rd Street and Stirling Road. Commissioner Salvino
seconded. There were four ayes.
® Commissioner Salvino made a motion to pass on second reading an
ordinance to rezone from R-2 to R-3 Herald Enterprise Property, with
the owner, Mr. Goodman signing an agreement drawn up by Mr. Walden,
to the effect that the owner and any subsequent owners for a period
of thirty years would limit themselves to constructing only one
building on the property to contain only four independent living units
® with a height limitation of one story. Commissioner Kelly seconded.
There were four ayes.
9. Continuation of public hearing continued from June 21st meeting.
Commissioner Kay made a motion to table the application to rezone

of the east line of the aforesaid Tract 1 to Taylor Road, and accept
the Zoning Board's recommendation for the whole tract of land and
set up a public hearing for 8-16-71, at 8:15 P. M. Commissioner Salvino
seconded. There were five ayes.
;0 10. Howard E. Burgess. Public Hearing. 8:15 P. M. Commissioner Kay
made a motion to grant the petition for a variance permit to allow the
sale of beer and wine in a new restaurant at the S. E. corner of
Federal Highway and Second Street. Commissioner Salvino seconded.
There were four ayes, the Mayor voting No, "based on no hardship."
11. James & Frances B. Zampaglione. Public Hearing. 8:30 P. M. Commissioner
Kelly made a motion to deny the two petitions for variance per ss
41 N. E. 3rd Street to, at
1) use a building originally designed as a
duplex for a three family apartment and 2) equip with a kitchen and use
as an apartment an area in the building of less than 400 square feet.
Commissioner Kay seconded. There were five ayes.

12. M. L. Smith. Public Hearing. B:45 P. M. The City Attorney
recormnended that this petition to rezone from B-2 and M-1-A to B-3
zoning classification be tabled until the August 16th meeting.
f Commissioner Kelly made a motion to accept the City Attorney s
recommendation. Commissioner Kay seconded. There were five ayes.

S 13. Reading of the Planning and Zoning Board's minutes of the July 13th
meeting.
Item #2 - Vera L. & E. L. Hill. Commissioner Kelly made a motion to
' accept the recommendation of the Planning and Zoning Board to approve
the tree variance permits, 1) to construct a second single family
c house on a lot in R-2 zoning on which lot there is already one single
family house, 2) to construct this second house with a square footage
of about 503 square feet instead of the 800 square feet for a single
family house in R-2 zoning and, 3) to construct this second house with
#, a rear yard of 10 feet instead of the 15 feet required in R-2 zoning.
Commissioner Kay seconded. There were three ayes, Commissioner Kay
and Mayor Jackson voting no.
Item #4 - Mrs. Katherine Larkin. Commissioner Kelly made a motion
to accept the recommendation of the Planning and Zoning Board to grant
the variance permit to convert Mrs. Larkin's single family house in
R-2 zoning into a duplex with one side having a living area of less
than the 500 square feet required in R-2 zoning. Commissioner Waiters
seconded. There were three ayes, Commissioner Kay and Mayor Jackson
voting No.
Item #5 - Fridovich-Martin. Commissioner Kelly made a motion to table
the petition for the acceptance of a plat for a new subdivision in the
M-1 zoned area just south of Griffin Road between the Steinfeldt-
Thompson Cannery and the west City limits, until the Commission
receives the proper information from the County Zoning Board regarding
the width of Griffin Road. Commissioner Kay seconded. There were
five ayes.
Item #6 - Marrone. Commissioner Kay made a motion to pass on first
reading the ordinance approving the plat plan of a new subdivision
located east of N. E. 5th Court, west of the Royal Palm Marina, north
of N. E. 3rd Street and south of the Dania Cut-Off Canal, with a
stipulation that a perpetuity clause will be put into it to protect
the owners of Lots 5, 6 and a portion of 4. Commissioner Salvino
seconded. There were five ayes.
14. Commissioner Salvino made a motion to pass on first reading the
application of a 2-APS, beer and wine license for Arael Medina at
F' Alex's Fruit Store. Commissioner Kelly seconded. There were five ayes.
15. Commissioner Salvino made a motion to pass on first reading the transfer
§. of a 2-COP license, beer and wine, from Ellen Leszczynski to TJA Corp.
Commissioner Kay seconded. There were five ayes.
c 16. Commissioner Kelly made a motion to approve on first reading the
application for a 4-COP license for Grace Wielandt at the old Tammy's
Restaurant, 1105 S. Federal Highway. Commissioner Kay seconded. There
F were five ayes.
17. Anton Project. Commissioner Kelly made a motion to adopt a resolution
to approve the site plan. Commissioner Waiters seconded. There were
`k five ayes. The City Manager set up a meeting with Mr. Anton, John
Farina, the City Engineer and himself to set up the assessment basis
and come back to the next meeting with everything finalized.
ctt is. A Finance Committee meeting was set for Thursday, July 22nd at 5:00 P. M.
g to discuss the budget.
19. The City Manager reported that there have been instances in the
past few weeks when our policemen and firemen have been called out
into the unincorporated areas of the County, the police going along
as protection, because during these instances our men and equipment
have been rocked. He expressed concern as to whether our men are
covered by our municipal insurance. Commissioner Kay made a motion

'rn ® to accept the City Manager's recommendation and direct him and the Fire Chief to negotiate with the proper officials of the County to
solve the problem of the insurance and the deputizatbn of our
policemen.
20. Commissioner Kelly made a motion to pay $137. 50 to Broome and Farina
® for their research and testimony for the Sullivan case. Commissioner
Salvino seconded. There were five ayes.
ra 21. Commissioner Kay made a motion to pay $400.00 to Broome S Farina
for the survey of Wayside Park. Commissioner Salvino seconded.
There were five ayes.
22. Audience. Mr. Jimmy Peterman of 608 West Beach Blvd. brought up
the newspaper articles concerning damages at Westside Park.
Commissioner Kelly made a motion to turn the matter over to the City
Manager and recommended a meeting between Mr. Peterman's group and
