mum CITY COIVISSInN MEETING OF OCTOBER 20, 1969 HELD IN THE DANIA, CITY CO"NISSION ROOM, CITY OF DANIA., FLORIDA. ROLL CALL Present Mayor-Commissioner Robert E. Houston Commissioners William J. Jackson Robert Kelly Boisy Waiters City Attorney Clarke Walden City Manager Stephen A. Derry Building Inspector Hubert Walkem City Clerk E. R. Clay Absent: Commissioner Joseph Thornton Police Chief Phil Thompson Excused on City Busineaa, ® 1. Minutes of September 15th, October 7th and October 9tb. Commissioner Kellyt then stated that he had not had time to road the minutes and asked that they be tabled to the next meeting. This was agreed apon by the Commission. 2. Bills paid for the month of September. 0 Commissionert•raiters made a motion they be approved, this was seconded by Commissioner Kelly. Roll Call was; then taken and the vote was four to zero. 31. Bills to be ptid' in the month of October. Commissioner Kelly made a motion that the bills be paid, this was seconded .p by Commissioner Jackson. Roll Call was then taken and the vote was four to zero. 4. Approvement of the Sewer Agreement between Elmer Christian and the City of Dania. A motion was made by Commissioner Kelly and seconded by Commissioner 4Taiters that the Agreement be accepted. Roll Call was then taken and the :® vote was Four to zero. 5. Second Reading on a 2 COP License. Penn Dutch Restaurant i A motion was made by Commissioner Kelly and seconded by Commissioner Waiters- it be approved. Roll Call was then taken and the vote was four to zero. 6. Second reading of a transfer from Minno Estate to Albert J. La Bonte & Frank G. McGonigle. This application was not approved by the Police Chief so no action was taken. 7. Letter from Alsac St Jude for a door to d)or campagain on Saturday November dth • 1969. A motion was made by Commissioner Waiters it be approved, this was. seconded by Commissioner Jackson. A11 in favor signify in the usual manner. them were four ayes. B. Tax Agreement from tiYlliam Markham Tax Assessorer. A motion was made by Commissioner Kelly to approve the City signing the agreement, this was seconded by Commissioner Jackson. All in favor signify in the usual manner. The Vote was four ayes. 9. Petition from citizens to have street lights installed in the alley between S. E. 2nd Avenue and S. E. 3rd Avemue and S. E. lath Street. On this item it was agreed by the Commissioners that this item be turned over to the Utility Committee. 1.0. Reading of Planning & Zoning Board Minutes. October 20, 1969 (1) n (2) The City Attorney stated the first item to be acted on was Item li 2 of the Planning & Toning Meeting. Application of Robert & Virginia Marston for a variance on the rear setback that would allow the construction of a Swimming Pool on the property at 325 N. S. 3rd Avenue, the Planning & 7oning Board asked for a Public Hearing at 7:45 P. M. on November 11, 1969 The City Attorney then read Item # 3, this was the application of ® Anthony DIAmbrosin for a variance to permit the construction of a Florida Room to within 5' of the property line, address 113 S. 1st Terrace, Dania. The recommendation of the Toning Board was to have a Public Hearing at 8:96 °. M. on November 11, 1969, A motion was then made by Commissioner Jackson to approve the two Public Hearings, this was seconded by Commissioner Kelly. All in favor signify in the usual manner. There were four ayes. A Item number 6 was a request for the Royal.Palm Colony to set up a Trailer to dispense Orange Juice, and information concerning their properties and to give out maps of Dania and to direct people to various attractions in Dania. This Trailer would be on a lot at Eller Drive & North Federal Hwy. It was stated that the Planning & Zoning Board had denied the request. There was then a long discussion between the people from the Royal Palm Colony and the Commiss loners. Ater the discussion it was decided that if Royal Palm Colony wished they could file for a Public Hearing before the Planning & Toning Board, and if they did apply the Public Hearing would be held at 8:15 P. M. on November 11, 1969. Commissioner Kelly then made a motion that if they came in and filed in a few days they would be granted a Public Hearing at 8:15 P. M. on November 11, 1969, this was seconded by Commissioner Jackson. All in favor signify in the usual manner. There were four ayes. Item # 4 was a Public Hearing on Rufus J. Hyde his request was a zoning change from B-1 to C-2. This to permit the property to be used as a restaurant and if granted would allow the sale of beer and wine for consumption on the premises. ® The Planning and Zoning Board then denied the variance, but on another motion the zoning change be granted. There was then discussion on whether Mr Hyde wanted a Public Hearing or not. It was then decided that there would have to be separate Hearings one on the Toning and one on the Variance. Commissioner Kelly then made a motion to grant the Public Hearings, this was seconded by Commissioner waiters. All in favor signify in the usual manner. There were four Ayes. Item N 5 was a Public Hearing Lar Construction Cc request a variance which if granted would permit the construction of a Duplex, the property being at 203 S. S. 3rd Street. The Planning & Toning Board denied the request. The City Attorney then ruled that it was proper to give Lar Construction their money back on the Building Permit as they could not build there, and also it was asked to check if the ',star Meter had been installed. Commissioner Kelly then made a motion to return the money for the Building Permit, this was seconded by Commissioner I'aiters. All in favor signify in the usual manner. There were four eyes. 11. The City Attorney then read a letter from the Dania Police Reserves regarding ® the gift of a 1961 Valiant fully equipped and in good condition which they .could turn over the title to the City, if the City agreed to pay the Insurance License and Gas. This car was to be used as a back up unit. There was then a long discussion regarding the use of the car and finally the item was tabled till the next meeting Friday October 24, 1969 at 8:si P. M. 12. The City Attorney then presented a Resolution on condeming shacks on the west r� Side, he state Walker bad given him a list of four some time ago and then just lately he had given him eight more so there was a total of twelve. The City Attorney then stated he thought a resolution should be adopted to cover all twelve of the shacks. He said that way one number could be assigned to the L'.tn. The City Attorney then read parts of the resolution and cited Items 16.7 + and 16.8. He then stated the City Manager be authorized to send the property owners a notice and give then l8days to do something or the City would proceed and put a lien on the property. The Mayor then asked if the 4 acre and the 5 acre parcels were included in this resolution and he was told no. The City Manager then said he had sent the property owners a certified letter, and they had both responded. He said John Sessa was supposed to do it but he could not seem to get ahold of him. The City Manager said he had another gentlemen who would do it if Sessa could not. There was then a long discussion regarding Sessa on this previous work done and the Fire Chief said Sessa had completed his part of the work. Then was then a motion made by Commissioner Kelly tp pass the resolution, this was seconded by Commissioner '-'niters. Roll Call was then taRen and the vote was four to zero. October 24. 1969 (2) iy: d The City Attorney then stated that the City of Dania was going to have to put out a large sum of money to handle this and wondered if they had funds to provide for it, the Mayor then stated it would have to come out of the fund know as Contingencies. e 13. The City Attorney then referred back to Item # 10 which was in regards to the P.ernadine Morris request for rezoning. This was third reading. The property is Lot 5, Block 13. Town of Dania. After a lenghty discussion Commissioner a, Kelly made a motion it be denied, this was seconded by Commissioner Jackson. ?hc Roll Call was four to zero. rr1. lb. There was then a letter read regarding Poppy Day in the City of Dania. After W discussion Commissioner Jackson made a motion it be allowed, this was seconded 5,. by Commissioner Kelly. All those in favor signify in the usual manner, the vote was four to zero. 15. Questions from the Audience. Alomzo Nalliams then got up and gave a long talk on the water problem down on Phippen Road[ After discussion it was turned over to the City Manager to handle. After a long discussion it was decided to let it up to the City Manager if he could not get it done for $360 then go ahead with the price of x: $hOD. It was also discussed that it may be necessary to have more than Lap one dry well on Phippen goad. This was also left up to the City M$r. 6,. The City Attorney then stated the City Manager could spend up to $1000 but if it went over this figure the City would have to put out for bias . 16. A Mr, Hopstetter of the Hotel Ann then got up and was complaining N about Garbage Pick Up and Trash behind Jordan Furniture that was ;. blowing out onto Federal Highway. There was a long discussion between the Commissloners , Mr Hopstetter and the City Manager. The City ` Manager then stated he would check it out the following morning. nY. 17. A gentleman in the audience then got up regarding the street lights In the Alley of Sessa Estates between S. E, 2nd Avenue and S. E. 3rd Ave and S. E. 4th Street, The Mayor then stated this item had come up earlier and had been turned over to the Utility Committee. There was then a long discussion between the Commissioners and this party and the City Manager. The gentleman was told that the Utility Committee and the City Manager would check on it and report back by the next Gcmmission meeting. There was then a long discussion between Commissioner helly and the City Manager regarding the paying by the property owners for three years . The City Manager is to check with Mr Turpin of the f Florida Power & Light Co, F 18. There was then discussion and it was decided to have a Special Meeting on Friday October 24th at 8:00 P. M. 19. Mr Emil Nothelfer then got up and complained about the dirty beach, he said. it was so bad you could not put down a blanket or a beach chair. Fie said it was so bad that lately he and his wife had been going to other beaches , The City Manager then stated he was working with the City of Hollywood to try to get help in cleaning the beach, as they ? own to the South and to the North of our beach. The Mayor then said the beach was so bad that he thought our men should be taken down there tomorrow and clean the beach. The Mayor then brought up about mowing the crass in the Cemetery he said he had brought this item up two or three tJmes , The Mayor said we were really falling down on work on the outsIde , 20, The City Manager then asked tha City Attorney to read a letter received from an Attorney who represented the Cities Insurance Co. He wanted to commend the help he had received from the City, from Commissioner - Walters and the Police Force but especially Sgt Connors . He said Sgt Connors had spent numereous hours digging up witnesses and helping th,� Attorney to no end. The case was finally won by the City. L7 , The City Manager then asked if the City was to pay all the expense of the fence at the pier, the Mayor answered he thought so. The City M-,nader said he had four proposals and the price range was really 1lfferent , He said the lowest was $630 and the highest was 12710.68. He stated the price he had from Tropical of $800 was over the telephone. Thez • was then a long discussion of the type of wire , how it should be be ho:)ked to the concrete poles that are there and in the end the representative from Tropical Fence Co was told to be at the next meetinu with a price for a fence as the Commissioners wanted it. October 20, 1969 (3) ( 4) 22 . The City Manager then said he had one more item and that he had passed it out to the Ccmmissioners. It was a letter from Broome & Farina Regarding Trail' s End Trailer Park Senitary Sewer Connection. The Mayor said he thought they were going to put in a Disposal Plant ® out there and he wondered what happened to that deal. There was then a lenghty discussion regarding our Sewer Plant Capacity and that they were told at the time the extension to the Trailer Park was approved that perhaps the City could not handle their sewerage problem. Commissioner Kelly then made a motion to table the item and asked that the City Manager come up with a recommendation , this was seconded by Commissioner Waiters. All in favor signify in the usual manner. There were four ayes. 23. The Mayor then brought up the subject of a catch basin down on 4th Street, He said this catch basin takes care of the water on Federal Hi6hway , He said the only way this could be corrected was to continue the Storm Sewer that was on S. E. 2nd Avenue down to S. E. 6th St ^.nl hook in the catch basins off the other streets. Commissioner Kelly then brought up the drainage problem on N. E. 3rd Strait riett behind the Cozy Cove Marina. There was a long discussion on this Item , the Mayor thought the line was plugged as they never had any trouble before. The City Engineer to be advised to bring drawings to the next meeting both on S. E. 2nd Avenue and on N. E. 3rd Street. 24. The Mayor then brought up that the Auditor's had suggested that the City read the meters every two months rather than every thirty days. The City Clerk was instructed. to bring recommendations to the next mee t,Srg, '® 211. The Mayor then asked about the Paving of the Beach Parking Lot, the City Manager stated he was supposed to get a report from the City Engineers today but that he did not receive it. He then said the report was the final specs. He was asked to have the City Engineer have the final specs for the next meeting. 26. The Mayor then asked about the specifications for the Police Cars, Scooter, Tractor and Pick up Truck. The City Manager said they were In the mill. The Mayor asked that they be at the meeting on Friday night and the City Manager said he did not know if he w.inld have them ready. 27. The Mayor then brought up the three parking meters at the beach and he stated they were not up as yet. He said these meters were in very good spots at the beach for revenue. The Mayor and the City Manager then got into a heated discussion which I will not type unless requested. 0 2E. It was then discussed about the flower pots around the City , the Beautification Committee was willing to buy more flower but wondered If the City would see that they were watered. Commissioner Kelly stated that earlier they had discussed the important things that should be done in the City and he did not think this was one of the important things.
