M . , July 1, 1968. The invocation was given and the pledge of allegiance to the flag was recited. Mayor-Commissioner Kelly asked the Clerk to call the roll and the following Commissioners and city officials were present: Mayor-Commissioner - Robert Kelly Commissioners - Robert E. Commissioner Marant moved that the Minutes of June 12, 1968, be approved as read. Commissioner Waiters seconded the motion. The Commissioners voted as follows: Houston - Yes 6Y Marant - Yes Thornton - Yes Waiters - Yes Kelly - Yes Motion passed. :p Bible Revival Meetings - Occupational License City Attorney Walden submitted or approval the application for an occupational license to be issued to J. 0. Monk, Jr. , clergyman, South Atlantic Corporation, to operate tent bible revival meetings and the erection of a tent for said purpose at the north side of S. W. 2nd Street at Phippen Road, Dania, July 2nd to August 31,1968, from 7:15 P. M. to i 10:00 P. M. , Sunday through Friday, tabled from the meeting of June 24, 1968. Mrs. Lucille West, 621 N.W. 3rd Terrace, Dania, appeared before the Commission and spoke on behalf of the colored community in that they wanted these revival meetings . Chief of Police Parton said he had con- ducted a survey in the immediate area and that the Mrs. Carpenter and Wilkins, who lived in that area, were against the revival meetings being ® held. After discussion, Commissioner Waiters made a motion to approve the application of J . 0. Monk, Jr., for a tent bible revival meeting(s) as stipulated in his application, and that a $50.00 clean-up bond be posted, refundable when evidence of clean-up was accomplished after August 31, 1968; the Fire Marshal be satisfied that the tent is fireproofed; proper sanitary facilities provided; all curfew and noise ordinances be observed and to cooperate with the Dania Police Department and Florida Highway Patrol in proper traffic control. Commissioner Marant seconded the motion. Eh,ctions - Voting Machines b Attorney Walden submitted for discussion Commission authorization city Itto rent voting machines for the General Election in Dania in November, 1968. ?? The City Manager advised the Commission that the Acting City Clerk had been z' informed by the Broward County Voting Machine Custodian, Mr. Bradford, that x inasmuch as the county, state, and national ballot would be on the County machines , it was questionable whether the City of Dania ballot could also be put on these machines; that it was quite probable that the City of Dania 1968. would have to use paper ballots for the General Election in November,or renting s' He further said there would be a question of either purchasing voting machines for the City of Dania . The Acting City Clerk advised she was unable to locate in West Palm Bcaach a company which rented or sold voting machines, as it was now a defunct company,. and that to her knowledge, or to the knowledge of Mr. Brad- ford, there were no voting machines available for rental or purchase at this time. Commissioner Houston moved to have this matter tabled for another week and see what would develop. Commissioner Marant seconded the motion. Bills Approved - City Engineer City Manager Goldberg submitted for approval City Engineering bills from Broome & Farina in the following amounts: $3,660.10; $162.50; $142.50; ,y and $107 . 50. He said these were the bills that were presented at the June 10, 1968 Commission meeting, and that, in addition to those bills, there was a new bill of $172.50. Commissioner Houston stated he thought those rc bills were to have been turned over to the Finance Committee. Mayor Kelly said there had not been a Finance Committee meeting since June loth. Com- s, missioner Thornton, Chairman of the Finance Committee, said he had called a meeting at one time and the Commission had discussed everything but that which the meeting been called for in this connection. He said he would call a meeting for the next evening, July 2, 1968, Finance Committee only, 6; at 8:00 P . M. , in City Hall. Mayor Kelly said these bills were then to be turned over to the Finance Committee for a recommendation July 2, 1968. City Manager Goldberg said he believed the bills had already been approved subject to the Finance Committee's review. The City Manager said the action was taken on the former bills mentioned, but requested action be taken on the $172. 50 dated June 28, 1968, from Broome & Farina, and that he would bring this bill to the July 2nd meeting for the Finance Committee's approval. Certificate of Competency - Master Plumber ommissioner ai ers reques a act ion be taken on behalf of Mr. Ed Cornelius to have issued him a City of Dania Certificate of Competency as a Master Plumber, which matter had been previously discussed at City Com- mission meetings, and that the Commission decide this matter one way or another. After much discussion between members of the City Commission and `r Mr. Cornelius, it was agreed that Mr. Cornelius would take a City of Dania Master Plumber' s examination under the supervision of Mr. Hubert Walker, " Building Inspector and two members of the Dania Plumbing Board, as well as a qualified outsider, perhaps from Hollywood or Hallandale. It was d, tcrmined that the next master plumber'sexamination would be held July 18, 29661 at 7: 30 P. M. Dania City Hall. Mr. Cornelius said he would try to take the examination at that time, but that he might be out of town due to a new job that was in the offing. Mr. Walker now said he had been at all examining board exam:i_nations , but one . Commissioner Houston said it was not necessary that Mr. Walker be present. However, Mayor Kelly noted that Mr, Walker, `> Building Inspector, was normally present at any examination at City Hall. Mayor Kelly asked if a better place to conduct examinations would not be in the Conference Room. Mr. Walker said there were different examina- tions given at one time and that by the candidates being placed in an office by himself he could better do his examination by not being disturbed rs by anyone . Garbage Ordinance City AttoFney Walden submitted for Second Reading the Garbage Ordinance passed on First Reading June 17, 1968. * City Manager Goldberg 'F reported, after Mr. Walden read the Ordinance, that he and the City Attor- ney had discussed the possible additional cost which might be imposed upon the city, if the Ordinance were to be adopted as is. He said that any additional load from what the city is presently collecting would, of necessity, mean an additional cost to the city and that would have to be spread over the bulk of the taxpayers now. He said, in reviewing this I (and that there also seemed to be an agreement), that a possibly simplified version of the Ordinance would be to the effect that: every home and every I" place which had an occupationallicense may be entitled to a total of six • (6) cans per week free pick-up by the city; further, that should the city want to go into picking up anything above that, or in addition to that, a .. provision could be made, either now, or at a later date, to issue an annual V sticker that could be put on each additional can beyond the six-can limit ® per week, which would be three (3) can twice a week. He said this would eliminate the inequities existing now as some people are receiving more service and some people are receiving less service. Commissioner Waiters said he thought there should be less cans for the residential than for the commercial. City Attorney Walden said, with ®► regard to single family homes, he could not recall where there had ever been a problem in this connection. He said, if the Commission went along with the City Manager's basic recommendation, he would say that the city would provide reasonable garbage pick-up for every residential home; that he did not think there was any need to spell it out as to the number of cans. A After considerable more discussion, Commissioner Houston said the matter of the Garbage Ordinance should wait until after the budget had been determined and the city sees where it stands financially. City Attorney Walden said he could draft an Ordinance as to what the Super- visor of Public Works and City Manager would recommend; circulate it for consideration at the next to the following meeting. He said he could O also meet with any of the Commissioners and draft another Ordinance up in connection with their thoughts so that everybody could see what they were talking about so there would be a clear understanding of what every- body' s thought were and that these drafted Ordinances could be ready by August 1st to be presented at the August 5th, 1968 meeting. Commissioner Houston moved that the Garbage Ordinance for Second Reading and/or Second and Third Reading be tabled until August 5, 1968. Commissioner Thornton seconded the motion. City Manager Goldberg questioned if the Bellows' rental property was to have city garbage pick-up, or not, Commissioner Houston said there was plenty of time to pick up any garbage in the City of Dania right now and why worry about a few cans of garbage now. With regard to the New England Raw Bar, Commissioner Houston said the city had all reasons in the world to turn them down, and not to discuss this now, as the New England Raw Bar has a complete load everyday to carry out of there. Commissioner Houston said for the city to do as they were doing right now - and there would be no worry. After the City Attorney read the Ordinance, Commissioner y,lw Houston moved that the Stop and Frisk Ordinance be passed on Second, Third and Final Reading . Commissioner Thornton seconded the motion. The Com- missioners voted as follows: Houston Yes Marant Yes Thornton Yes Waiters Yes Kelly Yes Motion passed. �F Appreciation-Broward County Board of Public Instruction City Attorney Walden submitted or tiling a letter from Myron Ashmore, Superintendent of Broward County Schools, City Manager Goldberg read the letter from the Board of Public Instruction expressing appreciation to the City of Dania for its assistance and cooperation given to the schools during r the 1967-68 school year in the area of accident and fire prevention, espec- ially through law enforcement and fire department personnel under the direc- tion and supervision of the City Commission, City Manager, Police Chief Parton and Fire Chief Lassiter. Recreation - Swimming Pool Mrs . Bec y Ik— S . E. Park Street, Dania, appeared before the Commission and was recognized by the Mayor. She stated the mothers in Dania had been interested in acquiring a swimming pool and, among themselves, 7` had decided the best solution was to have a swimming pool at Frost Park as a city pool. She said she and the other mothers would like to know the Commission' s feelings, if they should raise about $10,000.00, and the city to match that figure and try and pay the pool off together. She said the mothers were willing to support this and to work for it because they felt sure there were businesses in Dania that would be willing to support the program and who would be willing to patronize the pool. She said they realized the city was very busy and there were many things to worry about, but, she said, there was no business any bigger or more important than the youth in the city. She further said, that if all the energy and money that had been wasted on the recall petition, which was a stupid waste of time, had been put toward the swimming pool, how much closer they and the city would be toward doing something good for the City of Dania instead of some- thing destructive toward two people. Commissioner Marant said he had been in touch with a gentleman in an administrative capacity at the School Board, and said they talked and dis- cussed there might be an occasion sometime in the near future to again talk about them giving up some land at Olsen Junior High School for a pool. Mrs . Hill said that would be beating a dead horse. Commissioner Marant said they had planned to talk to the School Board and Broward County Board of County Commissioners in this connection, but that the Dania City Com- missioners had not yet had time to talk among themselves. Commissioner Marant said he had some reservations about it and that more thought and planning should go into the project; that there should be a recreation committee meeting to discuss this in order to come up with a proposal. Mrs . Hill said not to leave them out; that they wanted to work. Commissioner Marant said he would contact Mrs . Hill for a conference Tuesday, July 9, 1968 in the Conference Room at 2:00 P.M. in City Hall. Mrs . Hill said they intended to look at some of the different pools to see what was wanted and what they thought they could afford. She said they were thinking in terms of, perhaps, $50,000.00, or more. Commissioner Waiters suggested getting plans from the School Board and turn the matter over to the 'i Recreation and Finances Committees. Commissioner Houston said they would have to find out what size pool they were talking about and they would have to get prices ; that it would have to be a pool that everyone could fi enjoy. s City Manager's Report - Sewer System 'rty Manager Go dberg saidt e Sewer Superintendent, Mr. William Carney, suggested that the original Ordinance, which provided for the !, connections up to the sewer system allowed licensed plumbers to make such connections and also allowed home owners to make such connections on the basis that some of the home owners may be hard-pressed to hire a licensed man and that his feeling, after discussing the matter with the Building Inspector, was the city had been fortunate, so far, not to have had much of a problem, although there had been some problems in that area. But, he said, since most of the connections now have been made, that he was requesting the Ordinance be amended to take out the home owner so that all new connections would be made by a licensed plumber. Commissioner Houston said he was very firmly against this; that most of the connections had been made in the city and any new construction was taken care of by the plumber, but that there were still some connections to be made yet, and could see no reason why the home owner could not do it. He said, that perhaps Mr. Carney or Mr. Walker might have to make two inspections instead of one, but that was no hardship on them and there was no reason why these home owners who have not put in a connection yet because of a financial condition could not go ahead and put in their line. Com- missioner Waiters concurred with Commissioner Houston. Mayor Kelly said he had seen a box of boulders Mr. Carney had pulled out of the sewer plant, and that Mr. Carney felt that much of this has come from open end; from people who have put in their sewer system and left the ends open. He said the city had a sewer system and the law required that everybody hook up nd he saw no reason why, if the person had a hardship, that he should/�Oote into City Hall and be on record he has a hardship, and then the city would know where these areas were. He then said he would like to know if the city had a list of those persons who were illegal as to the fact they were not hooked up to the sewer system. Upon being questioned by the Mayor, City Manager Goldberg said he believed Mr. Carney had informed him there were not more than twenty-five persons who had not hooked up. Commissioner Houston said he did not think people could hook up themselves who had new construction. Mayor Kelly said, to resolve all doubt, the city should have only plumbers hook up from now on. Mr.P.obert Grammer came before the Commission and was recognized by the Mayor. He said there was nothing to stop the home owner from putting in his own plunbing, electric, et cetera. Commissioner Houston said all the home `1 owner had to do was abide by the code and pass the inspection. Commissioner Waiters said he believed the Ordinance should stay the way it is right now. Building Inspector Walker pointed out that the city has a 2� to 3 million dollar sewer system; that things have worked out so far, but it sas Mr. Carney's feeling the city should stop gambling on this system, and that only qualified persons be permitted to attach the lines to the (- it sewer system. He said he also shared Mr. Carney's feelings in this ;ratter. Commissioner Thornton asked, if when the connection is hooked up by an individual home owner, did Mr. Walker inspect the line and !'t . Robertson quite often and with regard to the $6,000.00 plus sewer assessment, Mr. Robertson had assured the City Attorney he would get the check. Mr. Robertson asked, he said, if the assessment would be against the amusement park or the 30-acre apartment site. City Attorney Walden said these properties were under two different corporations, both of which Mr. Robertson controlled, and he did not know to which corporation to charge the sewer assessment. Commissioner Houston said Mr. Robertson agreed to pay $6,000.00 sewer assessment against the sewer line he put in that runs down to the amusement park, and that this had nothing to do with the other land he owns at all. Mayor Kelly said the way this was arrived at was that the Engineers took one side of the whole plat. City Attorney's Report - Pirates' World - Noise Nuisance rty Attorney a den said r. Robertson h had brou hE up the matter of the misunderstandings he had had over the amusement park with the city concerning the noise and other nuisances . Mr. Walden said he had suggested, that if Mr. Robertson wished to speak with anyone, he start off with a meeting of the Police and Fire Committee when the Chief of Police might be present. Mr. Walden said, that if Mr. Robertson were invited to a meeting, he would come and attend it. Commissioner Houston said he thought the meeting should be called very soon because now the people were there every night and the noise was unbearable between 9:00 P . M. and 10:00 P.M. . Mayor Kelly said a meeting had been called for Wednesday, July 3, 1968, at 2:00 P.M. , and that he differed with Commis- sioner Houston with regard to the unbearable noise; that he had investigated this at 11:00 P.M. the previous Friday, and the noise was not too loud, but that he thought they had cooperated in trying to hold the noise down. Occupational License Fees �rity t�torney�a Wald said with respect to trying to recover some part of the license fees from the Tic Tac The and Show Club he had finally received a letter from the State Beverage Department stating, that the Beverage Department, under its law, turns over all of the license fee revenues immediately upon receipt into the General Fund of the State, and, therefore, the City of Dania cannot recover its share. rater and Sewers Mayor Kelly said he would like the City Sewer Superintendent to pre- pare a list of the people who have not hooked up to the sewers and who are riot finished hooking up and who have not yet had a final inspection. He requested the property description be included in the list and the list submitted to the City Commission as soon as possible. TRAFFIC LIGHTS commissioner Marant said that at 13th Street, South, near Volpe's F.-staurant, a traffic light was not working and asked the Chief of Police if he was aware of this. Police Chief Parton said he was and that a crew was working on the traffic light to put it back up; that the police were trying to find out who knocked the traffic light down. /�/� -6- MINUTES OF COMMISSION MEETING DANIA FLORIDA HELD J , Street Signs Commissioner Marant said with regard to Mr. Williams on S. W. 2nd Avenue and S.W . 13th Street, there was a stop sign that had been removed. It was determined this was a 4-way stop. Chief of Police Parton said that the first driver who came to a 4-way stop had the right-of-way, and the other driver(s) must wait their turn. City Manager Goldberg said the right-of-way is generally given to the street that does not have the stop sign, but if all the streets have a stop sign, then you do not know who has the right-of-way until one gets there. Commissioner Houston said a 4-way stop sign had been at that corner as far back as he could remember. Mr. Goldberg said the drivers whip up S. E . 2nd Avenue north of Dixie Highway. The matter was dropped and no action taken. Recall. Petition ommissioner Waiters said he had had a meeting with his attorney in regard to the recall petition and had instructed him to go ahead and have the matter put down for a hearing as soon as possible, which should have been done this date, July 1, 1968. Personnel -School Crossing Guard —commissioner alters requested the City Commission appoint Mr. Carter Tucker, 1719 S.W. 4th Street, as a school crossing guard this fall for the Bethune Elementary School. Commissioner Waiters said he would try to get the City of Hollywood to pick up half the cost of the school guard because many of the children attending the school were from Hollywood, too. Com- missioner Houston suggested the request be turned over to the Chief of Police so this man could be worked into the Police"Department's budget for 1968-69. Police Chief Parton said there was a traffic light at that particular school crossing and did not see the necessity for a school guard; that it would be better to utilize a man at S.W. Second Street. Permit Fee Schedule Commissioner Thornton said the proposed Permit Fee Schedule for the City of Dania had been prepared by Building Inspector Walker and that he would see copies of this schedule were made available to the City Commis- sioners and officials and that there would be a meeting shortly to discuss this matter.
