HELD ON SEPTEMBER

The City Commission of the City of Dania, Florida, held their regular
bi-monthly meeting in the City Commission Room at the Dania City Hall at
8:00 P . M. , September 3, 1968.
The invocation was given by the City Attorney, Mr. Walden, and the
pledge of allegiance to the flag was recited.
Mayor-Commissioner Kelly asked the Clerk to call the roll and the
following Commissioners and city officials were present:

and unanimously passed, the City Commission adopted a resolution effective
immediately accepting a quit claim deed from Bellows Development Corporation,
a Florida corporation, concerning the following described lands situate,
lying and being in Broward County, Florida, to wit:
The Easterly 8.60 feet of Tract A, "Resubdivision of Dania Del
0 Mar," according to the plat thereof, as recorded in Plat Book
14, at page 73, of the Public Records of Broward County, Florida;
said lands situate, lying and being in Broward County, Florida.
Public Hearing - Swanson-Parker-Miller - R-Apartment Zoning Classification
Thetime now being approximately 8:15 PP., the time aavertised for a
public hearing in the matter of Swanson-Miller lands, the City Attorney
noted that a hearing concerning the general area in question was conducted
by the City Planning and Zoning Board of Dania on Tuesday, July 9, 1968, and
a notice was advertised concerning a further hearing before the City Com-
mission of the City of Dania, Florida, at 8: 25 P .M. , Monday, July 22, 1968.
However, at the meeting of the City Commission of the City of Dania, held
on July 22, 1968, it was discovered that certain errors existed in the
legal descriptions of the lands which the applicant sought to have rezoned.
Therefore, on July 22, 1968, the City Commission authorized a hearing for
objections to be held on August 19, 1968. Subsequently, because of delays
in obtaining the correct legal description, the City Commission adopted a
motion on August 5, 1968, which, in effect, authorized the aforesaid public
hearing to be held at 8:15 P.M . this date, September 3, 1968, at 8:15 P.M.
at Dania City Hall.
City Attorney Walden further said the purpose of the Commission con-
ducting a public hearing was to consider the adoption of an ordinance which,
if adopted, will cause the rezoning from existing zoning classifications to
R-Apartment Zoning Classification, under the zoning ordinances of the City
of Dania, Florida, all of the following described lands situate, lying and
being in Dania, Broward County, Florida, to wit:

Public Hearing - Swanson-Parker-Miller - R-Apartment Zoning Classification
ont Ordinance - First Reading
Commence at the intersection of the north right-of-way
line of Dania Beach Boulevard and the West line of
Section 35, Township 50 South, Range 42 East; thence
run northerly along said West Section Line of Section
35, for a distance of 550 feet to a point; thence run
Aasterly along a line 550 feet north of, and parallel
to the said north right-of-way line of Dania Beach
Boulevard for a distance of 111.80 feet to the Point
of Beginning for this description.
Thence continue easterly along the last described course
for a distance of 553.12 feet to the east line of the
SW4 of NW4 of the SWw4 of said Section 35; thence run
southerly along said east line of the SW4 of the NWk of the
SW4 of said Section 35 for a distance of 300 feet to a
point; thence run westerly along a line 250 feet north
of and parallel to the north right-of-way line of Dania
Beach Boulevard for a distance of 553.24 feet to a point;
thence run northerly, in a straight line for a distance
® of 300 feet, more or less to the Point of Beginning.
The said lands are located generally between Dania
Beach Boulevard to the South, Northeast Second Street
to the North and Dania Jai Alai Fronton to the West
in Dania, Broward County, Florida.
Mr. Melvin Muroff, Attorney, appeared before the Commission and was
recognized by the Mayor. He said a portion of the Swanson-Miller lands
back to Gulfstream Road was not included in the application at this time.
He discussed Parcel "B," roughly five (5) acres facing 2nd Street and
Parcel "A." a portion on Dania Beach Blvd. , roughly 132 feet east of
®► 5th Avenue extension down to 250 feet from Dania Beach Blvd. and back.
In discussing the above five (5) acres, he said this was all zoned B-2
except for one-quarter 100' x 100' which is C-1. Commissioner Houston
discussed rights-of-way and Mr. Muroff said his people would be very
glad to give 35' right-of-way despite the fact they were not asking for
a change of zoning in B-2.

After more discussions, Mr. Muroff said his people would give a 70'
right-of-way for the construction of N. E. 5th Avenue extended, which is
on the north side of Dania Beach Boulevard and zoned B-2 to the depth of
the Swansom-Miller Tract, and that the name of the project would be called
The Danians Condominiums .
On motion of Commissioner Waiters, seconded by Commissioner Marant,
and unanimously passed, the Commission passed an Ordinance on First Reading
rezoning the existing property, as applied for by Mr. Melvin Muroff, to
R-Apartment Zoning Classification in the Swanson-Miller Tract, subject to
receiving a 70' right-of-way deed in the area zoned B-2, N. E. 5th Avenue
extended, which area was not included in the application to rezone.
Swale Ordinance - First Reading

City Manager Goldberg said he had some suggested changes in the ordinance,
which was tabled from the meeting of May 27, 1968. He said under Section 1,
(a) Residential Areas, lime 2, change 20 per cent to 30 per cent; ai,d after
the semi-colon of the same line add "except where positiv"�y well
drainage is available. the complete swale area can be paved." Further,
that on Page 2 additional items be added, i. e. Item (7) "no rock other
than washed 3/4 rock shall be used unless paved over;" and Item (8) "all
work done in the swale area shall be done at the owner's risk; if the city
has to remove same there will be no recourse."

Rezoning - Smith & Bellows - R-Apartment Zoning Classification - Third Reading

application of Smith & Bellows, an Ordinance rezoning the Smith & Bellows
property from existing zoning to R-Apartment Zoning Classification and
then proceeded to read the Ordinance. He noted that Smith & Bellows were
asked to give a quit claim deed of S' on the north side on Na E'., 2nd St., and
35' on the east side of the acreage for right-of-way purposes on N.E. 5th
Avenue and that a resolution would be prepared accepting this deed.
There being no further discussion, on motion of Commissioner Houston,
seconded by Commissioner Marant, and unanimously passed, the Commission
® passed on Third and Final Reading the Ordinance rezoning the Smith-Bellows
Tract from existing zoning to R-Apartment Zoning Classification.

On motion of Commissioner Houston, seconded by Commissioner Waiters,
and unanimously passed, the Commission approved the eleven (11) afore-
mentioned 1968-69 renewal applications for alcoholic beverage licenses.
City Attorney Walden submitted the transfer applications for a 2-COP
alcoholic beverage license of Ship N Shore Bar, and L & R Chicken Skillet
Corp. for approval and the new application of Balco Foods, Inc. for a 4-COP
alcoholic beverage license .
On motion of Commissioner Houston, seconded by Commissioner Marants,
® and unanimously passed, the Commission approved on First Reading, subject
to the Police Department and Fire Department's approval, the 2-COP trans-
fer applications for alcoholic beverage licenses of: Ship N Shore Bar and
L & R Chicken Skillet, and the new application of Balco 0o s, Inc. for a
/;-COP alco olio everage license.

After discussion, Commissioner Houston moved the City Attorney be
instructed to draw a resolution, adoptive and effective this date, authoriz-
ing the proper officers of the City of Dania to enter into agreements with
the above listed respective property owners adding their properties to the
Sewer Assessment Roll for the amounts indicated. Commissioner Marant
seconded the motion, which carried unanimously .

Houston moved the City Attorney be instructed to draw a resolution, adopted
and effective this date, authorizing the proper officers of the City of
Dania to enter into an agreement with Mr. and Mrs . Joseph M. Bringman where-
by the city waives $366.00 of the total assessment on the condition that an
agreement effective for twenty (20) years be entered into providing that the
lot not be divided. Commissioner Marant seconded the motion, which carried
unanimously.

After considerable iscussion and objections from Carl Zenobia and
Robert Grammer in the audience, and Commissioners Houston and Thornton,

passed on Third and Final Reading as read by title only effective September
16, 1968. Commissioner Marant seconded the motion and the Commissioners

Occupational License Ordinance - Second Reading

Kelly said the ordinance, as presented, was not intended to raise licensing
fees this year, but that the intent was to add additional licensing cate-
gories not presently covered in the present ordinance and to up-date the
enforcement of the ordinance, subject to certain revisions as outlined by
the Building Inspector, and the rates to be charged, where Dania does not
have a rate presently, will then be picked up as the same rate charged by
!' Hollywood.
Mr. Mervin Span, Dania, was advised, in answer to his questions , that
for his present occupation, his licensing fee for the forthcoming year
would be the same as last year.
Commissioner Houston objected to some of the fees proposed and
Mayor Kelly suggested he make his recommendations to the City Attorney
prior to Third Reading of the ordinance.
After further discussion, a motion was made by Commissioner Waiters
and seconded by Commission Marant to pass the proposed Occupational License
Ordinance on Second Reading, read by title only, subject to certain
revisions to be made by the City Attorney prior to Third Reading. The
' Commissioners voted as follows:

Commissioner Thornton, at this time, recommended that the City Clerk
mail any renewal notices not yet sent out.
Complaint - Drainage
—fir-C. Pinter, 37 S. W. 10th St. , Dania, appeared before the Commission
and was recognized by the Mayor. He said the rainwater comes up to the
" door of his garage and the sewer cap was above the water; that at times
there was 8" of water lying there. He said the Commission had previously
said the alley would be the way it was before the sewer was put in, and
requested the Commission to take care of this drainage problem by provid-
ing three or four tons of black top, a depth of �" to 3" for about 201 .
City Manager Goldberg said, that as the situation was heard here, the
bonding company or sewer contractor was liable for this because this was
one of those areas where the city notified them that the alley was not
satisfactory. He said they did go back in their with their engineers
and were supposed to have reset that alley at the grade it was before the
sewers went in place and suggested, that Mr. Carney, along with the engineers
check and find out whether or not it was replaced or made worse. Further,
he said he did not think it should be the city's cost, but the sewer bond-
ing company's cost. Mayor Kelly said he thought the city should do it and
Dut it in along with the others the city will have to fight over. Com-
missioner Thornton said he would like to see the matter resolved within
th�; next week or ten (lays .
Commissioner Thornton moved that the city take care of the drainage
pro:Ilem at 37 S . U. 10th Street, Dania; to notify the bonding company
in the proper manner, and to have the city proceed with the required work
as cesignated by the engineers to get rid of the water. Commissioner

Mosquito & Sandfly Control
Mr. Peter P . rossic, 529 N. W. 10th Street, Dania, appeared before
the Commission and was recognized by the Mayor. He said that he, and
:j the people in his neighborhood at Melaleuca Gardens have been bothered,
especially at night, with biting bugs and requested that the city's
fogging machine be sent there in the evenings, and more frequently than
in the past. Commissioner Waiters said the county's plane and the city's
Z'Yn fogger have tried to coordinate their efforts at controlling pests and
said the city management would check further into this effort with the
Acting Public Works Director, Mr. Pbtrozella. Commissioner Marant noted
the Fire Chief had told him he had seen the fogging machine in that area
only once and that last week was the second time.
School Crossings
r. Mervin Span, from the audience, requested information as to why
the school crossings have not yet been properly marked prior to the
commencement of the 1968-69 school year. Chief of Police Parton said a
part on the machine to make these markings was broken and the city was
looking for the part to fix the machine.
Water Wells
Mr. Gus Brice, Dania, appeared before the Commission and was recognized
by the Mayor. He requested information as to the status of obtaining water
wells for the City of Dania. He said the city seems to wait until the rainy
seasons come on and then forget all about water wells until the city gets
into a dry spell. He said he and others were well aware the city would be
in serious trouble with regard to the water situation, if the city did not
do something about it. Commissioner Houston said he had been recommending
getting wells put in for sometime. In- the course of the conversations,
Mr. Brice said he had started the ball rolling in this matter when he was
on the Commission to go to the County Commissioners to make a deal with
them to furnish water for Camp Blanding; he said the city can still go to
them and make a deal with the County.
•� Mr. Goldberg said this matter had been before the Commission at least
a dozen times in the past year. Commissioner Thornton insisted it was up
to the City Manager to find well sites and there was nothing the Commission
could do until this was done. Mr. Goldberg said the Utility Committee sug-
gested negotiating with the School Board for a well site at Stirling Road;
also that a report had been received from the City Engineer concerning
a using that location, which report was presented to the Commission. He
said the figure was in the $100,000.00 bracket. He said a well had been
put there and the water was good; that the School Board put in a test well
and had supplied the city with the results. Commissioner Thornton said
such a report had never been presented to him. Mr. Goldberg further said
the School Board had suggested the city go through formal channels to put
their request in for water and he said, that at that time, he asked the
Commission if they wanted to go through with this in view of the cost
! of about $200,000.00, but that Commissioner Houston said he would take care
of this . Mayor Kelly said this was a question of economics and that he
had talked with the City Engineer in regard to the area just west of the
Seaboard Railroad and this was where the matter had bogged down, right

City Manager' s Report - State Road Department - Drainage Easement - A-1-A
City Manager Goldberg sai e a received rom the State ad depart-
ment a drainage easement regarding the widening of Dania Beach Blvd. from
U . S . #1 to A-1-A to be executed by the city. He said the SRD was asking
for the drainage easement over the Canal which runs roughly from the New
England Raw Bar out to the interchange on the Intra-Coastal Waterway.
Commissioner Thornton asked if the Canal would be left open or if the SRD
was going to dump into it and Mr. Goldberg said he thought they were going
to leave it open, but would have to look at the construction plans. At
this time City Attorney Walden said Mr. Frost got a quitclaim deed to the city
from Model Land Co. for the canal. Commissioner Thornton said he would not
like to see the canal covered.

City h1anagerls Report - State Road Department - Drainage Easement - A-1-A
On motion of
Commissioner 15ornton, seconded y Commissioner Marant
and unanimously carried, the Commission tabled action on the SRD drainage
easement until .further information is available on the easement.
Sewers
City Manager Goldberg requested authorization to advertise for bids
on chemicals for the Water and Sewer Departments. Commissioner Thornton
is asked what was the situation with the central purchasing agency through
the county' s facilities and Mr. Goldberg said he believed the problem was
that they had let out a bid and that the company would not honor the
t cities at the same price. Mr. Carney, Sewer Superintendent, concurred
with Mr. Goldberg' s understanding of the situation. After discussions,
Mr. Carney was referred to the County Purchasing Agent, Mr. Fred Flanders,
for further investigation of chemical prices to the city under the central
�. purchasing plan, and make a report back to the Commission.

Streets - Paving
City anager Goldberg said that in line with paving to be done on
the East Side for streets now under construction, the city had for some
time had bad conditions on the West Side of town and particularly at the
intersections of some of the streets . He said he would recommend that
for the present time the Commission authorize up to $1,000.00 for the
repair of these intersections, at least the worst intersections repaved.
Commissioner Houston said he would like to see some bid prices made.
Commissioner Waiters said he had a breakdown or list of some of the
worst streets and would like to go along with the City Manager's recom-
mention at this time. Mr. Mervin Span, from the audience, said the Com-
mission should think about drainage problems first before resurfacing.
Mayor Kelly said repaving is a temporary measure and that in about two
years he thought the State would put pressure on for all cities to have
in their sewers. Commissioner Thornton said he would like to see the
city fix the streets that need to be fixed by putting in the drainage
first and then resurfacing the streets. Mayor Kelly said he would like
to see telephone bids put out instead of field bids for the work to be
cone now up to $i.,000.00, with recommendations from the City Engineer.
Commissioner Waiters made a motion that $1,000.00 be allocated for
resurfacing intersections at N.W. 4th Ave. and W. Dania Beach Blvd.,
hi. W. Gth Ave . and lst St. (Tigertail Blvd.), and N.W. 6th Ave. 6 W. Dania
Bach Blvd. . Commissioner Marant seconded the motion, and the Commis-
sioners voted as follows:

City Manager's Report - Streets - Paving
City Manager erg requested 5Rhorization to advertise for bids
for street paving work on the West Side of town in the estimated amount
-: of $6 810.00. Mayor Kell said most of the work would be resurfacing.

_'`''" would not be basically changed. Commissioner Thornton said he would like

::- to see the streets fixed like they ought to be fixed, just as the city
was doing on the east side. It was noted by City Attorney Walden, that
if the streets were to be assessed to the property owners, the city would
have to advertise for objections . Commissioner Thornton said he would
® also like to see drainage put in where necessary. City Attorney Walden
said if the Commission were to do anything by special assessment, he :
would suggest tabling the matter until the next meeting because the Com-
mission would have to adopt a resolution of necessity, which pinpoints
the exact places the city has in mind and what the city is going to do
to them, and authorizing a public hearing.
City Manager Goldberg said his recommendation was to basically take
care of the bad intersections and those areas which may be twenty to
thirty feet from the intersections, in accordance with the City Engineer's v
recommendations and to receive authorization to advertise for bids for
street resurfacing, including reworking swales in the total estimated y
• amount of $6,810.00, which list of streets and estimated costs is
attached hereto for the record.
After further discussion, Commissioner Thornton made a motion to
authorize the city engineer to prepare plans and specifications in
regard to the fifteen streets noted above and to bring his recommenda-
tions back to the Commission so that -the streets may be put in proper
order and then as soon as possible the city should advertise for bids.
Commissioner Marant seconded the motion, and the Commissioners voted
as follows:
