City Commission of the City of Dania, Florida, held their regular bi-monthly meeting in the City Commission Room at the Dania City Hall at 8: 00 F . M. , August 19, 1968. 1h, invocation was given by City Attorney Clarke Walden and the pledge i of allegiance to the flag was recited . Mayor-Commissioner Kelly asked the Clerk to call the roll and the '>' following Commissioners and city officials were resent: g Y P r ... Clay There being a quorum present, the Mayor called the meeting to order. City Commission On motion of Commissioner Thornton, seconded by Commissioner Waiters, and unanimously passed, the Commission excused Commissioner Marant from the meeting. Minutes Approved On motion of Commissioner Thornton, seconded by Commissioner Waiters, and unanimously passed, the Commission approved the Minutes of June 24, July 1, July 15, July 17, and July 22, 1968. ReZoning - R-Apartment Zoning Classification Ordinance On recommendation ot City Attorney Walden and on motion of Commissioner Houston, seconded by Commissioner Waiters and unanimously passed, the Commis- sion tabled until September 3, 1968, the Third and Final Reading of an Ordinance rezoning the property known as the Smith & Bellows Tract to R-Apart- ment Zoning Classification. Drainage and Paving - Municipal Improvement #6555 delegation of home owners appeared a ore the Commission to discuss the drainage and paving of S . W llth Street, Dania, Florida. The spokes- man said the people all agreed to pay for the paving of the new street with the promise they would get drainage, but that now the drainage had been cut out. He said that when they asked to have the street repaved, the Commission said they could not repave it because it would not last and the water would tear the street up and wanted to know what was going to happen to the new street. He said this was a problem that was supposed to be taken care of by the city and that Commissioner Waiters promised, that if they agreed to go ahead with the street, they would get the drainage. Commissioner Houston asked Commissioner Waiters if he had made such a promise and said Commissioner Waiters had no authority to make such a promise, Mayor Kelly said the issue was whether the drainage was needed on S. W. llth Street and whether the city was going to do it or not. He said the bid was let in separate bids and the drainage was separate; that some Commissioners that were for putting in the drainage and other who said the drainage could be put in later. He said the city engineer had recommended putting in the drainage and that there would ® not be enough drainage through the swales to take care of the drainage. After discussion. Commissioner Waiters made a motion to put the drain- age in at S. W. llth Street while the street was under construction. Motion died for lack of a second. Commissioner Houston moved that the Occupational License Ordinance be read by title only and passed on First Reading. Commissioner Thornton seconded the motion. t=" Commissioner Houston noted at this time that the handling of issuing and enforcing occupational licenses should be under the complete jurisdic- tion of the City Clerk, and Mayor Kelly said that the manner in which occupational licenses are transferred should be looked into so that dis- crepancies or errors will not occur when issuing these licenses. Mayor x Kelly said he understood the Ordinance would not increase the fees, but would increase the categories for occupational licenses as well t: as up-dating the categories . City Manager Goldberg questioned whether it was the intent of the Commission to change the fees for the forthcoming fiscal year, because, if the city was going to change the fees, the Cityi :;' *fit Clerk would have to be instructed what to do very shortly, Commissioner Houston said he believed the City Clerk had plenty of time in which to mail out renewal notices , Commissioner Houston said occupational licenses do not become delinquent until after October 1, 1968 of the fiscal year. Building Inspector Walker said renewal notices for Certificates of Competenc,, ¢ A for the trades were generally sent out in August so the holders of such certificates could renew their occupational licenses as of September 1st of the fiscal year. Commissioner Waiters recommended that the City Clerk send out the balance of prepared occupational license renewal notices on r September 15, 1968. There being no further discussion on the motion on the floor, the Commissioners voted as follows: °a- Houston Yes Thornton Yes Waiters Yes Motion passed. Kelly No Civil Service - Resolution Adopted and Effective (Implementation of Civil 7rvice an 7—ty­-TtEtorney Walden presented a Resolution to implement the Civil Service Plan so that said plan would be in full force and effect, Commis- sioner Houston said there had been a conference prior to the Commission meeting on this plan and stated that, if any changes were contemplated, he wished them brought out now and whether certain individuals came under the Civil Service Plan. City Attorney Walden said the persons discussed to come under the civil service plan, as it reads. Commissioner Houston said he did not want to see any Commissioner coming before the Commission in a week or two and attempt to change the classifications . Commissioner Waiters said they had not exactly decided which persons would come under the plan and Commissioner Houston said, then, he could not vote on it. Commissioner Waiters made a motion that the Resolution implementing A the Civil S- rvice Plan to put said plan in full force and effect be adopted this date . Commissioner Thornton seconded the motion for discussion purposes only. Commissioner Thornton asked if Civil Service superseded the City Charter and City Attorney Walden said it did because the Civil Service Plan amended • the Charter and it superseded anything earlier in the Charter, if there was a conflict. Mayor Kelly said that one of the first things the Personnel Director would do would be to classify the present employees and advertising for anv r';-- new categories or employees that are needed and the Civil Service Board will ssubmit sealed tests; that the Board will not know what these contain, which tests will come from the University of Chicago and the University of California . 'i Garbage Ordinance ' City Manager Walden submitted for further discussion the matter of S c_ th(- proposed Garbage Ordinance, which as passed on First and Second Readings. g After twenty minutes of discussion, City Manager Goldberg recommended, that ^' • in the Garbage Ordinance now before the Commission, that after the word license," in Section ?_, amend to read, "comma, excluding condominiums , co-ops and apart- ments,"and then under Section 3, put a comma at the end of the sentence and add, "including condominiums, co-ops and apartments." In the discussions, Mayor Kelly said he would like to see some reasonable fee put into this ordinance whereby a person who has a motel, or a trailer park, were willing to pay a little more for garbage pick-up, that it would be helpful. City Manager Goldberg pointed out that the 1937 Garbage Ordinance says that the city shall charge $1.00 per can and that he was sure, that when the State Auditors ' reports is submitted, the State is going to know the city has not been making these charges .of $1.00 per can. He said in the 1965 Minutes this same issue had been handled by previous Commissions and, apparently, every Commission that has sat in the City of Dania has found the garbage situation to be a problem. The question he said was whether the city was going to continue to operate under a 1937 ordinance and that he could not enforce this ordinance. After a thirty minute discussion on the pros and cons of adopting a S Garbage Ordinance at this time, Commissioner Houston moved that the two previous Readings of the Garbage Ordinance be cancelled, and Commissioner Thornton seconded the motion. City Manager Goldberg said he was firmly opposed to rescinding the Garbage Ordinance before the Commission now whereupon the Commissioners voted as follows: 0 Houston Yes Thornton Yes Waiters No Kelly No Motion stalemated. Permits —amity Attorney Walden submitted the recommendation of the Planning and 'honing Board that the request of Robert and Addie Mae Chunn to build a 4-unit apartment be approved and a permit issued for such construction. Commissioner Houston moved that the application of Robert And Addie Lac. Commissioner Waiters assured Mr. Curry and others in the delegation the city would take care of the aformentioned matters . ® City Manager's Report - Sewers ar City Manager Goldberg recommended that legal action be taken by City s. Attorney Clarke Walden regarding the $10,000.00 that was due from Peerless Sewer Bonding Company and, also, that the City Attorney take some action regarding the bonding company's refusal to be responsible for the Hilger-Ely sewer line which was found to be i stalled incorrectly by Sewer Superintend- ent William Carney and checked by} city's Sewer Engineers, Philpott, Ross & Saarinen. City Attorney Walden said he would handle the matter of the bonding company . Commissioner Thornton moved that the Hilger-Ely sewer line be corrected and Commissioner Houston seconded the motion which passed unanimously.
