Page -I- 'The City Commission of the City of Dania, Florida, met in the Commission Room at Dania City Hall at 8:00 P.M. , June 10, 1968. The pledge of allegiance to the flag was recited. The Mayor asked the Clerk to call the roll and the following Commis- sioners and city officials were present: Mayor-Commissioner - Robert Kelly Commissioners - Robert K. Houston - Richard Marant - Boisy N. Waiters - Joseph Thornton City Attorney - Clark Walden City Manager - Stanley Goldberg Chief of Police ' - Donald Parton Building Inspector - Hubert Walker Acting City Clerk - Gloria Houghton The Mayor called the special meeting to order. Ordinance - R-Apartment Zoning Classification - Third and Final Reading motion was made y ommissioner farran�c seconded by Commissioner Waiters that the Third and Final Reading of the R-Apartment Zoning Classifica- tion Ordinance be read by title only. After some discussion, the Commissioners voted as follows: Commissioner Houston - No it Marant - Yes 'f Thornton- No n Waiters - Yes ff Kelly - Yes Motion passed. Ordinance - R-Apartment Zoning Classification - Third and Final Read in Clarke Walden, City Attorney then red the - partment 'wing rdinance in its entirety. At the conclusion of his reading, the majority of the Commissioners agreed upon two amendments: (1) Amendment provided that town houses or row houses should each have two (2) parking spaces. The other amendment, (2) provided that there shall be no more than two (2) curb cuts for each 200 feet of street frontage. With respect to the two amendments, Clark Walden read the exact language used to accomplish each amendment. Thereupon, Commissioner Marant moved that the Ordinance, incorporating the above two amendments, be passed on Third and Final Reading. Commissioner Waiters seconded the motion. The Commissioners voted as follows: Houston Pass Thornton Yes, subject to the two amendments read be inserted wherever applicabl Marant Yes Waiters Yes Kelly Yes Motion passed. Note: Mayor Kelly said he would be in favor of giving a variance on a setback for a town house. He said he felt that a 501 setback for a town house would be excessive, but that if a person brought in some plans and the Commission saw what it was, that he believed the Commission would be willing to grant a variance. 6/10/68 -1- Y c 61IPIUTES OF SPECIAL MEETING CITY COMMISSION CITY OF DANIA June , 19 Page -2- Public Mousing Authority - Proposed Ordinance Mayor-Commissioner Kelly requested Crty Attorney Walden to draw a rC : Public Housing Authority Ordinance to be considered for First Reading Q at the meeting of June 17, 1968. Proposed Test We11 Sites ommissioner Houston reported to the City Commission on test well sites. He said he and the City Engineer had in mind two sites at the present time, but that in connection with the first site the Commission would have to get an agreement for purchase of the land in order to put the test well there. Commissioner Houston said he would like the Commission to authorize putting a test well there now and then, if not successful. at that site, he would like the Commission to approve putting in a test well on the second 'piece of property. No action was taken. Amended Ordinance - Water Meter Charges - First Readin ommissioner Houston recommene at t e ommiss on consider amending the ordinance concerning water meter charges. City Manager Goldberg recom- mended that the water meter charges be the same as those in the City of Hollywood. After further discussion, Mayor-Commissioner Kelly made a motion to draw and adopt on First Reading an amended ordinance on water meter charges and that the amount to be charged on the following sized water meters installed be: 5/8", $75.00; 111, $150.00, 1�11, $185.00 and 211, $295.00. Commissioner Houston seconded the motion. The Commissioners voted as follows: Houston Yes Marant Yes Thornton Yes Waiters Yes Kelly Yes Motion passed. Proposed Garbage Ordinance Mayor e y at this time discussed a proposed new garbage ordinance he wish to have drawn and adopted, and requested the City Manager to report. Mr. Goldberg said the problem concerning garbage was of long-standing and that the only ordinance on the books now was written in 1937, Ordinance No. 87. However, he said in 1965 there was quite a lengthy discussion at a Commission meeting about garbage collection and he believed, that he had determined from that meeting, it was decided that two cans, twice a week would be picked o up by the city instead of the way the ordinance read and that this would apply to residences and businesses alike, and that a charge of $1.00 would be made for each additional can picked up, with the option of paying this charge or having private haulers pick up the garbage. He said, that to his knowledge no charges have been made by the city no matter how much garbage has been collected. He further said there was, at present, no established policy of pick-ups between the city and privator collections. He suggested a policy be established and to have amended the ordinance now on the books. Commissioner Houston said he was against the city getting into the garbage business . He said he did not believe the city was being handicapped today in any way in picking up the garbage, and there were a lot of people who were losing money. He said everyone should do as he suggested, that they go along with the city and" that he knew there were some places in the city that would not do it, but that those people have to come into the city for favors at times. He said those people should be put on a list where they would never get a favor, if had anything to do with it. After more discus- sion Mayor Kelly said he understood that in the case of some of the places the city is picking up more than twice a week. Commissioner Houston the city was not to do it. Mayor Kelly said he agreed that he did not wish to see the city go into the commercial garbage business, that he did not think this was part of the city's function, but he said he did not see going out and making a backdoor deal with each individual. Mayor Kelly said that it was, thanks to Commissioner Houston, but that he would still say it was the wrong a way to do it, that the city needed a clear-cut policy where the city's men who are responsible for the job can go out and say this is the ordinance, this is the law, and this is the way it is going to be done, Commissioner Houston said that would call for a Garbage Superintendent, ^ 0 After considerable more discussion among the Commissioners and members of the audience Commissioner Thornton said he saw nothing wrong with making three (3) pick-ups, three (3) times a week for all businesses, and, that if this was not sufficient, the city did not care, and they could have individ- ual people haul it off, but that he thought the businessess were entitled to a certain amount of pick-up. He said he believed these people were pay- ing the greater share of taxes and footing the bill, that is the majority of them were. Carl Zenobia was recognized by the Chair and he said he understood a Policy had been set by the Commission in 1965, that two (2) cans of garbage would be picked up from everybody, that a commercial outfit would not want the job of just picking up two (2) cans. x, Tom Sette, West Shore Sanitation Service, 210 S. E. 3rd Terrace, Dania, was recognized by the Chair and he said, among many things, that the New "F ar England Oyster House has sixteen (16) yards of garbage everyday and that a � ^, <r he did not think the city could handle that amount of garbage, and that he ; has collected sixteen yards of garbage for $260.00 a month. After considerable more discussion, Mayor Kelly requested the City Attorney to bring back to the Commission an ordinance on garbage collection as soon as possible, after getting together with Mr, Charles Petrozella of the Public Works Department and City Manager Goldberg, and for them to come up with a proposed ordinance or an outline whereby the city would have a law ® with which to work. The Commission established, that for the interim period, until a garbage ordinance could be adopted, the city's policy of picking up garbage would be as follows : 0 Commercial establishments, such as restaurants, food stores, etc., 3 cans (not to exceed 30 gals, each), 3 times a week; cans to be in one area and the balance of the garbage to be hauled by private collectors at the expense of the owners-operators; and those who did not wish city service would not be obligated to accept such city service. The motion was seconded by Commissioner Merest. There was discussion that the bills referred to were discussed at a Commission meeting held May 29, 1968, and that the bills then presented were then approved for payment, subject to the Finance Committee's approval, City Manager Goldberg reported, that the money now, also, under discussion was to pay 7% of $46, 285.50, plus miscellaneous items in the amount of $3,660.10, plus amounts of $162.50, $142.50, and $107.50. Commissioners Houston and Thornton objected to the amounts of some of the bills. After further discussion, the Commissioners voted as follows: Houston No Marant Yes Waiters Yes Thornton No Motion passed.
