The City Commission of the City of Dania, Florida met in p Special Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER RICHARD MARANT COMMISSIONERS JAMES G. ADAMS GUS S. BRICE ROBERT KELLY ® CITY ATTORNEY BOISY WAITERS CLARKE WALDEN CITY MANAGER STANLEY GOLDBERG CHIEF OF POLICE ANTHONY CARACCI (ABSENT) CITY CLERK MARY THORNHILL O The meeting was called to order at 6:30 P.M. by Mayor Marant, for the purpose of resolving the situation on Dixie Highway, regarding manholes. City Manager Goldberg stated that Mr. Richardson of the State Road Department has advised the members of the Commission that O the City is responsible for the lowering and the raising of the manholes on Dixie Highway. This meeting is to consider authoriz- ing the funds for this work. He presented a quotation of $1684.00 for the work, with the City providing the concrete work around the basins. Therefore, the appropriation should be in the neighborhood of $2,000. O Commissioner Brice: Gentlemen, I read this letter very carefully, from Mr. Davidson. And I think we were in error in doing what we did in the first place, but we have done it. So now we have got to go back. Mr. Brice then read a paragraph of Mr. Davidson's letter, as follows: O "In cases where the utility plan is in conflict with the pro- posed construction, we expect the utility owner to make the necessary adjustment at their expense. However, in cases where the extent of the conflict is limited to the protrusion of the manholes in the subgrade or basegrade (and ours were in the O basegrade) we will expect our contractors to work around the manholes during their grading, stabilizing and base laying operations. In case where the grade is being lowered, and the projection of the manhole would create a traffic hazard, the manhole should be lowered and covered over until an appropriate time for its final adjustment-" s� Commissioner Brice continued: Now, these manholes were in the sub- grade, which he admitted. They were removed and cut off for the con- venience of the contractor, which I think we errored in not getting a directive from the State Road Department at the time requesting us to remove them. So it looks like now we have cut them down. So the contractor definitely is not going to put them back, because we put them down. So we are stuck. There is nothing else to do but put them back. Commissioner Waiters stated that Commissioner Brice is right. "But it appears to me that on numerous occasions that we should have persons out there who know what actually is going on with the job. I have seen too many cases where a person who is representing the City has not done what they have been paid to do. I don't know exactly whose shoulders this falls on, but I hope that in the future we don't have these things keep occurring, because we cannot afford this." City Manager Goldberg: I would like to say two things on that point. One is that I would like to have Mr. Carney explain exactly what happened -1- eye t for the matter of the record, because I think'it should be under- stood that if you do approve this money that you are approving it because this is a State Road Department requirement. If the lia- bility were on the contractor of the State Road Department, then ® I think they should pay for it, if that were the case. Before I have Mr. Carney say that, I would like to report that I had a telephone conversation with Mr. Urcheson today. He called wanting me to advise him tomorrow as to what the City is intending to do. But in that conversation today, as in previous epnversati:ons that he had with the Commission, he stated that had'.:the City not lowered ® the manholes, that the City would have had to make a separate agree- ment to pay the contractor for hand labor foriwork around the man- holes . Now this is what he stated to me today, and. . . Commissioner Kelly: Stan, I can't buy that though. ® City Manager Goldberg: I'm just trying to establish. . . .Mayor, isn't that what he stated at the meeting? Commissioner Kelly: Well, he was working all-around it at the meet- ing, but I still say when a contractor gives a price on a stretch of road, he knows what's in there. Now, he is right when he says that the telephone company has an expensive coaxial cable there, and they '8 don't want any heavy equipment around it, then if they have to work it by hand, then they are due extra money. Just the same way with our water line. If they had to work around it by hand, then they are entitled to more money. But for something like a sewer manhole, I can't see why the City would be responsible to pay them to work 0 around it. This should be in their price, I would think. City Manager Goldberg: Personally, Mr. Kelly, I agree with you. I think this is the reason the commission originally met with them. All I am saying is that I am trying to repeat Mr. Urchesons conver- sation both with me today and with the commission as closely as I A recall it for the matter of record; and that is that he said that we would have to pay the contractor to work around the manholes, at our meeting. Commissioner Waiters, is that correct? Commissioner Waiters: That's correct. City Manager Goldberg: That's correct. But yet, Mr. Davidson's letter doesn't say that. Commissioner Brice: But, as I said, gentlemen, we lowered the man- holes, and there is nothing we can do about them now, but go back there and put them back. City Manager Goldberg: Mr. Carney, do you want to explain that situa- tion, how the manholes got lowered? Bill Carney: I received a call from the State Road Department just prior to noon one day while the job was going on, stating to meet them ® on the job in reference to lowering the sewer manholes, which were in their way. I picked up Mr. Farina, City Engineer, and we drove down to the job. There was the resident Engineer on the job, one other engineer, and a survey crew from the State Road Department. And they told us that the manholes would have to be lowered 23 inches below the existing grade. At that time Mr. Farina and I questioned it that we had never heard of it before, that we knew they normally would be ` rV, adjusted two or three inches lower or higher, as the case arose. They said, no, this was the way it would have to be done. And they said they wanted it done immediately. They came back to the City Hall, and at that time I explained the situation to Mr. Goldberg, that this was something that they had said we should do. . . .lower them 23 inches. I then made arrangements for laborers to lower them 23 inches, cover them with lumber, and roofing material to keep the lines clean. They told Lis they would 're-locate them for us, so that we would know where they arc, and that we would have to re-raise them. -2- s 4N y�w:l� t W City Manager Goldberg: Do you recall the names of the Engineers that the State Road Department had instucted you to do this work? Mr. Carney: I believe now it was Mr.Squet, if he was the original ® engineer. There were two on the job, and that young dark haired fellow that was at the meeting the other day, I don't remember his name. Commissioner Kelly: Mr. Carney, they did tell you that we would have to raise them at our expense? 0 Mr. Carney: Yes sir, and lower them at our expense, 23 inches be- low the existing grade that they were set at. Commissioner Kelly: Well then, I feel that we are questing this at the wrong time. We should have questioned it a little more at the 0 time of lowering them rather than now. Mr. Carney: Well, like everything that has been on that job, it has been a last minute thing. They wait until they get ready, and they rush up here and say this has got to be done yesterday. . .you are hold- ' ing up the job. And of course we had them lowered at no expense. ® Mayor Marant: What do you mean by that? Mr. Carney: We had some laborers lower them at no expense to the city. We had the man who built them lower them. ® Mayor Marant: Charlie McDaniels, do you mean? Mr. Carney: No, no. . .Sewer manholes. Commissioner Kelly: Well, now what about this drainage. Isn't there some drainage catchbasins there that have to be. . . ® Mr. Carney: Yes sir, there is one drainage manhole that has to be' lowered on the S.W. corner opposite the mayor's place of business there. That was lowered. His was put in by All Construction at the time of the drainage job. Commissioner Kelly: And that has to be adjusted? Mr. Carney: It has been lowered, now it has to be re-raised. Commissioner Brice: Mr. Walden, in a situation like this, can we pass this on an emergency measure? City Attorney Walden: Yes sir. It should be done that way. Commissioner Brice: I think we should pass this on an emergency measure. And since the City Manager doesn't have but one bid, he had put out for some other quotations from Burnup & Simms, All Construction, and Hosey, 9 and Rowe. Burnup & Simms said they are not interested, All is not in- terested, Rowe is 'not interested; but Hosey said they would send in a quote. But he hasn't received it yet. In this case, rather than take the quotation that he has, I would like to see us give him the authority to go ahead and negotiate with whichever one he feels will do the job, since this is an emergency. • F City Attorney Walden: I think you had better make a motion to pass a resolution to that effect. A motion was made by Commissioner Brice to pass a resolution to autho- rize the City Manager as an emergency measure to proceed with the rais- ing of the manholes on the Dixie Highway in accordance with instructions from the State Road Department. The motion was seconded by Commissioner Waiters, -3- t MXam i City Manager Goldberg: Shouldn't there be an amount of money desig- nated? Commissioner Brice: How can you put an amount on it? Commissioner Kelly: Not to exceed $2,000? Commissioner Brice: You could put it on it that way, but you might �. be hung.; g for $100 bucks then. Here is a $1 684.00 bid without the cement work. City Attorney Walden: I don't think you need to put a limit on it. " It is understood that it is going to cost about $2,000.00. g< has City Manager Goldberg: What fund can you use? Can you use the Sewer Fund? I_q a� r City Attorney Walden: No. City Clerk Thornhill: It would be the drainage fund. (ir ff` City Manager Goldberg: Well thatts sewer manholes. These are sewer `N 0 manholes that we are talking about. City Attorney Walden: I don't think it was a part of the. . .it is not a part of the sewer system as such. Commissioner Brice:fund that. . . I think it will have to go out of that drainage City Attorney Walden: Have you got anything left in the drainage fund? City Clerk Thornhill: Well we had $50,000, and we spent about $25,000 or $30,000. A City Attorney Walden: Out of the drainage fund then. City Manager Goldberg: I would prefer it if it came out of the sewer construction fund because this is basically what it is. 0 City Attorney Walden: But it doesn't pertain to the initial sewer contract, though. You are doing it for highway and drainage purposes. That's the reason you are doing it. City Manager Goldberg: Would it be charged then against the sewer department? 0 City Attorney Walden: I think you ought to charge it againsttthe drainage department. . . .drainage fund. That is the primary reason you are doing it. City Manager Goldberg: No. City Attorney Walden: What is the primary reason then? City Manager Goldberg: The primary reason is to adjust the sanitary sewer manhole. 0 City Attorney Wa.0 en: But the adjustment is necessary because of the drainage program. City Manager Goldberg: No. The adjustment is necessary because of the construction of the highway on which the sanitary sewer manholes are located. The drainage program is entirely different. I think that. . . City Attorney Walden: Well, I don't think you ought to pay it out of the sewer fund to give you a firm answer. If you have got some other -4- a tfiN ` V rt thing you can pay it out of, fine. But I don't think this is pri- marily qualified as actual sewer construction. If you have got some- thing else you can pay it out of, fine. ® City Manager Goldberg: What about the sewer operating budget? Be- cause if we have to change any kind of . . .for example. . .do any addi- tional sewer work, which this is . In other words, this is not the initial construction, but it is later construction dealing with the sewer department. ® City Attorney Walden: But I think legally you cannot charge it to your sewer account. If you want to go and do it, fine. But legally I don't think you can. I don't know what else you have got to pay it from. Commissioner Brice: I think that basically it has got to go back and be charged out of this drainage. Because this drainage was all tied into the construction of the Old Dixie Highway. Now it actually isn't drainage, that's true. But the whole drainage program is all tied into the widening and the reconstruction of this road. That's the reason I think it has to go back to be charged against :that drainage allocation. ® Commissioner Waiters: Well, how much do we have in that drainage fund? Commissioner Brice: We've got enough money. City Clerk Thornhill: Well, it was originally $50,000.00. I know that ® at one time it was $23,000.00. The roll being called, the Commissioners voted as follows: Adams Yes Brice Yes • Kelly Yes Waiters Yes Marant Yes Mayor Marant: Gentlemen, along the thoughts of this changes in the assessments rates that we passed at the last special meeting we had, ® there is a check to be authorized,'.for payment for Mrs. Collins, in the amount of $305.00, which the City Clerk and the City Manager are both aware of. We passed a resolution, I believe, to authorize this payment, but Mrs. Thornhill would like to know which fund this is to come out of. • Commissioner Brice: It would come out of the Sewer. Because, first of all, this is an easement. Now, as I understand it, you have al- ready returned the money that we had set aside for easements. Now it will have to come out of the contingency fund for out of the sewer construction. Now, don't you have a special account that we have been paying miscellaneous type of sewer things out of? i City Clerk Thornhill: Mr. Sparkman returned the balance of the last $5,000 to us, and it was put in the miscellaneous contingency fund. Commissioner Brice: This will have to be paid out of it then. Because we are going to have some others that we are going to have to put up some shrubbery, or do one thing or another. And we have got to have J some place to pay this. . .Since we have dlosed out the actual easement account. It will have to go out of the sewer contingency (miscellaneous) fund. City Attorney Walden stated that they have got to have a resolution show- ing these adjustments that were recommended by Mr. Farina; and with re- spect to Mrs. Collins payment, approximately $300, that will be paid out of the sewer contingency fund. Would you like a resolution to that e1 f ect? -5- s s Mayor Marant: We have got the resolution for the sewer assessment ' changes. We passed that at a special meeting that you did not attend. ski 'h (� e ht City Attorney Walden: Alright, well incorporate that all again in g another resolution, if you will. Commissioner Brice: Now, Clarke, we are going to have others come up like this. ® City Attorney Walden: Well, what we are doing now is making indivi- dual requisitions. The way this bond resolution was set up initially with the Dania Bank it provides that every time we spend anything, we make a requisition. And to avoid making these small individual re- quisitions for the easements, I think several thousand dollars were appropriated to this Sparkman account. If you wart to set something O up so that you don't have to make all these individual requisitions again, I would suggest a transfer of 3, 4, 6t 5 thousand dollars into �. some account that the City controls rather than the bank. Commissioner Brice: Well, how much do you think we should have? Now € here is the thing that's coming up. The construction of the easements ® that we are going to do now, which we shut off on M 6 B, those are coming up out of the construction fund. But any expense involved as far as the easements are concerned cannot be charged to construction fund. And that is where we are going to need these other funds to pay for this. 0 City Attorney Walden: Let me suggest that you authorize tonight that an account that the City Clerk, City Manager, and the Mayor (two out of three) can sign; called the Miscellaneous Sewer Fund; And that you authorize the City to transfer,cthrough-Lrequi§itioh ofrom the Dania Bank, $5,000 to that fund, and that the City officials can then pay O out of it without having separate requisitions to that fund. A motion was made by Commissioner Adams to pass the resolution setting up the Miscellaneous Sewer Fund. The motion was seconded by Commis- sioner Brice, and the roll being called, the Commissioners voted as follows: O Adams Yes Brice Yes Kelly Yes Waiters Yes Marant Yes O City Attorney Walden: I don't think you need to make any further re- solution, but I suggest that in the resolution we give at the bank, we still take the $300 , and let the bank issue its check for the $300 to Mrs. Collins, because it is going to take two or three days to get the checks made up-for this new account. ;O Commissioner Brice: Well the $king about it is that we passed the resolution at that special meeting authorizing all the things that was on that list, all of the changes, and so forth. So that resolution has already been passed by the Commission authorizing this $305.00; which was on this list. !/ City Attorney Walden: Well that will be alright, but what I am saying is in the future have $5,000 that the City can play with. Commissioner Brice: Yes, but you have the resolution now, as far as the bank is concerned, to pay it out of the trust fund. O Mayor Marant: Gentlemen, I think the City Attorney has something that he 'Mould like to discuss at this time. -6- gap City Attorney Walden stated that two gentlemen who are trying to develop some land West of Dania in the unincorporated area, which involves perhaps 200 acres, have talked about a proposition that would involve the City constructing a municipal golf course on this ® land, on an arragement that would be similar to the Pittsburgh Pi- rates Deal. In other words, you would buy the land to develop the course, and these people would buy all the bonds that would be issued in connection with that. Now the advantage to them, as land developers, would be to sell the surrounding lands as high class lots. The City woftld end up in theory with a municipal golf co without it costing anything. urse ® He stated that he did not have all the details, but the gentlemen asked him'to set up a meeting between them and the Commissioners. It was suggested that they meet at 8:00 P.M. tomorrow night, Tuesday, May 23 . City Attorney Walden stated that a few meetings ago, by motion, the 0 City authorized Mr. Marrone to reduce his subdivision bond from $37,000 to $12,000 because he had put in everything except the sewer. The City by motion authorized that, and the bond has been reduced. His bonding company now is asking that the City adopt a resolution reduc- ing the amount of the bond from $37,200 to $12,230. ® A motion was made by Commissioner Brice that a resolution be adopted and passed reducing the amount of Mr. Marrone's bond from $37,200.00 to $12,230.00. The motion was seconded by Commissioner Adams, and the roll being called, the Commissioners voted as follows: Adams Yes ® Brice Yes Kelly Yes Waiters Yes Marant Yes City Attorney Walden presented a letter from Olson and Zednek, Attor- ® neys at Law, as follows: "Gentlemen: As attorneys for Dania Police Chief Montie Smith we herewith demand instanter reinstatement together with all ® back salary since October 6, 1966, of Montie F. Smith as Chief of Police based on the resolution of the City Commis- sion meeting held October 6, 1966, reading in part " . .If Chief Smith is found innocent of the charges he is to be reinstated with full pay" . We will appreciate your return mail remittance and ® advise that Police Chief Montie Smith has been reinstated. Yours very truly, /s/ Montague Rosenberg For the Firm 1' Mr. Walden suggested that the Commissioners turn this over to the S City Manager and himself; after which he will contact Mr. Rosenberg and see if there is some kind of a compromise. Mayor Marant asked at the time that this resolution was passed, was Montie Smith promised back pay from the time that he was relieved of duty until the time that the new commission took office? City Attorney Walden: stated that he didn't wish to go on record, but what he would do if Mr. Rosenberg is receptive, at a subsequent meet- ing he thought that he would recommend that they pay former Chief Smith his salary from the day of his suspension until the day that Chief Caracci was appointed. He stated that he felt this would be a reasonable compromise, and if the attorney wanted to go along with that suggestion, he (Walden) would come back later and make that suggestion. -7- me Commissioner Brice stated that he does not remember the exact wording; therefore he felt that this was a matter for the City Attorney to handle. He added that he made a statement to the City Manager a week ago that he thought the City should notify Pormer Chief of Police, and advise him to come to the City Hall m and sign the necessary papers as far as his pension.and so forth, and go ahead and authorize the payment from the time that he was suspended until he was replaced. He stated that the Charter gives the Commission the right, and that no department head's job extends beyond a new commission. "So therefore, the old commission could not commit us to any action beyond their time." City Attorney Walden stated that Mrs- 'Thornhill mentioned to him, and he has spoken to the City Manager about this, that if we are going to use the same auditors again this year, she would like to have them come in a little early to check the sewer account pri- marily to see that they are being set up properly. He stated that A Mr. Haliburton also should be asked to advise the City as to whether the various accounts comply withtthetterms of the bond resolution. Commissioner Brice stated that he would like to see the City retain the present auditing firm. He then suggested that they authorize the City Manager to get an estimate of what the cost will be, and !P then present it to the commission. In the meantime, he suggested that they continue with the same firm. Mr. Brice further stated that it will cost more than last year, because of the sewers being added this year. City Clerk Thornhill stated that the work has almost doubled as far 0 as the bookkeeping is concerned. City Attorney Walden stated that what they ought to do, since the bookkeeper spends 50% of her time on the sewers; thdn 50% of her Pay ought to come out of the sewer fund. City Clerk Thornhill pointed out that we do not have a sewer opera- ting fund. "That is something that will have to be gone over with with the trustees at the Dania Bank." City Attorney Walden suggested that they ought to get Mr. Haliburton, and Harvey Henann in along with'.the auditor. City Clerk Thornhill: As you know, the sewer assessment money cannot be used in the operation, because that is allocated for the retire- ment of the bonds. And a portion of the money for the sewer service charges will go to the operating fund, but they have not decided what percentage or anything else. "There is a lot to be done." Commissioner Brice stated that the way it is set up, the monthly charge for he thought the first three years is supposed to go 100% to the operation. He asked her to check that out, but he was quite sure he was right. "It is all spelled out in that Engineering report." City Clerk Thornhill: Well, of course, the Engineering report and the trust agreement are two different things. Commissioner Brice: Well I know, but apparently the trust agreement was dravm up from the engineering report. City Clerk Thornhill: Now we have not had very much money come in from sewer service charges, as you know. And this has all been paid to the trust department, and they have invested the money. But until such time as an operating fund is set up, this is still being invested. City Manager Goldberg: I would recommend then, Mr. Mayor and Commis- sion, that Mary get in touch with Mr. Haliburton and Mr. Henann, and I believe the fellows name was Ed who had worked here. . . . -8- City Clerk Thornhill: I would talk to Mr. Freeman, because Mr. Preeman is the one with the firm. Mrs. Thornhill stated that she would rather talk to Mr. Freeman, because he is the one that the Commission will hold responsible. Bill Carney stated that he did not think this needed Commission action, but the City Manager asked the City Engineer and himself to check out a lateral at Stuart's Garage. He stated that either of the contractors who can raise the manholes is capable of extend- ing that line, and that manhole is low enough. So it is just a ® matter of laying 25 feet of pipe and a "Y". He can be authorized to go ahead and have that done under a separate billing, but we can get it done while the road i:s. . .. Commissioner Brice: He has authority to do that, Mr. Carney, under missing laterals, because there should have been two laterals put in ® there to start with. Bill Carney: Well, the engineer said that they didn't need it now, and the city can put it in later. Commissioner Brice: Sure, that's What the Engineer said, but our contract with M B said that they were to serve every plat and parcel. Bill Carney: Well, the same man can do it while he is down there working. Commissioner Waiters stated that he was talking to a fellow today, i from the Hotel & Restaurant Commission, about Pirates World; and they are very upset about this grease trap that they were supposed to comply with. He stated that they would not issue a permit until this has been met. Commissioner Waiters stated that if he had known this, he would not have voted to give them a temporary Certificate of Occupancy. He added that they want to see Pirates World come up ® With all of the things they have asked them to comply with before they issue a certificate. Secondly, they want to see if Dania will work with them in trying to get this thing worked out. Mayor Marant stated that Mr. Robertson said that they do not need it because they are not washing pots and pans, but the health department O says put it in anyway. Commissioner Brice stated that this is strictly between the County Health Department and the Pirates World, and he did not see why the City should enter into it."for this reason, we didn't require that. That wasn't one of our stipulations, as far as we were concerned. Our people didn't feel that the grease traps were necessary for our sewer system, or Mr. Carney would have insisted that they be installed as such. Now they are using all plastic and paper plates; and he-Pelt this should not involve the City. Commissioner Waiters stated that the County though sets the standards r and the City must comply with those standards. He asked Mr. Walden if the City can be sued by the County. City Attorney Walden stated no, that he thought the County Health Department on its own has got the right to do what they want against Pirates World. If the City does not want to co-operate, then the 0 Health Department on its own has got to go out there and stop the operation. Commissioner Waiters asked what if we issue a license to them though. City Attorney Walden stated that they would be independant of each 0 other. "In other words, Pirates World has got to satisfy the City, and independantly the State Health Department." -9= i9 0 -_STD Mayor Marant: They still haven't a Certificate of Occupancy from the City. They are still on a temporary basis, aren't they? Commissioner Brice: Yes. But what they are actually saying is not the Certificate of Occupancy, but they are asking that we withhold the licenses out there. Do you want to lose that much money? I don't, because I don't actually think. . . . .Clarke, What would be our situation out there? City Attorney Walden: Well, the City is not actually set up a rule on health matters. . . . Commissioner Brice: And if we withhold the license, we are actually taking over an operation, or the policing operation for the Health Department. And I don't think we should become involved in that. A Commissioner Waiters stated that he would hate to see the City of Dania going against the wishes of these other agencies. He asked how they are going to go about it. Mayor Marant suggested that they ask them (Pirates World) to do what the County asks. • Commissioner Waiters asked what about the license. Are we going to issue the licenses before we ask this, or after we ask this. Mayor Marant stated that he didn't see how we could not. Commissioner Brice stated that he thought we should issue those licenses. City Attorney Walden stated that they (Commissioners) have sort of committed themselves to let them go ahead. O Commissioner Waiters stated that they are putting the Inspector on a spot too. Commissioner Kelly asked Mr. Carney if they navel:met the sewer re- quirements. 6 Bill Carney stated that they sf111 have to trace down that "so-called leak" . Commissioner Brice asked: Have you determined that there is a leak? Bill Carney: We dug ourselves, City forces, where we had the water 0 coming up out of the ground. But of course, as you all know, it could leak 60 feet either way and bubble up. And I didn't think that we should go ahead and dig it up, so he has been notified, and he said he would get to it and have it dug up. Commissioner Brice stated that Davis & Craven has given the City a • certification that that had been pressure tested, so it will go back on Davis 6 Craven. We have the certification on file. Bill Carney. It was supposed to have been broken, remember? Commissioner Brice; Yes, but he said it was retested. Bill Carney: At that meeting that we held, they said it would be re- tested and certified to. Commissioner Brice: And they did. And the letter is on. . .we have re- ceived it. Bill Carney: And every week we can go down there, and that water will be seeping up through the ground.
