MINUTES OF SPECIAL MEETING, CITY COMMISSION, CITY OF DANIA,
FLORIDA, HELD FEBRUARY 22, 1967,
The City Commission of the City of Dania, Florida, met in
Special Session in the Commission Room at the City Hall.

The meeting was called to order at 5:40 P.M. by Mayor Natant.
City Attorney Walden read an ordinance entitled:
AN ORDINANCE prohibiting the pumping of contents of septic
® tanks into the municipal sanitary sewer system, and pro-
hibiting private property owners from opening manhole covers
i connecting into the municipal sanitary sewer system, and
making it unlawful for any person to violate this ordin-
ance, and providing that the penalty for any violation
shall be as set forth in Sec. 1-6 Code of Ordinances,
City of Dania, and providing that by unanimous consent
of all Commissioners present on the introduction of the
ordinance and reading of the ordinance on first reading,
second reading, and third reading at the meeting of the
City Commission held on February 22, 1967.
® City Attorney Walden read the ordinance in its entirety on first
reading, and by title only the second and third times.
A motion was made by Commissioner Adams to pass the ordinance on
all three readings. The motion was seconded by Commissioner Kelly,
and the roll being called, the Commissioners voted as follows:

City Attorney Walden stated that when they adopted the ordinance
quite a few months ago stating who could do the sewer connection
work, the ordinance simply said Plumbing Contractors, Engineering
Contractors, and General Contractors. He advised that the Plumbing
Contractors in town must take a Plumbing Examination, and also the
® General Contractors must take an examination. HoOever, with Engine-
ering Contractors, anyone can get that license simply by paying the
fee. It is felt that some restriction should be placed on that. He
stated that he has an ordinance to present that says that Plumbing
Contractors can make the hook ups, and also Engineering contractors
can if they can show by affidavit that they have been engaged pri-
marily in sewer work for the last 10 years, and that they have with-
in the last 5 years actually contracted for sewer installations.
He stated that he has eliminated the category of General Contractors.
He further stated that there has been some question about letting
property owners handle their own hook-ups. He stated that the old
ordinance simply requires the owner to take out the permit in his
name, and then hire someone who may not have the qualifications to
do the work. He stated that this ordinance tightens it up a bit by

'< saying that if the owner takes out the contract in his own name
he must do his own work, and he physically has to do the work and
" be there at all times .
City Attorney Walden read the ordinance entitled:

Dania, Florida, with the subject of the amendment concern-
ing the contractors and other persons who may connect lat-
eral lines across private properties to sanitary sewer

system, City of Dania, and providing that it shall be un-
lawful for any person to violate this ordinance, and pro-
viding a penalty, and providing that by unanimous consent
of all Commissioners present for the introduction of the
ordinance, and the reading of the ordinance on first read-
ing, second reading, third reading at the meeting of the
City Commission held February 22, 1967.
City Attorney Walden read the ordinance in its entirety the first
time, and by title only the second and third times.
0 A motion was made by Commissioner Brice that the ordinance be passed
t on all three readings. The motion was seconded by Commissioner:

Bill Brooks stated that this is going to put an awful hardship on
a lot of people. He stated that he has intentions of getting an
® Engineering license to do some of this work, and he has the
equipment to do it. lie stated that he also wants to do his own
work but he has men to run his equipment. He objected very strongly
to the adoption of this ordinance.
Commissioner Kelly stated that the only question he has is that
® he felt that the owner ought to be able to hire a Journeyman
Plumber. "If I put in my own lateral, I am sure there. will be a
whole lot better job if I hire a Journeyman Pluinber than' if I try
to do the job myself. According to law, I can do it myself and do
a botched up job, but I can't go out and hire somebody that would
be qualified." He stated that the ordinance they have now states
that if the connection is not approved on the first inspection of
the City of Dania, the City may charge another $5.00 for each addi-
tional inspection required .
Commissioner Brice stated that if the owner is there at all times
supervising the job he would not be too concerned about it, but
® he should be present if he is going to do his own work. He stated
that there are some retired people in town who are not physically
able to do the work. They wont be doing the work themselves, but
they ought to supervise the work.
Commissioner Kelly stated that he felt that the Building Inspector
® has the power to make a man uncover the line if he has come to inspect
it and it is covered up; also, he could charge him an extra $5 .00
every time he has to come back to inspect it.
City Attorney Walden stated that he was told by the head of the
Central Examining Board that in the county only plumbers can connect
y€, to the sanitary sewers.
34-11 Brooks suggested that other people should be allowed to lay the
sewer lines, but have a qualified plumber do the actual connections.
Commissioner Brice suggested that they change the wording to state
�i that an Engineering Contractor who holds a county license for sewer
work, or passes an examination. He suggested that perhaps the county
c(, iLl oxamine the applicants.

Building Inspector Wells stated that he asked if they could examine
a group from Dania, and he said that it would be possible.
Commissioner Brice stated that we could pay the expense, but it
® would be a lot cheaper than trying to examine them ourselves .
City Attorney Walden stated that, as he understood it, there was
no such thing as a Sewer contractor in the county; the only ones who
are licensed in the county to do sewer work are the plumbers . He
asked Building Inspector Wells if this is what he understood.
Building Inspector Wells stated that; as he understood this Engineer-
ing, it is a license similar to the one that Mears (M B Construction
Company) had. It allows you to do public work in streets and right
of ways , and that sort'. of thing.
® City Attorney Walden asked if Mears is qualified under the County
Zoning Ordinances to hook up sewers to private homes out in the County,
or is Charlie McDaniels?
Building Inspector Wells: No sir. But they have let them do that
in cases. I understand. But it has been a legal battle, as I was told.
® This is all information that I have received, that the plumbers claim
that is their business to run clear through the property line. And I
guess they relented and let them do it in emergency cases. But they
still maintain that that is their job to go all the way out to the main
sewer.
® City Manager Goldberg: I think the difference here is the license the
County uses, as I gather from what Armand just said, is a license to
install sewers in the public rights of way, which is a separate sewer
license. Is that right Armand?
Mr. Wells: Yes sir, that is the principal for the Engineering License,
® for sanitary sewers.
City Attorney Walden: What does a street contractor or paving contrac-
tor get in the county?
Mr. Wells: That is another type, it is a different catagory. It is
an Engineering License, but it is restricted to street paving and so
on. They have different catagories, 7 or 8 different catagories.
And there is an examination board for each one.
Commissioner Kelly asked if a home owner took out a permit and he had
to be present at all times, and if the inspector came and found out
that someone else was doing it, would this suffice.
Commissioner Brice stated that it is exactly like if he came up to take
out a building permit to do his own work. If Mr. Wells comes by and he
has a carpenter helping him do this, and he is not there, as the man who
took the permit out, he (Wells) had the perfect right to stop him. Be-
cause I am the man who took out the permit. He stated that in some
cases the job may be too big for one man, in which case he may get a
Journeyman Plumber to help him. But he (home owner) has to be present.
City Attorney Walden stated that he understands now what they want, but
he would like to rewrite the ordinance and present it to the Commission;
because he did not think they shotQd pass it without it being written
out, because they may want to make some change.
City Manager Goldberg suggested the following amendments: In place of
where it says that the owner shall do the work himself, amending that
to say that the owner shall supervise the work at all times. The se-
cond amendment be adding a third group who would be eligible to do this
work, and that being a group who would pass a sewer engineering exam-

Commissioner Brice withdrew his motion to pass the ordinance on
all three readings . Commissioner Adams withdrew his second to
the motion. '
® It was suggested that they have a special meeting tomorrow night
at 5: 00 to present this revised ordinance.
A motion was made by Commissioner Brice to table this until 5:00
P.M. Thursday, February 23 , 1967. The motion was seconded by
Commissioner Kelly, and the roll being called, the Commissioners
® voted as follows:

Commissioner Kelly asked if we couldn't have some instructions
mimeographed for the home owners when they come in to pick up a
permit. These instructions should state that he is to be on the
job at all times, that there is a provision in the ordinances that
• he is to pay a $5 .00 for each inspection, telling him how much fall
he needs in laying the pipe, etc.
Building Inspector Wells stated that we could have it made up.
Mayor Marant agreed that this should be done. That way there would
A be no ,question as to what is required.
City Manager Goldberg asked supposing the building inspector finds
that the owner comes up to take out the permit, and then a journeyman,
or some other person not qualified under the terms of this ordinance,
is doing the work without the owner being present. Who does he (the
® building inspector) arrest:
City Attorney Walden: Both of them.
Commissioner Kelly suggested that these instructions to the home owners
should also include the information that they are liable to $500.00
® fine or arrest or both.
City Manager Goldberg asked the Commission to amend the request that
he made at the last meeting, in regards to the recreation tennis
courts and basketball courts. He asked permission to advertise for
not only Frost Park, as he mentioned at the last meeting, but also for
® West Side Park. And also, to advertise this in the alternative, either
one price being the black sealer for all the courts; and the second
price being the black sealer on the basketball and handball courts,
and the color sealer on tennis courts; also a price on lining the courts.
A motion was made by Commissioner Brice that the City Manager be
allowed to advertise under his suggested conditions to include living
of courts. The motion was seconded by Commissioner Kelly, and the
roll being called, the Commissioners voted as follows:

City Manager Goldberg stated that, in regards to the Old Bank Build-
ing roof, the Mayor said they would take up the awarding of the bid
after contacting the low bidder on the amount he would charge for a
15 year bonded roof.

Building Inspector Wells reported that the next morning after the
Commission meeting, he contacted Mr. Glover and told him what the
commission wanted was a price for a 15 year guarantee. And he said
he would have it here. He didn't show up.
Commissioner Brice stated that in view of this he would like to make
a motion that they award it to the second highest bidder with the 15
year bonded roof, which he quoted at the time it came in. He stated
that it was asked for when it was advertised.
A motion was made by Commissioner Brice to authorize the City Man-
ager' to award the contract, on:a 15 year bonded roof, to the second
highest bidder.
Commissioner Waiters asked if they would give him until tomorrow
morning to come up with the 15 year bond, because he contacted Mr.
Glover and he (Glover) promised to have the bid in.
The motion was seconded by Commissioner Adams, and the roll being
called, the Commissioners voted as follows:
