HomeMy WebLinkAbout31153 - MINUTES - City Commission MINUTES OF SPECIAL MEETING, CITY COMMISSION, CITY OF DANIA, FLORIDA HELD NOVEMBER 2, 1966. ® The City Commission of the City of Dania, Florida met in Special Session in the Commission Room at the City Hall. PRESENT WERE: MAYOR COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS BRICE ® FRANK SALVINO S. ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN CITY MANAGER STANLEY GOLDBERG ACTING CHIEF OF POLICE WILLIAM C. JONES ® CITY CLERK 19ARY THORNHILL Meeting called to order at 9:30 A . A. EST by Mayor Adams . City Manager Goldberg advised the Commission that he had received a letter from the Attorney representing the Peerless Insurance Company, . addressed to Clarke Walden, City Attorney. Peerless Insurance Company is surety on the Performance and Payment Bond given to the City of Dania on contract with M B Construction Company. City Manager Goldberg read the letter outlining work to be completed as reported to the Bonding Company by their engineers, Davis & Craven, ® Inc. , giving a completion date of December 31, 1966 of the sewer system and possibly another 30 days to complete the alleys and other clean-up work . City Manager Goldberg read a letter from Philpott, Ross & Saarinen, Inc., engineers for the City of Dania, that it is possible to complete the job by January 1, 1967 if proper personnel is employed. Mayor Adams asked Mr. Boyd, Attorney, representing Peerless Insurance Company, if the City could be assured that they were going to have proper personnel to finish the job in the time specified? Mr. Boyd stated that insofar as they are available, we do not antici- pate any difficulty. However, it is possible we may not be able to get competent personnel to keep full crews going on this job. Commissioner Zenobia asked Mr. Farina, Engineer, with Davis & Craven, if this was a very tight schedule or does everything have to click ® in order to complete the job at the time specified? Mr. Farina stated that they had definitely left some leeway. They made what they feel is a reasonable estimate based on available personnel and equipment. 6 Commissioner Salvino asked Mr. Barry, Engineer, with Philpott, Ross & Saarinen, Inc. , if at the last meeting he made the statement that the job was not done according to specifications? Do you feel if the job had been done right in the beginning it would be finished now? Mr. Barry stated that he did not say the job-- but that areas of the iob that had not crone in according to specifications. He did not reel qualified to make a statement as to what might have happened a year ago . Attorney Walden stated that he thought the issue was .whether you could do better elsewhere and evidently you cannot, so it appears that no action should be taken on the report, just file it for record. -1- r SIM City Manager Goldberg stated that he thought the City Engineers and the Bonding Company Engineers were aware of the situation and that they would report immediately to the City of any change in this work schedule. If the City Commission accepts this report he would hope that they in turn would require a report in say a week saying the job was either on schedule or whatever the status is. That he presumed from what Mr. Boyd has said the Bonding Company has made Payment to whatever personnel is needed on the job. Attorney Walden stated that he thought one thing wes material, and that was -- is the contractor cooperating with Mr. Craven's firm. There is no point in having these meetings if there is a lack of communication with the engineers and contractor. We have not heard that the contractor is not cooperating, so we have to presume he is . Mr. Boyd advised that the contractor was cooperating with them and the engineers . And if at any time it is any different they will re- port to the commission. Attorney Walden asked if the City engineers were giving orders to Craven, and then Craven in turn giving orders to the contractor? Mr. Boyd stated that was correct. They have prepared a punch list through the cooperation of Mr. Barry and Mr. Craven, and this is the list being used to carry out the projected time schedule. As each aspect is completed it will be checked off the list. S Attorney Walden stated that he thought the City should check with Mr. Boyd about every two weeks to see if this work schedule is proper. Mr. Boyd stated that he would be in touch with the job each day, and if at any time it appears that we are running into any unforseen dif- ficulties we will let you know immediately. Commissioner Brice asked Mr. Boyd if his company can assure us that they will keep enough people on this job to complete it in the time allotted . Mr. Boyd stated that from time to time it is difficult to get the proper personnel. But, insofar as they are available on the local labor market, they will be employed. Mr. Robert Houston asked Attorney Walden if this extension given the contractor would in any way jeopardize the penalty under the con- tract? 40 Attorney Walden advised that the City was not giving any formal ex= tension to the contractor. Before this is over he felt sure the City would be involved in litigation. Mr. Robert Houston asked what was going to be done about the junk 4 pile along the railroad. It had been there for two years and he did not see any need for a delay in getting it 'cleaned up. It does not take any experienced personnel to clean that up. It is very close to the tourist season and I think we all want to see our city cleaned Lip . There are a lot of eyesores around the City made by this con- tractor. Mr. Farina advised that the Would attempt to cleanup these conditions as soon as possible. -2- t + s ` BREHM r� Mr. Robert Houston asked if anything had been done about extending ; the sewer in Dixie Highway to serve the new filling station on the corner: That it should be done before the street is paved. He un- derstood the contract had been let for the paving. City Manager Goldberg advised that he had a report from the engineers and he would meet with them and the city attorney and see what can be worked out. Mr. Barry, Engineer, stated that in the past whenever it was necessary to make an extension of the system that was not on the original plan �g :Aat it was necessary to have a change order.. Does this still hold true? jN--" Attorney Walden advised it would have to be done through a change r order. The engineer will have to be given some authority to start on Che preparation of the change order. Mr. Philpott is still the City Engineer. 44 Commissioner Brice suggested that Mr. Barry make a field survey and meet with the City Manager and work out something from that. After all, Philpott, Ross & Saarinen is still the City Engineers . If M B Construction wants to do the work alright, if they do not we can get some one else. The work should be done before the road is paved by the State Road Department. ® A motion was made by Commissioner Zenobia that Philpott, Ross & Saarinen, Inc. be authorized to draw plans and specifications for extension of the sanitary sewer line in Old Dixie Highway to take care of the Atlantic Service Station at the intersection of Dixie Highway and US 1; motion seconded by Commissioner Young, and the roll being called, Commissioners voted as follows: ® Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes 0 Attorney Walden presented an application for first reading for a beer and wine license for Irene Newton, 402 Phippen Road. She was at the last meeting and asked about her license but the Acting Chief had not approved it at that time. He application has been approved by the State and the license will be returned to Tallahassee on November B 0 if she does not pick it up. If it is approved on first reading today, it can be approved on final reading at the meeting on November 7. Amotion was made by Commissioner Zenobia that the application be ap- proved on first reading; motion seconded by Commissioner Salvino, and the roll being called, Commissioners voted as follows: Brice Yes Salvino Yes 'r Young Yes Zenobia Yes Adams Yes Commissioner Young, Chairman of the Finance Committee, reported that tl)e Committee had met recently with the Pension Committee and he felt the balance due the Provident Life Insurance Company, the company 3 rhat handles the City' s Pension Fund should be paid. -3- s 9 ;v a• •'� .I - � S !sl ' Commissioner Zenobia asked Commissioner Young if this meant we would be taking this plan for the balance of the year? V: 1 u ; Commissioner Young stated that at the present time it would have to be paid, and any changes would have to come later. Commissioner Brice stated that what it actually amounted to is --- y it is on an annual basis and if there is any change or revision in the plan we will receive credit on the premium paid. We either have `=n to pay the premium or drop the plan . They have assured us verbally, we do not have it in writing yet, that we will only have to pay the premium for the time the plan is in effect, if at any time the plan is dropped or revised. tl's A motion was made b Commissioner Young that the bill for 22 500 Y g $ e due Provident Life Insurance for the Pension Plan due October 1, 1966 be approved for payment; motion seconded by Commissioner Brice, "i and the roll being called, Commissioners voted: c Brice Yes Salvino Yes Young Yes Zenobia Yes for paying the bill, but not approval of the plan. Adams Yes Commissioner Brice stated that he would like to make a motion that all special assignments in the Police Department be directed to the City Manager by the Acting Chief for his approval before they are made until such time a new Chief is appointed. Our police depart- ment in the past couple of weeks has got into a jumble and the A citizens are up in arms over it; motion seconded by Commissioner Salvino. Commissioner Brice stated that under the Charter, the City Manager is theoretically the Acting Chief, This in no way is going to hamper the Acting Police Chief other than he consults the City Manager before the assignments or changes are made. That is the way all departments should work. It is just a matter of everybody being on the same wave length. EST by Mayor Adams for the purpose of canvassing the vote of the General Election held in the City of Dania, Florida on November 1, 1966, for the purpose of elect- ing City Commissioners .
