® The City Commission of the City of Dania, Florida met in Special
Session in the Commission Room at the City Hall.

Meeting called to order at 8:00 o'clock P. M. EST by Mayor Adams .
�.' Invocation by Rev. 0. H. Hudgins of the Dania Methodist Church.
Mayor Adams stated that before proceeding with the regular agenda
c? ' ® the City Attorney would like to bring up something concerning the
Ewa sewer project.
rR Attorney Walden read a letter addressed to the Commission, written
by him outlining his views on the sewer project and its completion.
(A copy of this letter is attached to and made a part of the minutes
® of this meeting. )
Attorney Walden read a resolution entitled, " A RESOLUTION AUTHORIZING
THAT PRELIMINARY STEPS BE TAKEN BY THE CITY MANAGER, IN ACCORDANCE WITH
THE PARAGRAPH ENTITLED" OWNER'S RIGHT TO TERMINATE CONTRACT", BEGINNING
ON PAGE GC-4 OF CONTRACT DATED JANUARY 22, 19651 BETWEEN CITY OF DANIA,
FLORIDA AND R. J. MEARS AND C. E. LOY, CO-PARTNERS, DOING BUSINESS AS
Pf B CONSTRUCTION COMPANY, FOR THE PURPOSE OF TERMINATING SAID CONTRACT
IN ACCORDANCE WITH SAID PARAGRAPH IF SAID R. J. MEARS AND C. E. LOY,
CO-PARTNERS, DOING BUSINESS AS M. B. CONSTRUCTION COMPANY, SHALL NOT,
WITHIN TEN CALENDER DAYS FROM NOTICE FROM THE CITY, TAKE SUCH MEASURES
AS WILL, INSURE SATISFACTORY PERFORMANCE, CONSTRUCTION AND COMPLETION
OF SAID CONTRACT; AND PROVIDING FOR THE MEASURES WHICH WILL BE SATIS-
FACTORY TO THC CITY TO INSURE THE SATISFACTORY PERFORMANCE, CONSTRUCTION
AND COMPLETION OF SAID CONTRACT; AND REPEALING ALL RESOLUTIONS IN CONFLICT

Attorney Walden: If you see fit to pass this resolution, I would like
to advise you that in the discussion I had with Mr. Boyd, representative
of the Bonding Company, he assured me that the company realizes its
obligations under its bond. He further assured me it is the desire of
the Bonding Company to cooperate with the city and that they do not in-
tend to do anything to delay the contractor in finishing the job. I feel
free in saying that shortly after we notified the Bonding Company of the
progress of the construction, the Company employed Mr. Craven, of the
firm of Davis & Craven, to look into the contract. They have all the
available data and they know what to do. There should not be any delay
I f Sou decide finally to ask Mr. Mears to get off the job.
j•`. Ai interpret the contract, you have to give him 10 days notice, which
what this resolution authorizes. If within 10 days he does not com-
r;. 1)2,t;, the contract or in some way satisfy you that he can do it, then
ilave the right to ask him to get off the job. While the contract
ioc:icates it is necessary to rebid the job, the Bonding Company indi-
they would take over and employ another contractor to finish the

I think that if within the 10 day period Mr. Mears in some fashion
can convince you of his ability and willii.gness to complete the job,
it may well be you may want him to stay. If you do that-- as I
understand it, the Bonding Company is willing to help in every way
possible if he gives them his cooperation.
I would further like to state that Mr. Mears filed a suit recently
against certain of the City employees, and that his attorney, a Mr.
Bennett from Winter Haven, came down today for a meeting with Mr.
® Boyd and myself. Mr. Boyd was tied up in West Palm Beach and did
not get here until 7: 30 this evening; therefore, we did not have a
meeting .
Mr. Boyd is from the firm of Blackwell, Walker F, Gray, Attorneys,
representing Peerless Insurance Company, the surety on the completion
bond, and he will answer any questions you might have concerning
this project.
Commissioner Young asked Mr. Boyd what he had to report on the work.
Mr. Boyd stated that all he could say was that he was representing
® Peerless Insurance Company and that they had employed the firm of Davis
6 Craven, Engineers, to make a preliminary inspection of the premises
to determine the exact status of the construction and pending the out-
come of the resolution. That he was certain Peerless recognized their
obligations under the bond. If a default is declared they will then
be in a position to take such steps that are necessary to complete
the job.
Attorney Walden recommended that the Commission seriously think about
doing something now. Very shortly you are going to be in trouble on
the revenue bonds . That he thought some immediate action should be
taken so that no great problem will arise.
® Attorney Walden: I want to go on record advising You of all these
things . I am not trying to tell you what to do, I am not an engineer.
I think your recommendations to do something should be based on what
your daily reports tell you they seem to speak for themselves, or on
any recommendation the engineer might make, or any recommendation the
® city manager might make. I understand the city manager had some con-
vzrsation with the engineer today, he might make a report to you on
e:hat the engineer thinks about the job. I am not making any engineer-
ing recommendation, all I can do is tell you what the contract says
you can do .
City Manager Goldberg stated that the engineers say their daily reports
speak for themselves .
Commissioner Brice stated that he felt this commission had bent over
backwards throughout the entire time, they have followed the recom-
mendations of the engineers and tried to work with Mr. Mears. He
has shown absolute disregard for any cooperate effort as far as the
City is concerned and he thought we needed to go ahead and pass the
rc-solution giving him 10 days notice.

ORDINANCE: Levying a tax upon admissions sold by any
permanent outdoor recreational park licen-
see
who is licensed to operate within the
corporate limits of the City of Dania.
(Third Reading)
City Attorney Walden read the ordinance entitled:
AN ORDINANCE levying a tax upon admission tickets sold by
any permanent outdoor recreational park licensee who is
sf licensed to operate within the corporate limits of the
® City of Dania, Florida; fixing the amount of said tax,
and imposing upon said licensee the burden of adding said
tax to the cost of each and every admission ticket sold,'
and of collecting same; and authorizing the Mayor-•CoTinis-
sioner, City Manager and City Clerk-Auditor of the City of
Dania, Florida, to enter into agreembnts with any perman-
ent outdoor recreational park licensee, consistent with the
terms of this ordinance, concerning the levying and collec-
tion of such taxes; and providing that all ordinances or
parts of ordinances in conflict herewith be repealed to the
extent of such conflict; and providing that the ordinance
shall become effective as of its passage and adoption on
third reading.
A motion was made by Commissioner Zenobia to pass the ordinance
on third and final reading. The motion was seconded by Commis-
sioner Young, and the roll being called, the Commissioners voted
as follows:

ORDINANCE: Approving the plat of College Center.
(Third Reading)
City Attorney Walden read the ordinance entitled:
® AN ORDINANCE approving the plat of College Center, same being
a subdivision of the S 151.50 feet of the S* of the NEB of
the N44 of the NW' of Section 3, Township 51 South, Range 42
East, lying vkest of South Phippen Road, less that part in-
cluded in the plat of College Tract Second Addition, as re-
corded in plat book 19, page 19 of the public records of
® Broe:ard County, together with a parcel shown as "Reserved B",
of block 12, of said College Tract Second Addition and re-
pealing all ordinances and parts of ordinances in conflict
herewith and providing that this ordinance shall be in force
and effect immediately upon its final passage and adoption.
® A motion was made by Commissioner Brice to pass the ordinance on
third and final reading. The motion was seconded by Commissioner
Salvino, and the roll being called, the Commissioners voted as

OPTIMIST CLUB: Request for permission to hold a "Kidis_ Day"
November 18, 1966.

Richard Marant was present representing the Optimist Club. He
requested permission to hold a "circus type of affair" on Novem-
ber 18, on a Friday. He stated that there will be no gambling
of any type, only rides and refreshment booths.
Commissioner Brice asked if they will be required to have insurance.
City Attorney Walden replied that that would be one of the require-
ments of the contract.
® Commissioner Young stated that in the past it has been customary for
operations of this type to put :up a $50.00 clean up bond.
It was asked where they would hold this circus. Mr. Marant asked
if they would give approval contingent upon selection of a site. He
stated that he would see what he could find, and then let the City
Manager know what site they have found.
A motion was made by Commissioner Zenobia to allow the Optimist Club
to hold this "Kid's,•Day" on November 18, with the understanding that
they will furnish the Certificate of Insurance, and that all fees
will be waived by the City. ':The motion was seconded by Commissioner
Salvino.
Commissioner Young asked how about the clean up bond.
Mr. Marant stated that he would post that bond.

CITY MANAGER'S REPORT:
City Manager Goldberg stated that some time ago they received bids
in regards to the paving of N.W. loth Avenue. Those bids were
® tabled, because at that time they only had half of the right-ef-
way, and they were considering a subdivision in the area from which
they hoped to get the other half. He then recommended that they
now award the paving bids to DiMar Paving Company on the recommen-
dation of the City Consulting Engineers for the bid price of $1.96
per square yard.
A motion was made by Commissioner Brice that they accept this bid,
contingent upon receipt of the right of way deed. The motion was
seconded by Commissioner Young, and the roll being called, the
Commissioners voted as follows:

- City Manager Goldberg presented a request for authorization to adver-
tise for the painting and repair of the Water Tower. The specifica-
tions have been prepared.
Commissioner Brice stated that he talked to Alvie Peters about this
and Mr. Peters informed him that this project was supposed to be done
last year, but there was no money put in the budget for it.

A motion was made by Commissioner Brice to advertise for bids to
be received November 7, 1966) at 8:30 P.M. The motion was seconded
by Commissioner Zenobia, and the roll being called, the Commissioners

City Manager Goldberg submitted a report on the proposed Boat Dock
and facilities at the Dania Beach. He suggested that they refer it
to the Parks & Recreation Committee for their consideration and to
report back to the Commission. He asked if this required a motion.
City Attorney Walden replied that it did not.
City Manager Goldberg requested permission to have the Engineers
draw plans for the paving and enlarging of the parking area at.:the
beach, and the paving of the right-of-way strip along the seawall.
These plans should be prepared and let out for bids as soon as they
are prepared, subject to clearance by the City Legal Department, for
® both paving and parking meters.
A motion was made by Commissioner Brice to instruct the City Manager
to proceed with specifications for the paving and for the installing
of parking meters in the parking area at the beach. The motion was
seconded by Commissioner Salvino.
Commissioner Zenobia asked if we got the right of way there.
City Attorney Walden advised that they really shouldn't do anything
until they get that right of way.
City Manager Goldberg replied that he was requesting permission to
go ahead with it, if they get clearance.
City Attorney Walden stated that he will make a written report to the
Commission as to what they do or don't have there. He didn't know
at present just what they do have. He would investigate and bring
® back a report at the next meeting.
Commissioner Brice withdrew his motion. Commissioner Salvino with-
drew his second.
Bob Houston objected to the city putting in more parking meters. He
stated that what they need is more free parking area there. He also
stated that they should get at the County or State or whoever it was
that tore up the parking area by the Marinarium, and get them to re-
place it.
Commissioner Brice stated that they have been in contact with the
0 County over that area, and at one time they had the assurance that
they were going to go ahead and pave it. So far, we have not been
able to get them to move up to it, but we haventt given up on it.
Bob Houston suggested that someone go before the County Commission
tomorrow morning and make that request..
City !danager Goldberg reported that we received several letters from
some of our present insurance carriers and other insurance agents in —
regards to some proposals that they have to make to the Commission
and to the finance committee, the Pension Committee; and other,i
insurance agents in the City have requested an opportunity to be
4Fr considered for city insurance. He suggested that this matter be
referred to the Finance Committee, and whoever else they might want in
ot. the discussion with the various agents in the city. He suggested

that vhis be done very soon "because some of these insurance renewals
arc due in this month" . He recommended that this be referred to the
Finance Committee to report on at the next meeting.
City Manager Goldberg presented a request from Jerry Glick to move
the Rental Car business across the street to 1702 N. Federal Highway.
He stated that approval was originally granted in 1963 for the pre-
sent location.
Mr. Glick was present and informed the Commission of his plans. He
stated that he wants to fix up the property a little more presentable.
He also intends to pave the entire area that he is going to use. He
intends to enclose it with a fence, dnd also repair and beautify the
building. He stated that everything that is going to be done will
meet with the Building Inspector's approval'.
A motion was made by Commissioner Brice to grant permission to move
® the operation with the understanding that they are not necessarily
at this time approving the building. The motion was seconded by
Commissioner Zenobia.
Commissioner Young stated that it is his understanding that something
like this should go to the Zoning Board.
Commissioner Brice stated that he agreed, but in his motion he stated
that they were merely giving him permission to move the building, "If
he can meet the building requirements, we have nothing against him
moving his operation" .

City Attorney Walden stated that when Mr. Glick presents his plans to
the Building Inspector, he may then have him go before the Zoning Board.
Bob Houston stated that at the last meeting they withheld issuing of
a building permit for Elmer Lish. Mr. Houston was requested to speak
for Mr. Lish. He stated that they tabled Mr. Lish's request in order
to try to get the necessary right of way from him. He stated that Mr.
Lish wants to get started with the building, and they will be working
a hardship on him if they don't authorize issuing of the building per-
mit tonight. It was psssed by the Zoning Board. He has his plans, he
0 has his land graded off, he is out of business in this building today.
So he is out of business until he can get a new building.
A motion was made by Commissioner Zenobia to approve the issuance of
a building permit. The motion was seconded by Commissioner Salvino,
and the roll being called, the Commissioners voted as follows:

City Manager Goldberg stated that some time ago the Commission.-:worked
with the City of Hollywood to share the cost of street lighting along
Sheridan Street. At that time the estimated cost was $3y600.00, and
the Commission on February 7, agreed to pay their share.of the $3,900.
However, the bids came in less, and they h_v. a bill from the
City of Hollywood, for Dania's share of the street lighting, material
and labor, from US#1 to 12th Avenue, $2,796.88. He requested a motion
for the City to pay its portion of the street lighting.

A motion was made by Commissioner Zenobia to pay the bill. The
motion was seconded by Commissioner Brice, and the roll being

® City Manager Goldberg stated that the Mayor has two proclamations,
one in regards to Fire Prevention, and the other:in regards to Fire
Safety. Mr. Howard Burgess, as chairman of the Fire Prevention
Committee, requests that they pass these proclamations.
A motion was made by Commissioner Salvino that the proclamations be
® signed by the Mayor. The motion was seconded by Commissioner Young,
and the roll being called, the Commissioners voted as follows:

Mayor Adams presented another proclamation for Tire Safety week,
October 9.
® A motion was made by Commissioner Brice that the proclamation be
signed by the Mayor. The motion was seconded by Commissioner Zenobia,

CITY ATTORNEY'S REPORT:
® City Attorney Walden stated that a few meetings ago the Commission%
asked him to meet with the local clergy to discuss the change in the
ordinance concerning alcoholic beverage sale in proximity to churches
and schools. He stated that the present ordinance calls for a dis-
tance of 300 feet. The Clergy suggested that they also add to churches
and schools any youth halls or Sunday schools, within,:1,000 feet ."as
the crow flies" not from main entrance to main entrance, but from pro-
perty line to property line.
Rev. Jennings was present and stated that he discussed this with vari-
ous other clergy in the City. He called the state office,in Miami and
found that the shortest line that the state allows is 2,500 feet. He
called the County, and they have 11500 feet distance as a pedestrian
travels. Fort Lauderdale has a 300 foot distance "as the crow flies" .
And Hollywood has a distance of 1,000 feet, as a pedestrian travels.
fie suggested that Dania make it 1,Q00 feet "as the crow flies" .
City Attorney Walden stated that this has to be done by ordinance to be
z passed on three readings. He suggested that he prepare the ordinance
and bring it back to the next meeting.
Commissioner Brice suggested that they add to it that any public re-
creation, such as Frost Park.
idr. DeMuzzio from the audience suggested that at times the Commission
sets a time for opening of bids, and also a time limit on speaking
for members of the audience. He suggested thattthey install a cloak
on the wall in the Commission Room.

Bob Houston again asked the Commission to take some action on
installing lights on Federal Highway, east side, from Sheridan
Street to Dixie Highway.
rl„ Commissioner Brice agreed and suggested that the City Manager get
y{@," Florida Power & Light Company to look at it.
Commissioner Brice reported that he called Mr. Davison of the State
} Road Department today in regards to the letting of the bids on the
F Dixie Highway for October 20th. He Davison didn't give him too much
' " ® assurance that this was going to come up on October 20th. He sug-
gested that, inasmuch as they have recently passed some emergency
measures to try to co-operate with the State Road Department, on
getting this highway widened and paved, he :recominended for the Com-
missioners consideration, that they instruct the City Manager to
write a letter to the State Road Department outlining the things
® that the City of Dania has passed and the things that they have done
in the past few months in trying to co-operate with.'them, and toa
ask for special consideration to be sure that this project is bid
on October 20th, and a copy of that to go to the County Commissioners.
"I think it is high time that we put a little pressure on them".
® Commissioner Young stated that he is in agreement.
Commissioner Salvino stated that when he came::back from vacation he
asked some questions about the tape recorder and tapes missing from
the City Hall. He stated that he received a threatening phone call
last night, and he has been accused of talking to people regarding
gambling and bolita. He then passed a .letter to the City Attorney
to read.
City Attorney Walden read as follows:
"This statement was taken from Richard Lees, dated September
30, 1966, and taken by Frank Salvino at 8:45 p.m.:
Question by Mr. Salvino: Did you ever see Sewer Bid tape
recordings from the City of Dania in any place other than
the Dania City Hall?
Answer by Mr. Lees: Yes, I have.
Question by Mr. Salvino: Where did you see them at?
Answer by Mr. Lees: At Chief Smith's apartment.
Question by Mr. Salvino: And how did you come about being
in Chief Smith's apartment?
Answer by Mr. Lees: I was working the midnight shift, if
my memory is right. It was Friday the 26th or Saturday,
the 27th, of August, 1966, when I received a radio message
6 from the desk Officer Yacks that I was to call a certain
number;that the Chief wanted me to call a certain number.
I went to a pay phone and called the Chief. He instructed
me that he was at Brownie's Bar and he wanted me to come down
to Brownie's Bar in Hollywood. I left the City of Dania with
the City Police car and went to Brownie's Bar. I met the
a Chief sitting with his girlfriend who I knew as Virginia.
The Chief himself was in a very intoxicating condition, highly
intoxicated. He gave me a set of keys and said that it was
Virginia's birthday, his girlfriend's birtrhddy, and she didn't
have any makeup on, and had left her makeup bag back in his
apartment. And he wanted me to go back to the apartment and
® get her makeup kit and bring it to him at the bar. At this
time he stated "Don't let anybody know about it, and don't be
seen by anybody" . I left and I went to his apartment in Holly-
Wood on A-1-A, in the area of Tally Ho apartments. When I went
into the apartment I didn't know where the makeup kit was, so
I checked the TV set. It wasn't on the TV set. I checked the
Couches, and just along side of the TV set, I looked and I :,c
noticed there were some little boxes, and on the boxes it said
Sewer Bid tapes. There was a recorder there also that said
Sewer Bid tape 11-23-64, 2-17-64, No. 1 and 7-20-64 that had

3. At this time I couldn't understand why these tapes were
in the Chief's apartment, and I immediately took the numbers
down.
-; Question by Mr. Salvino: Did you take these tapes out of
Montie Smith's apartment?
Answer by Lees: No, sir, I did not.
Question by Mr. Salvino: Did you report this to anybody else?
-' Answer by Mr. Lees: Yes, I did, I mentioned it to Mr. Frank
Pinter, the Grand Jury investigator, also Commissioner Brice, ,
Vice Mayor Brice.
Question by Mr. Salvino: Why did you mention these tapes to
these people?
Answer by Mr. Lees: Well, it was common knowledge that there
was some tapes missing from City Hall, and it just struck me
funny that they would be in the Chiefs apartment.
Question by Mr. Salvino: Was there also a tape recorder there
too?
Answer by Mr. Lees: Yes, there was.
Question by Mr. Salvino: Can you describe the tape recorder?
Answer by Mr. Lees: No sir, I can't.
Question by Mr. Salvino: Was it small or large?
Answer by Mr. Lees: A small one.
Question by Mr. Salvino: Would you testify to this information
a under oath?
Answer by Mr. Lees: I sure will. Twill take a lie test .or
anything.
Question by Mr. Salvino: Do you know who took these tapes out
of City Hall?
Answer by Mr. Lees: No, I do not.
Question by Mr. Salvino: Would you sign this statement now?
Answer by Mr. Lees: Yes I will.
City Attorney Walden stated that it bears the signature of Richard
Lees and the signature of Theliba.Anchors, Notary Public.
Chief Smith stated that he has used the tape recorder many times in
taking statements and received tapes for it, and Mrs. Thornhill will
bear him out. He did not know what kind of tapes they were. He
stated that he didn't want to leave it in ,the Police car all night
so he took it inside. He added that he often takes the recorder out
to interview a witness.

Commissioner Brice asked why are the tapes not back in the City Hall.
Chief Smith replied that he did not know which ones they were. They
are still at home on the TV set. lie stated "I don't read what is on
the box. Mrs. Thornhill gave me the tapes for usage".

Commissioner Young asked if it was not true that the minutes have
been taken from the tape and certified.
City Clerk Thornhill replied that they have all been transcribed, 'and
they use the tapes over and over again after they have been approved.
Commissioner Salvino asked if the tapes are kept in .the safe.
City Clerk Thornhill replied either in the safe or in her desk drawer.
Commissioner Zenobia asked Mrs. Thornhill if she has given the Chief
tapes at different times.
She replied, "Yes."
Commissioner Zenobia asked does he use the tape recorder at different
times.

" Commissioner Zenobia stated that right now they have tapes that
were used August 28, 1964, "that has been crossed out" . Another ?"

A motion was made by Commissioner Brice that hereafter, whenever a
tape is taken of Commission meetings, that they be retained because
in transcribing, they do not transcribe word for word of the con-
versation and the discussions that are carried on at Commission n
meetings. And I think that there is' no reason to take a tape unless
we are going to keep it." I would like to make a motion that it go
on record that from now on all tapes will be so marked and kept, so

The motion is as follows:
A motion was made by Commissioner Brice to retain the tapes after
Commission meetings. The motion was seconded by Commissioner Salvino.
G ® Bob Houston stated that the tapes should not only be kept, but there
should be a place to keep them.
City Clerk Thornhill stated that these tapes cost $3.75 each and we
have 300 now.
® City Attorney Walden stated that some time ago the Commission instructed
Mrs. Thornhill to make very detailed minutes. '!I hohestly believe that
you are wasting some valuable time on the part of the Clerk in making
her transcribe these things. in such detail. She ought to just report
the motion, what it was and the action taken. That is all that is
needed in minutes. I don't think all this conversation is part of the
official minutes. If you want the tapes, that is fine. But I don't
think the clerk ought to made to type 20 pages of minutes for every
meeting that we have here." He further stated that in minutes of any
other governing body, all that is typed in the minutes is the motion
that was passed.
® Commissioner Brice stated that the very reason for keeping the tapes
is so that they do not have to go into detail in the minutes.
Harry Loury, from the audience stated that he would like to see the
tapes from the Zoning Board meetings kept too. Mr. Loury stated that
they would also like to have a record of what they had said in the past.
9 Commissioner Brice stated that he was willing to change the motion, with
$he permission of Mr. Salvino. The motion now reads:

Commissioner Young asked Mrs. Thornhill how much storage space do they .

Mrs. Thornhill replied: We have a little vault there, Mr. Young, about
5 feet by 7 feet, and all the ordinances, all the registration books,
the money, the coffee pot, and everything is all in this one little area.
Commissioner Young asked if she felt that She has adequate space to
keep all these tapes for three years along with all the otherrthings
she mentioned.

Commissioner Salvino turned the letter over to City Clerk Thornhill.
® Commissioner Zenobia stated that it has been brought to his attention
by a few people of the City that the Dania Fishing Pier Restaurant,
run by Mr. Rhodes, has some vending machines out there that the City
is not getting some money out of. He has done some checking on it,
and he asked that the City make a special audit of the Dania Fishing
Pier Restaurant and the Dania Beach Grill, "Because I believe it has
® come to light that we did not get anything from these Pepsi Cola
machines and the cigarette machines. So I would like to find out
once and for all if this is true or not': . I would like to put that
in the form of a motion" .
A motion was made by Commissioner Zenobia that the City make a spe-
cial audit of the Dania Fishing Pier Restaurant and the Dania Beach
Grill. The motion was seconded by Commissioner Young, and the roll
being called, the Commissioners voted as follows:

Commissioner Salvino stated that he has half interest in the Dania
Beach Grill, and he had that before he became elected.
Bill Rhodes stated that he welcomes an audit of the books "I have
nothing to hide" .
Commissioner Zenobia read a letter regarding Mary Head, who is
unable to work on the election board on the West Precinct. They
4? proposed the name of Katherine Baker, 601 S. W. 1st Street has been
mentioned to fill this vacancy. Genevieve Ely is also unable to
work iii the South Precinct; she recommends Jean Jackson for the South.
Also, Willie Mae Ward, 35 N.W. loth Court is recommended for the West.
Commissioner Zenobia made a motion that a resolution be drawn and
adopted placing the above mentioned names on the election board.

City Attorney Walden stated that the City Clerk has received a Quit
Claim deed from Mr. & Mrs. Beaver for the radius on Old Dixie High-
way. So they need a resolution accepting the Quit Claim dedd.
A motion was made by Commissioner Young to, adopt and pass a resolu-
tion accepting the Quit Claim deed. -The motion was seconded by Com-
missioner Brice, and the roll being called, the Commissioners voted
as follows:

Chief Smith stated that he just wanted the people to know that he
® had permission tottake the recorder and tapes. "They will be back
here in the morning. But I certainly have not been_ any part of a
conspiracy to take any tapes out of here."
Commissioner Zenobia: Well I, for one, believe you.
® Mayor Adams stated that they had a special meeting regarding Officer
Lees, and it was the wish of the Commission that the Police & Fire
Commission should handle this. The Police & Fire Commission unani-
mously recommended the suspension of Officer Lees and they gave him
30 days. This date is to-stdrt when he was suspended a week ago
Saturday. That is the recommendation of the Police & Fire Committee
® to the Commission.
Mayor Adams further reported that they had a meeting with the Firemen
on Wednesday, with the Chief and all the paid firemen present. He
stated that the firemen requested the meeting with the Police & Fire
Committee. They work a Shift of 24 hours on and 24 hours off. During
® their vacation time, they have to double up. The Police & Fire Commit-
tee recommend that the firemen be paid for the time that they worked.
Commissioner Brice stated that he feels this recommendation is in order.
But he also felt, that this Commission should adopt a plan or-procedure
that any of the City employees who work extra time should get paid at
® the regular pay schedule for the time worked. We are not only doing
this for the firemen, we are going to do it for anyone else who is on
the City payroll who is called in for extra time. It is only fair
that if they do it for one department, they do it for all.
A motion was made by Commissioner Brice to pay the 6 firementfor the
® overtime, and any other employee who works extra time. The motion was
seconded by Commissioner Salvino.
City Manager Goldberg suggested that the other employees be referred
to the Finance Committee for further study.
Commissioner Young stated that they are covering two different areas,
and if they are going to cover two different areas, they need two
motions, "because I may want to vote Yes on one and No on the other^,"
Commissioner Young offered 'an amendment to Ir. Brice's motion, No. 1,
'the motion relating to all personnel otherr:than the Fire Department
