DANIA CITY COMMISSION
WORKSHOP MEETING
APRIL 17 , 1990

1 . Michael Moskowitz, attorney for the Cassone property, offers
to pay a portion of the drainage cost for property in the
vicinity of SE 4 Avenue and SE 3 Place with the City also paying
a portion of the total cost.
� John Calvin, Berry & Calvin, presented his proposal on
using a 36" diameter pipe made of corrugated aluminum
or a 30" PVC pipe which is smoother and can take more j
flow to drain the ditch located on the Cassone
property.
Discussion continued with the Commission regarding the
cost and advantages of using concrete, aluminum or PVC
piping for this project .
Mike Moskowitz, Attorney for the Cassone property,
explained that he has received information from his
� engineers that this project cannot use pipe larger than
36" in order to install the sewer laterals . Mr .
Moskowitz advised the Commission that his client is not
prepared to pay more than $24 , 000 as his part to
complete this drainage project .
After lengthy discussion, it was determined that Mr .
Calvin would come back with the cost figures on
installing the pipe and specifics on how to clear the
sewer laterals for this project .
City Attorney Adler stated that he would research the
status of the East Marsh Drainage District.

j 2. Discussion of a proposed contract with Coastal Tech for
I engineering services related to Dania Fishing Pier Study.

City Manager Flatley reminded the Commission that
Coastal Tech had been ranked number one to present a j
proposal on engineering services relative to
above/below water inspection of the Dania Fishing Pier.
Mr. Harvey Sasso, Vice President, Coastal Technology
Corporation, explained the methods that will be used in J r;
inspecting the Dania Fishing Pier. Mr. Sasso explained J
that after the inspection is completed, he will prepare R.
a report for the City categorizing the most critical to ;
the least critical repairs that will be required and
1 advise of cost. � �

After further discussion, City Manager Flatley stated
that this item will be added to the next regular e
meeting agenda for approval .
3. Big Nassau Daddy property, 1506 South Dixie Highway, is
presently owned by the City of Dania with several liens pending
and no property lease.
City Attorney Adler explained that. the City had
originally sited the Big Nassau Daddy property for code
enforcement violations and eventually a lien was
recorded by the City. The City then filed a
foreclosure suit to foreclose on the mortgage and
received a Certificate of Title to the property on a
fee simple basis . City Attorney Adler advised that the
City owns this property subject to encumbrances of
other liens filed by the So. Broward Hospital District,
Internal Revenue and back taxes.
Due to the encumbrances , City Attorney Adler
recommended to declare this property surplus and
advertise for bids for someone else to buy it. City
Attorney Adler felt it would be beneficial to the City
to let someone else work out a deal with the So.
Broward Hospital District , take over the first
mortgage, pay back taxes and pay any other liens that
were filed on the property prior to Dania taking title.

The Commission agreed to add this item to the next
regular commission meeting .
4. Status report on Chateau DeVille Condominium.
City Attorney Adler explained the details behind the
bankruptcy filed since October by the bank that was
going to finance the sale of the Chateau DeVille
Condominiums . Mr. . Adler explained that. no certificate
of occupancies have been released on the property even
though there are purchasers living there. These
purchasers pay $500 a month to the builder and that he
has advised these purchasers that the builder has no
right to receive their money until the bankruptcy is
resolved. Mr. Adler has informed these purchasers that
they cannot pay their water bills to the city as they
are not legally connected to the City water system.

City Attorney Adler stated that the Certificate of j
Occupancies on the buildings that were ready to close
were sent to the title company handling the closings
for Mary DeRosa Realty. The title company is suppose
to hold all certificate of occupancies in escrow until
the impact and administrative fees are paid to the City
before closing on any unit . Mr. Adler said that FPL
has also given power to the units even though the
certificate of occupancies have not been released.
Mr. Adler is attempting to contact the attorney
designated as trustee in an effort to resolve these
problems and expects to report back to the Commission
at the next regular meeting .
5. Property Standards discussion of minimum housing and
commercial codes.
Will Allen, Growth Management Director, presented an
ordinance creating property standards in Dania for
residential and commercial properties that would be a
supplement to the South Florida Building Code mandated
by the State. Mr. Allen stated that these standards
f would address exterior maintenance and sanitation
13 issues and not ! 'just safety of a building .

Discussion continued regarding additional revisions
being made to this ordinance before adoption.

6. Further discussion of forming a regional wastewater
authority: ¢
a) Revised draft of the Large User Agreement pertaining
to the Hollywood litigation suit.
b) Draft #5 of the proposed legislation establishing a
wastewater authority as well as draft #4 so that one
can see the changes made between the two drafts.

City Manager Flatley submitted a revised draft to the
Large User Agreement which is part of the Hollywood
litigation suit . Mr . Flatley stated that he felt the
litigation should be settled with Hollywood by next
Tuesday and hopes to receive a check by then for what
is owed back to Dania.
City Manager Flatley explained that with regards to the
concept of establishing a new wastewater authority he
would like to hear responses from our City Engineer,
Broward County, and the City of Hallandale and to
j workshop again next month.
7. Discussion of sidewalk maintenance and swale rocks.
Commissioner Grace expressed her concern for the broken
sidewalks in the City and the possibility of the City
being sued for persons being injured. Commissioner
Grace stated that there must be procedures created to
address this problem.
City Attorney Adler and City Manager Flatley explained
that all sidewalk repairs are the responsibility of the
{ property owner even though the City legally owns the
sidewalk.
City Manager Flatley suggested the possibility of
j budgeting funds for repair of sidewalks in an effort to
assist property owners like Pembroke Pines has recently
j done.
8 . Discussion of Winn Dixie Shopping Center maintenance.

Commissioner Bertino informed the Commission of several f
complaints that he has received regarding the trash and
garbage cleanup problem at the Winn Dixie Shopping
Center. Commissioner Bertino suggested this type of
situation be included to the commercial property
section of the minimum housing code being discussed at
this meeting.
ITEM 8 WAS DELAYED WHILE, AWAITING THE ARRIVAL OF A
REPRESENTATIVE OF THE WINN DIXIE SHOPPING CENTER.
AT THIS TIME, CITY ATTORNEY ADLER ASKED IF THE
COMMISSION HAD ANY OBJECTION TO HEARING A REQUEST BY
HARBOUR TOWN TO CONSTRUCT A TEMPORARY TENT FOR THE BILL
FISHING TOURNAMENT SCHEDULED APRIL 23, 1990. CITY
1 ATTORNEY ADLER STATED THAT NO ACTION COULD BE TAKEN
TONIGHT BUT SINCE THE TENT HAS TO BE CONSTRUCTED ON ,
APRIL 23, PRIOR TO THE REGULAR MEETING, HE ASKED THE
COMMISSION TO RESPOND. J'
j DAVID GRAHAM EXPLAINED THE IMPORTANCE OF THE WEEK LONG
EVENTS SCHEDULED AT HARBOUR TOWNE AND REQUESTED f; y

THE COMMISSION AGREED TO ALLOW MR. GRAHAM TO CONSTRUCT
THE TEMPORARY TENT ON MONDAY, APRIL 23 AND THAT THEY
WILL VOTE ON IT AT THE REGULAR MEETING APRIL 24 . MR,
GRAHAM STATED THAT HE WOULD DELIVER A LETTER TO THE
CITY MANAGER THAT IN THE EVENT THE TENT CONSTRUCTION IS 1
VOTED DOWN ON TUESDAY, HE WOULD REMOVE THE TENT

Commissioner Bertino informed the Commission of the
ongoing rodent , trash, garbage and lack of maintenance
problems at the Winn Dixie Shopping Center .

1 Ms. Rita Espinosa , Metrium Realty, was present to
represent the shopping center management company and
stated that her company has no problem with maintaining
the property. Ms . Espinosa informed the Commission of
other difficult problems regarding people dumping items
behind the shopping center , tenant burglaries , RV
camper trailers being parked in the Shopping Center and
gang related crimes . Ms. Espinosa requested assistance
from the City by supplying additional police
surveillance.

Discussion followed regarding the City Manager. and
Building departments meeting with Ms . Espinosa to work
out the details of these problems .
9. Continued discussion regarding an amendment to the fence
i ordinance as it pertains to sidestreet sideyard fence heights.
(Commissioner Cook)
Will Allen presented his review of the Dania fence
ordinance and reported on his findings of what other
cities are using in relation to this subject . Mr.
Allen stated that he feels a 6 ' fence on the corner
sideyard is reasonable and added that regulations could
be included requiring frame attractiveness.
Commissioner Bertino suggested leaving the fence
request under the variance procedure but no fee be
iattached as a fence will usually enhance the area .
Several residents were present to express their
opposition to being required to go thru the variance
procedure to obtain a fence as other residents have
been allowed to construct fences with no restrictions .
The Commission generally agreed to consider an j
amendment to the fence ordinance to allow a 6' fence on
side corner and inside lots and to stop it, at the front
edge of the property where a 4 ' fence would then be
allowed. The ordinance will include specific material.
standards that will be allowed and any request for a
fence outside the standard would require a variance
request.
10. Schedule of Arbor Day (Friday, April 20) events at Dania
Elementary School and Collins Elementary School.
City Manager Flatley requested Commission support at
the Arbor Day celebration for Friday, April 20 at 8 :00

the Commission that having an Arbor Day celebration was
a requirement .in order to file for the Tree City USA
1 Program.
Commissioner Grace explained that at 10:00 a.m. on
Friday, Collins Elementary will also be having a
celebration for Earth Day and that two trees will be
planted in commemoration of Chester A. Byrd and Anita
Collins . p
}11. Discussion regarding Dania Housing Authority. (Mayor
Mc Elyea)
Mayor Mc Elyea expressed his concern with the manner in
which the Dania Housing Authority is conducting
business. Mayor Mc Elyea mentioned that the courts
have ordered his two appointments to be seated on the
Housing Authority and that all meetings have been
deferred for three months by the Chairman of the
Housing Authority . Mayor Mc Elyea reminded the
Commission of the Housing Authority projects that are
j in progress at this time with no one overseeing them.
Mayor Mc Elyea mentioned that Nancy Preusz has filed a
suit against the Housing Authority for discrimination.
Mayor Mc Elyea stated that in accordance with State
Statute, he has the right to ask for a 10 day notice of
resignation from Bill Winkelholz , Chairman of the Dania
Housing Authority , or to turn this over to the Broward
County Housing Authority to solve the problem. Mayor I ,,
Mc Elyea expressed concern that no one seems to be able
to know what is really going on with the Housing
Authority business .
City Attorney Adler said that it is his understanding
that Ms . Preusz has filed a complaint with the Human
Relations Board for discrimination . Mr. Adler stated
y that he doesn ' t quite understand the basis of
discrimination since Ms . Preusz has been running the
Dania Housing Authority in the position of Executive
Director.

City Attorney Adler stated that the Court Order is not
final until the 30 days for appeal has passed and that
he recommends to wait 30 days for the appeal to run out
before taking any action. Mr. Adler said that he would
speak with the Human Relations Board, Mr. Winkelholz,
Chairman of the Housing Authority, and HUD to obtain j
more information for the Commission.
This workshop meeting was then adjourned.
