Feltgen , BSO, Commissioner Cook and City Manager Flatley for their assistance in the success of the Chester Byrd Family Day in cooperation with the Dania Activity Committee . Commissioner Grace informed the Commission that the funds a.° received from the success of the Chester Byrd Family Day made it possible to make needed repairs to the Camp Blanding Day Care Center in time for the new school year. Commissioner Grace then read a letter of appreciation from Dorothy James , Director of the Camp Blanding Day Care Center, to the City of Dania for their support . 1 . Leeds, D/B/A Leeds Co. ; and authorizing the appropriate city officials to execute said contract . i I ' 1 I Regular Commission Meeting 1 September 12, 1989 ( 1 znr�r"i z 1 . 7 City Attorney Adler read the title of the resolution authorizing City Manager to submit an application for funding under the Florida Recreation Development Assistance Program for Dania Beach Park; designating the City Manager or his designee as the official liaison agent ; confirming the amount of funds requested in the grant ; confirming the availability of the required matching funds; confirming the total cost of the project ; confirming the City' s responsibility to develop, operate and maintain the project ; confirming that the City offered all citizens the opportunity to participate in the planning process relative to the adoption of the recreation and open space element ; confirming the city' s on-going concern for citizen participation in planning and selection of recreation pojects . 1 .8 City Attorney Adler read the title of the resolution relating to N. E. 7th Avenue special assessment district improvements in accordance with Sections 170.03 , 170. 04 , 170. 05, 170. 06 and 170.07 of Chapter 170, Florida Statutes, stating the nature of the proposed improvements ; designating the portion of the expenses to be paid by special assessments; designating what part, if any, of the expenses shall be apportioned and paid from the General Fund of the City of Dania; establishing the total estimated cost of the improvements; approving the assessment plat ; designating the manner in which the assessments shall be made; designating when said assessments are to be paid, designating the manner of payment of the assessments ; designating the lands upon which the special assessment shall be levied ; providing for the preparation of the assessment roll ; providing for the availability of plans and specifications ; providing for separability. Ordinances 1 . 11 City Attorney Adler read the title of the ordinance amending , Section 13-68 and Section 13-69 (a ) (b) (c ) (g ) (h) & ( i ) of Article IV, Chapter 13 of the 1980 Code of Ordinances to provide for charges for pick ups of garbage and trash at residential and commercial sites. 1 . 12 City Attorney Adler read the title of the ordinance amending Article 5, Part II of the City Charter entitled "Special Assessments for Local Improvements" by the adoption of the provisions of Chapter 170, Florida Statutes, for the assessment and collection of special assessments within the City ; providing for separability. . 1 . 13 City Attorney Adler read the title of the ordinance amending Section 26-34 , Article III , of Chapter 26, of the Code of Ordinances of the City of Dania , Florida regarding site plan review for single family residences ; repealing sub-paragraph (a ) thereof . 1 . 14 City Attorney Adler read the title of the ordinance amending Section 13-32 of Article II , Chapter 13 , of the Code of Ordinances of the City of Dania regarding responsibility of owners of privately owned property within the City of Dania ; providing for assessments Of costs; providing for liens; providing for payment of interest on liens . 1 . 15 City Attorney Adler read the title of the ordinance approving the plat of "Glen-Lauren Flomes" . i j 1 . 16 City Attorney Adler read the title of the ordinance rezoning lots 6 through 13, together with lots 18 through 23 , Block 3, "Dixie Way" from present zoning classification to C-3 zoning classification under the provisions of Ordinance No. 100 of the City of Dania, j Florida . i 1 . 17 City Attorney Adler read the title of the ordinance amending i Chapter 18 of the Code of Ordinances entitled "Pensions and Retirement" to permit payment to the trustees of the retirement { system for administrative services rendered to or on behalf of the f system. The motion passed on the following roll call vote . i Commissioner Bertino - yes Vice-Mayor Mikes - yes Commissioner Cook - yes Mayor McElyea- yes Commissioner Grace-yes PULLED FROM CONSENT AGENDA Resolutions 1 .4 City Attorney Adler read the title of the resolution approving the memorandum of understanding between the City of Dania and Broward County regarding "Project-Impac ' . Upon Commissioner Cook' s request , Mr. Mike Smith , Personnel Director, stepped forward to update the Commission on improvements that have been made to Dania due to Dania ' s participation in the "Project-Impac" program with Broward County. Mr . Smith explained that Dania , along with Deerfield and Oakland Park , will be receiving a portion of the $593 ,000 allocated for this program. A motion was made by Commissioner Cook, seconded by Commissioner Grace to approve the resolution approving the memorandum of understanding between the City of Dania and Broward County regarding i, "Project-Impac" . The motion passed on the following roll call vote. Upon Commissioner Grace ' s request , Mike Smith , Personnel Director, - i stepped forward to explain the two phase park project agreement with Broward County in the amount of $45,000. Mr. Smith explained that $30,000 has been utilized for sidewalks, drainage and curbing around Modello Park and $15 ,000 will provide some initial development of a new park at N.W. 14th Way between 2nd. and 3rd. Street on the C-10 canal . He also explained that another part of "Project-Impac" { involves a $20,000 grant that will be coming later to develop Chester y Byrd Park in the S.W. part of the City . A motion was made by Commissioner Grace, seconded by Commissioner Cook to approve the resolution approving the amended agreement between City of Dania and Broward County for park project in the amount of $45 ,000 . This item was pulled from the agenda and no action was taken . f i Regular Commission Meeting 3 September 12 , 1989 j ,f F7, 1 Ordinance 1 . 18 Ordinance amending Section 27-38 of Article II of Chapter 27 of the 1980 Code of Ordinances entitled "Rates and Charges for Service" and providing that except as herein amended all other provisions of Chapter 27, Article II , of the Code of Ordinances shall remain in i full force and effect . This item was pulled from the agenda and no action was taken . I i 2 . PROCLAMATIONS 2 . 1 Mayor McElyea proclaimed September 23 and 24 , 1989 as Pioneer Days . 2. 2 Mayor McElyea proclaimed September 17 , 1989 as Citizenship Day and September 17 through September 23 , 1989 as Constitution Week. 3 . BIDS - None 4 . Public Hearings and Other Related Matters Administrative Ordinances (Second and Final Reading ) 4 . 1 City Attorney Adler read the title of the ordinance amending Section 18-29. 1 ( 4 ) of Article III , Chapter 18, of the Code of Ordinances providing that General Employees shall become members of the retirement system regardless of age; providing an option to make retroactive contributions to the retirement system for employees w:�,ac date of employment was on or after their fifty-fifth birthday; providing for the terms of such retroactive contribution . Mayor McElyea then opened the public hearing . Hearing no one speak in favor or opposition, Mayor McElyea closed the public hearing and i opened this item to the Commission for discussion and possible action. At this time , a motion was made by Vice-Mayor Mikes , seconded by Commissioner Bertino to amend the ordinance as stated by not exceeding the contribution amount set by federal mandate requirements >.aJ of l/l/88 and to take up additional employee contribution increases by negotiation in order for the City to budget for this type of d item. The motion failed on the following roll call vote . Commissioner Bertino-yes Vice-Mayor Mikes-yes Commissioner Cook-no Mayor McElyea-no Commissioner Grace-no 7 A motion was then made by Commissioner Cook , seconded by Commissioner 1 Grace to adopt the ordinance amending Section 18-29 . 1 (4 ) of Article III , Chapter 18 , of the Code of Ordinances as prepared. This motion passed on the following roll call vote . y Commissioner Bertino-yes Vice-Mayor Mikes-yes Commissioner Cook-yes Mayor McElyea-yes j Commissioner Grace-yes 7 I r � Commissioner Bertino requested that, in the future , before any ordinances are prepared under any direction or input from board members in the City or any mandate that it be brought to the City Commission first prior to being drawn up. 4 . 2 City Attorney Adler read the title of the ordinance providing for a referendum on annexation of property located west of Ravenswood ` Road , east of State Road 7, north of Stirling Road and south of State Road 84. 1 Regular Commission Meeting 4 September 12, 1989 I A motion was made by Commissioner Bertino, seconded by Vice-Mayor Mikes to continue this ordinance until such time as the proposed annexation agreement is received from Broward County. Site Plan Requests - none 6. Expenditure Requests - none 7. Special Requests City Attorney Adler informed the Commission of a special request from John Bond to delete the easterly portion of Nisa Plat from the platting process at the County due to time constraints . He explained that the easterly portion of the plat is wetlands areas which would require months of review time . A motion was made by Commissioner Cook, seconded by Commissioner Bertino to grant the request by John Bond to delete the easterly portion of Nisa Plat from the platting process at the County due to time constraints. Hift that Mr . Mancusi was recovering from an operation and couldn' t be present at the August 18 , 1989 , City Commission Meeting . A motion was made by Commissioner Grace , seconded by Commissioner Cook to rehear VA28-89 at the City Commission Meeting scheduled October 10 , 1989 . Appointments 8 . 1 & 8.2 Commissioner Bertino requested appointment to the Political Sign Committee and Safe Neighborhood Advisory Board be rescheduled for the September 26 Regular Commission Meeting . The Mayor granted i this request. 1 9. Discussion - none i ti j 10 . Citizen's Comments - none 1 I i 11 . Adminstrative Reports 11 . 1 City Manager ;! The Commission approved of Commissioner Bertino' s concept to obtain the Tree City USA designation for the City of Dania presented by the i National Arbor Day Foundation in cooperation with the U.S . Forest Service and the National Association of State Foresters . City i Manager Flatley will be assisting Mayor Bertino in meeting the four requirements necessary to obtain this designation. Regular Commission Meeting 5 September 12, 1989 i' City Manager Flatley reminded the public that there is a Public I Hearing scheduled September 13, 1989 at 8: 00 p.m. to discuss next years budget . 11 . 2 City Attorney - no comments j 12 . Commission Comments 12. 1 Commissioner Bertino I Commissioner Bertino reported that he is still working on bicycle paths and expects some very gratifying results in the near future. 12 . 2 Commissioner Cook - no comments 12.3 Commissioner Grace Commissioner Grace thanked Mayor McElyea, on behalf of the Camp Blanding Child Care Center, for his support . Commissioner Grace reminded the Commissioner that there will be a banquet held at the Holiday Inn on State Road 7 on October 13th in honor of the late Mayor Chester A. Byrd . i Commissioner Grace also mentioned that on October 14 there will be a game at Lockhart Stadium that starts at 1 : 30 p.m. and requested that a list of the activities for that day be k+' y posted in City Hall . I Commissioner Grace requested Mayor McElyea to be present for Citizenship Day September 17 at the American Legion Post 209. ' Commissioner Grace expressed her concern over police officers searching individuals without proper cause and requested Capt . Hernandez to look into this problem. j Commissioner Grace informed the Commission of an illegal fence that ! has been constructed at Mr. D' s Fish Market on Stirling Road and requested the Planning and Zoning Board and City Manager to look into this problem. i 12.4 Vice-Mayor Mikes a. Vice-Mayor Mikes complimented City Manager Flatley for the presentation that he gave before the Civic Association last week on a number of issues . Vice-Mayor Mikes expressed the importance of petitioner notices being sent out prior to the Planning and Zoning Board Meetings to ensure all citizens that may be effected by an item are duly notified . 12. 5 Mayor McElyea Mayor McElyea commented on the prostitution problem in Dania and requested BSO to tighten-up in this area.
