PRESENTATIONS
B.S.O. presentation to Dania Fire Rescue personnel .
Captain Ralph Hernandez of B.S .O. District IX read a letter from
Sheriff Nick Navarro to Fire Chief Grammer extending his
gratitude to the firefighter/paramedics of the City of Dania for
coming to the aid of Deputy Janet Varona and providing life
saving assistance in a manner which is to be highly commended , �..
Captain Hernandez recognized Assistant Fire Chief Kenneth Land,
Engineer-operator Loyd Holden, Firefighter/paramedic Michael
Cassano, Firefighter/paramedic Patrick Patterson, Fire-
fighter/paramedic John Lexa , Firefighter/paramedic Thomas
Tubridy, and Firefighter/paramedic Enrique Mustelier all of whom
assisted in the rescue of Deputy Varona.
Artis Hall of Bethune-Cookman College.
Mr. Jerry Carter representing Mr. Hall stated that The
Bethune-Cookman College Broward County Chapter will be hosting
their first annual Chester A. Byrd presidential banquet in
October in Broward County. Mr . Carter presented their proposal
for sponsorship for this event for consideration by the
Commission.
Commissioner Grace urged support from the City of Dania in this
event. She urged all the commissioners to attend the banquet.

3 . BIDS - 8: 15 p.m.
3 .1 Receipt of bids for 24 PVC Roll-up Shutters.
1 A motion was made by Commissioner Bertino, seconded by Vice-Mayor
Mikes that the time of receipt of bids be closed. Motion passed
junanimously.
City Manager Flatley opened and read the following two bids : 1 )
i Roloden for twenty six thousand five hundred dollars and 2 ) Nuprime
Rollaway for seventeen thousand eight hundred and fifty dollars,
City Manager Flatley turned the bids over to Fred Arruda for
evaluation to be awarded later in the evening.

City Manager requested that the commission approve the Nuprime
Rollaway Bid due to the $8 ,000 difference in the bids and the
recommendation of Mr. Fred Arruda of the city' s construction and
maintenance crew.
Mayor McElyea granted the request to speak by Mr. Charles Casper,
sales engineer with the Roloden Company.
Mr. Casper presented his view of the differences in the two companies
that had submitted bids.
After discussion, a motion was made by Commissioner Cook , seconded by
Commissioner Grace , to award the bid to the Roloden Company in the
amount of twenty six thousand five hundred dollars ( $26 ,500 .00 ) .
The motion passed on the following roll call vote:

4 . PUBLIC HEARINGS AND OTHER RELATED MATTERS
4 . 1 Petitioner/owner - Michael Mancusi ; property located at 202 N.E.
2nd Place (continued from 6/27/89)
Public Hearing - VA-28-89 - a variance request to construct a 6 '
fence in an exterior side yard (maximum 4 ' permitted) .
Sharee Kelly, representing Michael Mancusi , presented the
request to the commission.
Mayor McElyea opened the public hearing. Dr. David Preacher of
313 N. E. 2nd Ct. spoke in opposition to the variance. No one
else spoke for or against the variance . The Mayor then closed
the public hearing and invited comments from the commission.
Commissioner Cook stated that there are several 6 ' fences in
different areas of the city that have not obtained a variance or
been sited .
Commissioner Bertino commented on the fact that the fence was
built in violation of the permit and that there were neighbors
in opposition to the fence. He also stated that if anyone else
has constructed fences in violation of the code that they should
also be cited.
Growth Management Director Larry Leeds explained that the permit
was issued for a 4 ' fence in the exterior side yard and a 6 '
fence for the interior side yard. Therefore , this variance
relates to the exterior side yard where a 6 ' fence was
erected in violation.
Commissioner Bertino made a motion , seconded by Vice-Mayor
Mikes to deny this variance request. Motion was passed on the
following roll call vote:

4 . 2 Petitioner/owner - David Nuby; property located at 25-27 N.W.
4th Avenue.
A) Public Hearing - RZ-33-89 (second and final reading of ordi-
nance) .
City Attorney Adler read the title of an ordinance rezoning Lots
12 and 13 of Block 15 of the "Town of Modello" .
Mr. David Nuby presented the rezoning request to the commission
to rezone the property at 25-27 N.W. 4th Avenue from C-3 zoning
to C-4 zoning in order to be able to keep his equipment parked

on this property. I

Mayor McElyea opened the public hearing. No one spoke for or
against the rezoning. The Mayor closed the public hearing and
invited comments from the commission.
After further discussion, Commissioner Cook made a motion,
seconded by Commissioner Grace , to adopt the ordinance on
second and final reading rezoning this property. Motion
passed on the following roll call vote:

B) Public Hearing - VA-34-89 - A Variance is requested to allow
outdoor storage of construction equipment and construction
materials in a C-4 zoning district .
Mayor McElyea explained that Mr. Nuby needs this variance to
be able to leave his equipment and construction materials
outdoors .
Mayor McElyea opened the public hearing . No one spoke for
or against the variance . The Mayor closed the public hearing
and invited comments from the commission.

A motion was made by Vice-Mayor Mikes, seconded by Commissioner
Bertino to approve the variance subject to the following condi-
tions recommended by the Planning and Zoning Board :
1 ) 6' fence with slats on all sides of the property
l., 2) Landscape front of property with ficus hedge
3 ) 4 black olive trees in front of swale area
The motion passed on the following roll call vote :

Public Hearing - PL-53-89 (second and final reading of ordi-
nance)
City Attorney Adler read the title of an ordinance approving the
plat of "Richart Plat" .
Jenny Buthene with Research Florida, Inc. representing the owner
presented the request to the commission.
Mayor McElyea opened the public hearing. No one spoke in favor
or against the plat.
A motion was made by Commissioner Cook , seconded by Commissioner
Grace to adopt the ordinance approving the plat . The motion
passed on the following roll call vote:

800 N.W. 3rd Place .
A) Public Hearing - RZ-47-89 (second & final reading of ordinance)
City Attorney Adler explained to the commission that the ordi-
nance should be amended to cover only all of lots 1 through 24 ,
block 2 corrected plat of Dania Manor as recorded in plat book

The wrong description of the ordinance was used by the building
department originally. A motion was made by Commissioner Cook ,
seconded by Commissioner Grace to amend the ordinance as
suggested by City Attorney Adler.
Motion passed on the following roll call vote :

City Attorney read the amended title of the ordinance.
Attorney A. J. Ryan, representing the owner, Mr . Downs ,
presented the request to the commission.
Mayor McElyea opened the public hearing. Several citizens ex-
pressed their objections and concerns to this rezoning.
Mayor McElyea closed the public hearing and invited comments
from the commission.
A motion was made by Commissioner Cook , seconded by Commissioner
Grace to approve the ordinance rezoning this property. The
motion passed on the following roll call vote:

B) Public Hearing - VA-48-89 - The following variances are re-
quested:
a) automobile parking on leased property;
b) outdoor storage of construction equipment and materials on
crushed rock area .
Attorney A. J. Ryan, presented the request to the commission.
Mr. Ryan stated that the equipment referred to as construction
equipment is really marine equipment used on boats doing marine
research at sea.
Mayor McElyea opened the public hearing on a) of this item.
Citizens in the area surrounding this property expressed their
concerns on this variance . The Mayor closed the public hearing
and invited comments from the commission.
Commissioner Bertino made a motion, seconded by Commissioner
Grace to grant a variance for automobile parking on a paved
area for employees and customers of the business . The motion
passed on the following roll call vote:

Attorney A. J. Ryan recommended that the commission change the
language in b) from construction equipment to marine research
equipment .
Vice-Mayor expressed his desire to make this variance contingent
on a two year time limit for the variance and further land-
scaping review with city staff . He made a motion to approve the f
variance for b) for a period of two years, subject to an add-
itional site plan review of the building department . Motion
died for lack of a second.
After further discussion, Commissioner Bertino made a motion ,
seconded by Commissioner Cook, to approve the variance for b)
for the outdoor storage of marine equipment with the following

stipulations:
1 ) A 10 ' high hedqe that
the building departmenteets with the specifications of
2) Landscaping and irrigation system
3) An 8 ' fence with 75% screenage of the total
fenced area within 2 years.
4 ) No toxic materials to be stored on the area
5 ) Landscaping must be maintained
6 ) Hours of operation to be from 7: 00 a.m. to 7:00 p.m.
7 ) Subject to the revised site plan from the building dept.

C) SP-49-89 - A site plan approval is requested for a Marina
Technical Center (Office/warehouse/light fabrication) and
associated parking and outdoor storage .
Mr. Larry Leeds stated that the site plan complies with all
zoning and parking requirements.
The height of the trees and the type were discussed. Vice-Mayor
Mikes requested that the trees be higher and that they be sable
palm clusters .
Vice-Mayor Mikes made a motion, seconded by Commissioner Bertino
that the site plan be approved subject to the modifications on I
the trees along Griffin road. The motion passed on the follow-

5. SITE PLAN REQUESTS - none
6 . EXPENDITURE REQUESTS - none
7. SPECIAL REQUESTS
7.1 To approve A.T. & T. proposal to resolve the telecommunications
si tax overpayment issue ($18 ,949 ) .
City Manager Flatley explained to the Commmission the proposal
from A. T. & T. in reference to the overpayment to the cities.
He recommended that the commission accept the proposal from
A. T. & T.
A motion was made by Commissioner Bertino to approve this
request. Motion seconded by Commissioner Cook and passed on
the following roll call vote :

7. 2 Request to approve Safe Neighborhood Consultant Ranking.
City Manager Flatley informed the commission that the Safe
Neighborhood Advisory Board had met and reviewed the propo-
sals that were received from the consultants. The board ranked
Larry Leeds Co. Community Planning Consultants number 1 ;
i Berry Calvin Engineers number 2; and Han, Perez, Belomo Group

number 3 .
Mr. Flatley recommended that the commission accept the Leeds
I Company proposal and that he would bring back to the commission
a contract at the September 12th meeting if the proposal meets

the criteria of the state.

A motion was made by Commissioner Bertino, seconded by
Commissioner Cook, to approve the recommendation to retain
the Leeds Company. The motion passed on the following
roll call vote:

8. APPOINTMENTS
8. 1 Appointment by Commissioner Bertino to a political sign
committee .
Commissioner Bertino requested that this be removed from the
agenda.
8 .2 Appointment by Commissioner Bertino to the Safe Neighborhood
Advisory Board. (7;ua: be property owners or residents within
the district) .
Commissioner Bertino requested that this be removed from the
agenda.
9 . DISCUSSION
9 . 1 Arthur Coachman wishes to discuss the upkeep of a neighbor-
hood lake .
Mr. Coachman expressed his concern with the lack of upkeep
around Nelson Lake and asked the City to help clean up this area and maintain it. 1e ..
The City Manager was directed to look into this as to the cityyIs
responsibility in maintaining the lake and the area around it.
9.2 Discussion of Dania Beach concept plan for the beach grant
application.
City Manager Flatley presented concept drawings of improvements at the beach to be submitted to the state as part of the appli-
cation for the grant from the state.
He also informed the commission that the city would be able to
use the land value of the beach as the match for the grant.
City Manager Flatley informed the commission that the new beach
cleaner had arrived and we would be cleaning the beach on a
daily basis.
* At this time discussion of item 3 . 1 was continued.
11 . ADMINISTRATIVE REPORTS
11 .1 City Manager
11 . 1 . 1 Notification of train whistle blowing public hearing at the
county on September 12 , 1989 (2 :00 p.m. )
City Manager Flatley informed the commission that the county
would be holding a 1 g public hearing on Sept . 12, 1989 at 2 :00
p.m. at the Broward County Governmental Center on the county
wide train whistle ordinance that will establish whistle
blowing limitations in all cities of Broward County.
City Manager invited the commission to attend a meeting of the
Griffin Civic Center at Griffin Park on Tuesday, August 22nd
at 8 : 00 p.m, to respond to any questions of the people in that
area regarding the City of Dania.
11 . 2 City Attorney announced the Chamber of Commerce barbecue on
August 26th from 3 :00 p.m. to 8 :00 p.m.

12 . COMMISSION COMMENTS
12. 1 Commissioner Bertino announced that school starts on August 28th

and asked that everyone watch out for the children and be extra I
careful with their driving.

12. 2 Commissioner Cook reported that Mr. Mike Smith
director, will be bringing the commission up-to-dateonnel next week
on the money that the city will be receiving from our grants .
12.3 Commissioner Grace inquired of the City Manager as to the status

t Commissioner Grace announced that on Saturday, August 26 , the
Chester A. Byrd family day would be held at Modello Park and
urged all the commissioners and employees to attend.
12.4 Vice-Mayor Mikes expressed his concern with the public notices
on public hearings being sent out prior to the commission meet-
ings instead of the Planning and Zoning board meetings .
