Ordinances
1 . 5 The title of an Ordinance amending Section 2-25 of Article II of
Chapter 26 of the Code of Ordinances re tree maintenance
practices was read for first reading by City Attorney Adler.
1 . 6 The title of an Ordinance amending sub-paragraph (b) of Section
10. 32, Art. 10, Chapter 28 of the City Code to increase the
s distance of notification of owners of adjacent properties of
proposed changes in zoning and requests for variances and
special exception uses, from a distance of 300 feet to a
distance of 600 feet was read for first reading by City Attorney
Adler.
1 .7 The title of an Ordinance amending Section 15-12, of the 1980
Code of Ordinances, by amending the occupational license fees
was read for first reading by City Attorney Adler.
Resolution
** (prepared per the May 22nd workshop )
The title of a Resolution in support of Transflorida Bank 's
request to Broward County for a curb cut on Sheridan Street at
the southwest corner of its property to permit a right-turn only
exit onto Sheridan Street was read by City Attorney Adler.
City Attorney Adler reported this resolution provides that a
copy be furnished to the Broward County Commission .
A motion was made by Commissioner Cook, seconded by Commissioner
Grace to approve the consent agenda with the exception of item 1 . 4 .
The motion passed on the following roll call vote:

PULLED FROM CONSENT AGENDA:
Resolution
1 . 4 The title of a Resolution relating to NE 7th Avenue Special
Assessment District Improvements was read by City Attorney
Adler.
Vice Mayor Mikes pulled this item from the Consent Agenda for
purposes of clarification.
City Manager Flatley described the process necessary to
establish a special assessment program to develop NE 7th Avenue,
the first step being this resolution of necessity, the next step
will be notices sent to property owners , approval of the special
assessment map, proceeding to public hearings and approval of
the assessment roll and certification of tax rolls.
City Engineer John Calvin explained that this takes the actual
cost of road construction and related costs and spreads them out
over benefitting properties .
In response to a question raised by Vice Mayor Mikes regarding
the possibility of any additional liability to the city for
funding if Broward County acquired any of those properties, City
Attorney Adler said the County would have to pay the assessment
also as a property owner.
A motion was made by Vice Mayor Mikes, seconded by Commissioner
Cook to adopt the resolution of necessity. The motion passed on

requirements in accordance with the following criteria :

Administrative Ordinances (second and final reading )
4.2 The title of an Ordinance amending Sec. 9-2 (b) and Sec. 9-3 of
Chapter 9 of the City Code to increase the fees for grave plots
I and interment and to change the time when no funeral services
can be conducted to the hours of 3: 00 p.m. on Saturday to 9: 00
a.m. on Monday was read for second and final reading by City
Attorney Adler.
Mayor McElyea opened the public hearing. Hearing no one speak j
in favor or opposition, the Mayor closed the public hearing.
A motion was made by Commissioner Grace, seconded by
Commissioner Cook to adopt the ordinance on second and final
reading. The motion passed on the following roll call vote:

j 4 . 3 The title of an Ordinance Amending Sec . 6-33 of the City Code,
i entitled "Schedule of Charges" was read for second and final
reading by City Attorney Adler.
City Attorney Adler explained that this ordinance raises the
hourly parking fees at Dania Beach to $1 .00 and increases the
cost of the annual parking permit to $20.00. He said the
ordinance needs to have the effective date of August 1, 1989,
inserted .
Mayor McElyea opened the public hearing . Hearing comments in
favor by Vincent Carroll , Peggy Breeschoten, Faye Bartelmes and
Hugo Renda, the Mayor closed the public hearing.
Following discussion of planned beach improvements , a motion was
made by Commissioner Grace , seconded by Vice Mayor Mikes to
adopt the ordinance on second and final reading . The motion
passed on the following roll call vote:

8. APPOINTMENTS
8 . 1 Appointment of a Real Estate Appraiser to the Unsafe Structures
Board . (member must be a resident of Dania and registered and by
licensed by the State of Florida )
With the understanding that a qualified appointee may be sought
outside the city if one cannot be found within the city limits ,
Commissioner Cook presented the resume of Keith Pfenniger and
er, Real Estate Appraiser,

made a motion to appoint 9
to the Unsafe Structures Board . The motion was seconded by Vice
- ; Mayor Mikes for discussion. Being assured that no other a
Commissioner had a certified property appraiser within the city
limits to appoint, the motion passed unanimously.
8. 2 Appointment to the Downtown Redevelopment Agency. (member must
be a Dania resident or engaged in a business in Dania)
Vice Mayor Mikes, as Chairman of that committee, made a motion
to invite the Chamber of Commerce to make a recommendation to
the City Commission for appointment to that position. The
motion was seconded by Commissioner Bertino and passed
unanimously.
**** During Commission Comments (agenda item 12 . 5 ) , motion passed to
reconsider the vote on this item.
Mayor McElyea passed the gavel and made a motion to reappoint
James Kocourek to the Downtown Redevelopment Agency. The motion
was seconded by Commissioner Cook and passed unanimously.
j 8. 3 Appointment of sub-contractor to the Code Enforcement Board.
(The term of Peggy Breeschoten, who was appointed in lieu of a I
sub-contractor, has expired . Member must be a Dania resident. )
A motion was made by Commissioner Cook, seconded by Commissioner
Bertino to reappoint Peggy Breeschoten to the Code Enforcement
Board. The motion passed unanimously.

8.4 Appointment of electrical contractor to the Unsafe Structures
Board. (The term of William Sargent will expire on 5/26/89. If
a qualified Dania resident is not found, a qualified
non-resident may be appointed. )

A motion was made by Commissioner Bertino, seconded by
Commissioner Cook to reappoint William Sargent to the Unsafe
Structures Board. The motion passed unanimously.
9. DISCUSSION
9. 1 Airport noise exposure comments
City Manager Flatley, regarding submission of public comment on
the noise exposure maps and accompanying compatibility program
by May 27, 1989, as discussed at the May 22nd workshop, said he
will be requesting a thirty day extension to that deadline. He
reported on the County Commission meeting he and Vice Mayor
Mikes attended this morning.
City Manager Flatley received input from the Commission on
matters that need to be addressed immediately if the time
extension is not granted, i .e. curfew, noise and air quality
monitoring . House Bill 12-47 on clear zones currently pending
in the Legislature was discussed and City Manager Flatley
reported plans to submit amendments to the Bill, including one
to require all airports to do Part 150 Studies . Vice Mayor
Mikes, commenting on the Noise Compliance Committee 's planned
response to the Bill , suggested the city also include a request
to require all major airports to continual) update

A motion was made by Commissioner Cook, seconded by Commissioner
j Grace to direct City Manager Flatley to forward a letter to
F.A.A. requesting a thirty day extension to the May 27th public
comment deadline and also commenting on House Bill 12-47. The
motion passed unanimously.
9. 2 Drainage for southeast Dania (Commissioner Bertino)

9.4 Drainage into condominium lakes (Commissioner Cook)
Discussing Commissioner Bertino's concerns regarding the
drainage problem and flooding in the southeast section of the
city and Commissioner Cook 's concerns regarding the condition of
the condominium lakes the city drains into, the Commission
expressed the need to have a study done to find solutions to the
problems and to continue to maintain the lakes in the meantime.
9. 3 County agreements for 4-way stop signs.
City Manager Flatley reported denial by County Traffic
Engineering of his requests for stop signs at SE 7th and SE 3rd
Ave. and also at SE 2nd Ave . and SE loth St. He recommended
getting together a list of the places where the Commission wants
to have three or four-way stop signs installed and putting an
agreement before the County Commission.

10. 1 Request by Dr. David Preacher to ask the Commission for a vote l of confidence and financial help for the Curtis ' and their legal
battle with the airport noise curfew.

Dr. Preacher called attention to the Curtis family's legal bill I'of approximately $20,000 incurred for consultant services and f
asked the city to make a donation to them in support of their
efforts .
Vice Mayor Mikes suggested the City Manager look for four or
five thousand dollars, maybe in the contingency fund, to assist
and support the Curtis ' work in Dania and collection of the
data, done by a qualified expert, that the city will need in a
year or two.
11 . ADMINISTRATIVE REPORTS

11 . 1. 1 Hurricane Awareness Presentation
Lt . Mike Goldstein commented on preparatory plans for
the approaching hurricane season and announced the
Hurricane Awareness Presentation to be presented at the
Dania City Hall Commission Chambers by the Broward
Sheriff 's Office and Southern Bell in cooperation with
the City of Dania on June 1 , 1989, at 7: 30
again on June 2, 1989, at 2:00 p.m. p.m. and

11. 1 . 2 City Manager Flatley asked for approval of a letter,
prepared per the May 22nd workshop, to Henry Cooke,
County Engineering, recommending that the County drop
the project to improve the intersection of U.S. 1 and SE I
2nd St. and also requesting resynchronization of the
traffic light.

A motion was made by Commissioner Bertino, seconded by
Commissioner Cook to authorize the City Manager to
forward the letter. The motion passed unanimously.

12. 3 Commissioner Grace yielded her time to Bill Griffin. Mr.
Griffin complained about MEBA's garbage disposal system and the
location of their dumpsters .
*** 12.4 Vice Mayor Mikes suggested action be taken on agenda item 9. 1 .
I Vice Mayor Mikes said he will have a report on the A-1-A bridge
proposal after Friday's committee meeting.
j12. 5 Mayor McElyea yielded his time to Kurt Ely. Mr. Ely explained
his reasons for declining appointment to the Downtown
Redevelopment Agency in order that Jim Kocourek might be
reappointed.
**** A motion was made by Vice Mayor Mikes , seconded by Commissioner
s Cook to reconsider agenda item 8. 2. The motion passed
unanimously.
