A motion was made by Commissioner Hirsch, seconded by 1

Public Works Director, Herbert Lund, presented
meritorious achievement awards to two city cemetery 1°
employees, Johnny Wyche and Alonzo Sam, in recognition
of their idea which resulted in saving the city the
considerable cost of a new casket lowering device.
* At this time Vice Mayor Cook announced the withdrawal of agenda item
7. 1 and the continuance of agenda item 4. 2.

Resolutions
1. 2 The title of a resolution finding, pursuant to F.S. 163, that
there is a need for a community redevelopment agency to function
in the City of Dania and further authorizing the creation of a
j community redevelopment agency, a public body to be known as the
"Downtown Redevelopment Agency" was read by City Attorney Adler.
Ordinances (First Reading Only)
1. 3 The title of an ordinance relating to and creating the "Downtown
Redevelopment Agency" was read for first reading by City
Attorney Adler.
1. 4 The title of an ordinance amending Chapter 3, Article II of the
Code of Ordinances by adding Section 3. 39 to be entitled "Signs
in the Downtown Dania Redevelopment District" was read for first

Ricki Tannen, representing the petitioner, explained the request
to rezone Lot 6 to bring it into conformity with the land use.
Regarding the P&z Board 's recommendation of approval subject to
submission of a conceptual site plan, City Planner Leeds
explained that this is an existing home, a site plan is not
necessary, and recommended approval of the rezoning.
Vice Mayor Cook opened the public hearing . Hearing no one speak
in favor or opposition, the Vice Mayor closed the public
hearing.
A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to adopt the rezoning ordinance (R2-13-88 )
on second and final reading. The motion passed on the following
roll call vote:

* A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to continue the second and final reading of
the ordinance approving the plat of "Stirling Road/Hawthorne
,. y; Plat" (PL-14-88 ) until the next regular meeting of April 12,
1988. The motion passed on the following roll call vote:

Administrative Ordinances (second and final reading)
4.3 The title of an ordinance amending Section 2. 4 of the Code of
Ordinances by amending the existing Civil Service rules in their
entirety by setting forth the principles and procedures that are
to be followed by the City of Dania in its personnel program;
providing for exceptions to the personnel covered by Civil
Service; providing for a Civil Service Board; providing for a
classification and compensation plan; providing for a separation
! and disciplinary action; providing for a grievance procedure;
and providing for an appeal procedure was read for second and
final reading by City Attorney Adler. (continued from 3/8/88)
Vice Mayor Cook opened the public hearing. Gloria Daly,
Chairman of the Civil Service Board, Vinson Marlin, alternate
member of the Board, Matthew Mierzwa , of Kaplan Sicking & Bloom,
Legal Counsel cc the Dania Firefighters, Harvey Darcy, new
member of the Civil Service Board and Anita Serpe all spoke in
favor of passing the new rules as written. Michael Smith,
Personnel Director, spoke in opposition to permitting employees
to serve on the Civil. Service Board and expressed objections to
giving the Board the right to modify decisions via the
mitigation clause. Hearing arguments for and against, the Vice I
Mayor closed the public hearing. i

In response to inquiry by Vice Mayor Cook, City Attorney Adler
advised that if the ordinance is passed adopting the rules in
their entirety, the Commission can amend the ordinance at any
time .

During discussion, it was suggested that, in the interests of
fairness , language might be inserted to give the city or the
grieving employee the right to ask a potentially biased board
member to disqualify himself and be replaced by an alternate.
City Attorney Adler also said he would check into whether or not
the city has the right to appeal a civil service board hearing.

Responding to Commissioner Bertino 's question regarding why
civil service should be necessary at all when the employees have
excellent union and grievance i

Commissioner McElyea, to amend the first motion to exclude the

City Manager Jewell reported that Mr. Forman was unable to
attend this meeting and that Mr. Day is a prospective tenant at
Harbour Towne . He explained that the original site plan was for
a retail shop and a new Tugboat Annie 's and that they no longer
want to build a new Tugboat Annie 's and instead plan to renovate
the existing Tugboat Annie 's and build the retail store where
the new Tugboat Annie 's was to be located .
Commissioner Hirsch asked about the terms of the lease and said
he would rather wait for Mr. Forman to address the Commission.
Commissioner McElyea expressed concerns regarding the Civic
Center.
A motion was made by Commissioner Bertino, seconded by
Commissioner Hirsch to continue this item until the next regular
meeting of April 12, 1988. The motion passed on the following
roll call vote:

10. CITIZENS ' COMMENTS
10. 1 Request by Kathy Kelly from Ocean Waterway Mobile Home Park for
information from the City regarding the Michael Thomas
situation.

Kathy Kelly, having received new information earlier in the day,
elected to pass on the discussion at this time.
i Al Spies commended City Manager Jewell on his professionalism in
i providing the group with very important information and thanked
Commissioner Hirsch for his assistance.

11. ADMINISTRATIVE REPORTS
11. 1 City Manager Jewell commented on the fairness of having employee
members on the Civil Service Board and posed a question on
fairness if he wanted to have two department heads on the Board.
11 . 2 City Attorney - no comment.
12. COMMISSION COMMENT
12. 1 Commissioner Bertino commented on variances granted in the past
in flex zones and business and industrial properties with regard
to reviewing and revoking those that have not begun or made any
progress in a year.

City Manager Jewell reported that the list is almost complete
and will be distributed to the Commission shortly.
I 12. 2 Commissioner Hirsch wished Mayor Byrd the best regarding his
surgery next week.
12. 3 Commissioner McElyea commented on Public Works Director Lund and
Chief Mechanic Mike Harris submitting the winning bid for an �
engine analyzer.
