Byrd A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to excuse Vice Mayor Byrd, being honored as a Pioneer of Broward County this evening. The motion passed unanimously. -. At this time, Mayor Bertino announced, for the benefit of the members of the audience interested in the request for vacation of an alleyway that was denied at the previous Commission meeting, that the item cannot be tir brought up at this Commission meeting, but, rather, would have to go through the process once again of going to Planning & Zoning before coming again to the Commission, and noted that there are no time limitations for that to be done. I. Gatto, was read for first reading by City Attorney Adler. Building & Zoning Ordinances (First Reading) 1.5 RZ-01-87 - Rezoning request - Petitioner/Owner: Jonathan J. Carter; property located at NW 1 St. & NW 7 Ave. The title of an ordinance rezoning Lot 21 & 24, Block 30 of 'The Town of Modello' from RD 6000 to C-2 Zoning classification was i read for first reading by City Attorney Adler. i A motion was made by Commissioner Cook, seconded by Commissioner Hirsch to approve the consent agenda. The motion passed on the following roll call vote : Commissioner Cook-yes Commissioner McElyea-yes Commissioner Hirsch-yes Mayor Bertino-yes I 2. PROCLAMATIONS 2. 1 Mayor Bertino proclaimed February 26, 1987, Human Rights for Soviet Jewry Day. III ( Regular Commission Meeting 1 j February 10, 1987 I 1 2. 2 Mayor Bertino proclaimed February 22-28, 1987, National Engineers ' Week. * RESOLUTION (Additional Item) i Mayor Bertino read a Resolution expressing congratulations and best f wishes to Clark and Louise Russell upon their fiftieth wedding anniversary. # E A motion was made by Commissioner Hirsch, seconded by Commissioner MCElyea to adopt the resolution. The motion passed unanimously. 3. BIDS - none 4. PUBLIC HEARINGS AND OTHER RELATED MATTERS - none 5. SITE PLAN REQUESTS - none 6. EXPENDITURE REQUESTS - none 7. SPECIAL REQUESTS 7. 1 Request by John A. Bond to file petition to vacate Shull Road and to waive replatting procedures . (Continued from 1/27/87) Bob McLaughlin of McLaughlin Engineering, representing the petitioner, explained that Shull Road was cut off by the realignment of US-1, and the petitioner wishes to file petitions with the City of Dania to vacate the southern portion of Shull Rd. and the County to vacate the northern portion of Shull Rd. j City Attorney Adler reported that the right-of-way is owned by the County, not the City. Mr. McLaughlin explained that the County will not process any vacation request without a resolution from the unit local government having jurisdiction. Upon City Attorney Adler's advice, Mr. McLaughlin said he would furnish the County 's ordinance stating what has to be done . A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to refer the vacation request to the P&2 -a Board. The motion passed unanimously. 7. 2 Request by Broward County to waive replatting procedures and filing fee for the vacation of four parcels lying within the City of Dania. (Continued from 1/27/87 ) City Manager Jewell reported that the original request was for five parcels but, due to a problem with the legal on the Taylor Rd. parcel, the County is now requesting the vacation of the other four parcels, and having been reviewed by the City Attorney, City Engineers and himself, he recommended approval. Jeffrey Siniawsky, Assistant General Counsel, stepped forward and mentioned that one of the parcels is Shull Rd. and explained that they have fee title and are asking the City to vacate any city rights-of-way underneath that parcel and will be making the same request of the County Commission. City Attorney Adler noted that these are all lands within the airport property. Ik i Mr. Siniawsky asked that the Commission waive replatting procedures and filing fee for the vacation of the four parcels and stated that the legal description for the fifth parcel will { be provided in time for the next Commission meeting. He said l the parcels show up on some maps as being thoroughfares and they are seeking vacation of the rights-of-way involved as a prelude L to granting a new right-of-way to the Florida East Coast Railroad as part of the airport expansion project. 1 i Regular Commission Meeting 2 February 10, 1987 jI i After discussion of the public rights-of-way, the Commissioners expressed the desire to review the legal descriptions and area ' location maps. I i A motion was made by Commissioner Cook, seconded by Commissioner McElyea to continue this item until the next regular meeting scheduled for February 24, 1987. The motion passed unanimously. t 8. ADMINISTRATIVE REPORTS 11 . 1 City Manager Jewell requested an executive session as soon as possible. 11. 2 City Attorney Adler - no comment. - 12. COMMISSION COMMENT t f J 12. 1 Commissioner Cook deferred her time to Gloria Daly, who t� commented on the need to workshop the civil service rules revisions proposed by the Civil Service Board in September of last year. i City Manager Jewell was asked to arrange a workshop date and } time with the Commission and Civil Service Board. i Commissioner Cook commented on problems in the southeast section of the city and asked City Manager Jewell to review the situation. 12. 2 Commissioner Hirsch - no comment. 12.3 Commissioner McElyea asked the City Manager to check into getting the County to resurface Old Griffin Rd. He also asked City Manager Jewell to check on the drainage situation on SW 2nd Ave. between 4th & 5th Streets. 12.4 Vice Mayor Byrd - absent. 12. 5 Mayor Bertino inquired about the completion date for 5th St. City Manager Jewell estimated the end of March.
