Byrd Commissioners : Jean Cook Howard Hirsch City Attorney: Frank Adler City Manager: Eugene Jewell City Clerk : Wanda Mullikin Police Chief: Gilbert Thivener Building Official : Paul Maxwell Absent - Commissioner: Charles McElyea A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to excuse Commissioner McElyea who is ill in the hospital . The motion passed unanimously . The Commissioners all wished Commissioner McElyea a speedy recovery. �+ PRESENTATION by the Housing Authority regarding recent funding award . * (Addressed after agenda item 4 .1 ) ,r- f Members of the Dania Housing Authority thanked the Commission and Administration for their support and backing resulting in the receipt of 41 additional units of housing to service low and moderate income citizens in Dania and announced that the actual grant award of $245 ,100 was the largest certificate allotment received countywide. 1 . CONSENT AGENDA 42� Minutes 1 .1 October 14 , 1986 , Regular Meeting. Administrative Ordinances (First Reading) ADDENDUM ITEM: 1 .2 The title of an ordinance annexing to the City of Dania certain properties described as the N 1/2 of Lot 2 , Palmeador Half Acres No. 2 was read for first reading by City Attorney Adler. A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to approve the consent agenda. The motion passed on the following roll call vote: Commissioner Cook-yes Vice Mayor Byrd-yes Commissioner Hirsch-yes Mayor Bertino-yes 2 . PROCLAMATIONS - none ** (At this time , agenda item 4 . 1 was addressed. ) 3 . BIDS - (8 : 15 p.m. ) 3 .1 Receipt of bids for "SE 5th Avenue Roadway Construction" *** (Addressed at 8 : 15 , interrupting agenda item 4 . 1 ) A motion was made by Commissioner Hirsch, seconded by Vice Mayor i L Byrd to close the time for receipt of bids . The motion passed unanimously. i Regular Commission Meeting 1 October 28 , 1986 I i **** (Addressed after Presentation by Housing Authority) City Manager Jewell opened and read the sealed bids received from All Rite Engineering Contractors of Davie, $465 ,423 .30 with bid bond attached; and Williams Paving Co. in Miami , $481 ,838 .70 with bid bond attached . i A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to remand the bids to the City Manager for review and recommendation at the next regular meeting of November 11 , 1986 . PUBLIC HEARINGS AND OTHER RELATED MATTERS f BUILDING & ZONING I t ** 4 .1 Petitioner: American International Rent-A-Car; Owner: Arael I Medina; property located at 222 N. Federal Hwy, Unit C. PUBLIC HEARING - VA-60-86 - Variance request to operate a r a C-3 zoning district. rent-a-car facility in Regis Reasbeck, Attorney representing the petitioner and owner, stepped forward to request a variance, necessitated by the airport expansion program, to operate a rental car agency at the location of what is now known as Alex Flamingo Grove. The P&Z Board made no recommendation , there being a two to two vote. i I� Mayor Bertino opened the public hearing. Kurt Ely spoke in opposition, commenting on the availability of appropriate C-4 zoned property and noting that the rental car agency was already I operating in code violation. Hearing Bob Mikes speak in opposition to allowing the airport servicing businesses to move into the community servicing business area, the Mayor closed the public hearing. Building Official Maxwell reported that they did operate a car rental facility without an occupational license , had rental vehicles on the site, and , after being cited by the Code Enforcement Board, they applied for and received an occupational license for office use only. They were advised that a variance :Y•a/' was needed to permit rental vehicles on the site and that only five vehicular spaces were available. Mr. Maxwell stated that the Code Enforcement Board hearing was postponed until after this variance is either approved or denied. Mr. Reasbeck , explaining that when he prepared the lease he did not realize that a rental car agency was not permitted in that zoning, claimed responsibility for the misunderstanding. Ralph Mizrahi , Vice President of American International Rent-A-Car, apologized for the oversight in not realizing that they needed to apply to the City of Dania for a new occupational license when they moved the facility the short distance southward, and said that no disrespect intended. to the City of Dania was I *** (At this time, 8 :15 p.m. , time for receipt of bids was closed. ) Mayor Bertino reopened the public hearing . Hearing Mr. Ely claim that the red tag was ignored by the applicant , and hearing Mr. Mizrahi dispute the claim, the Mayor closed the public i hearing. The Commissioners discussed the availability of C-4 zoned property and the inadvisability of opening a floodgate of variances for C-3 . ? IA motion was made by Commissioner Hirsch to deny the variance I request. The motion died for lack of a second. i Regular Commission Meeting 2 October 28 , 1986 i Following further Commission discussion concerning po ssible variance abuses , Mayor Bertino passed the gavel and made a motion to deny the variance . The motion was seconded by Commissioner Hirsch. After a confused roll call vote , clarification of the motion , and revoting , the motion to deny the variance (VA-60-86 ) passed on the following roll call vote: Commissioner Cook--yes Vice Mayor Byrd-yes Commissioner Hirsch-yes Mayor Bertino-yes f * (At this time the Presentation by the Housing Authority was heard. ) 4 .2 Petitioner/Owner: Helen Tanis; prop. located at 313 NE 2nd Ave. PUBLIC HEARING - VA-65-86 - Variance request to replace existing water and electrical lines external from house to dock across 2nd Avenue . Helen Tanis stepped forward to explain the request to replace the lines to her boat dock across the street, which were damaged during extensive remodeling of her house. the public hearing. In response to Bob Mayor Bertino opened Mikes' question, the petitioner said that no electric meter will be installed on the dock . Hearing no one speak in favor or opposition, the Mayor closed the public hearing. A motion was made by Commissioner Cook, seconded by Vice Mayor Byrd to grant the variance (VA-65-86 ) . The motion passed ,. unanimously. i 4 .3 Petitioner/Owner: Bryan Oaks Partnership; prop. located west of Bryan Rd. , north of Tigertail Blvd . PUBLIC HEARING PL-66-86 - Plat Approval request for "Dania Office Park" (containing 18 .42+ acres ) The title of an ordinance approving the plat of "Dania Office Park" was read for second and final reading by City Attorney Adler. Linda Strutt, Planner with Williams, Hatfield and Stoner, explained the request for perimeter plat approval . Mayor Bertino opened the public hearing. Hearing no one speak in favor or opposition, the Mayor closed the public hearing. i A motion was made by Commissioner Cook, seconded by Vice Mayor Byrd to adopt the ordinance on second and final reading . The motion passed on the following roll call vote: Commissioner Cook-yes Vice Mayor Byrd-yes Commissioner Hirsch-yes Mayor Bertino-yes 4 .4 Petitioner: E.T. Legg & Associates , Inc. ; Owner: Westwind Contracting, Inc . ; property located at 4160 Ravenswood Rd . PUBLIC HEARING VA-67-86 - Variance request to relocate an existing DILL wacu , - condemned by I-595 right-of-way, to a new location at 4160 Ravenswood Rd. Bill Hess , representing the petitioner, stepped forward to i explain that the request is to relocate an existing sign to property zoned heavy industrial and described the sign. The P&Z ; Board recommended approval. } . Mayor Bertino opened the public hearing. Bob Mikes spoke in opposition to billboards in general , and especially to granting variances for billboards that don' t advertise Dania business. Regular Commission Meeting 3 October 28 , 1986 The pleasant appearance of the sign and landscaping was pointed out by Mr. Hess, and he gave assurances that approximately twelve billboards will be removed from the area of State Road 84 to the Dania Cut-Off Canal because of State regulations. Hearing Bob Mikes suggest at least placing limits on the variance, the Mayor closed the public hearing . Building Official Maxwell reported that the size of the sign is to remain the same as it was , 48 ' x 141 . A motion was made by Commissioner Cook, seconded by Vice Mayor Byrd to grant the variance (VA-67-86 ) , with the provision that the size of the sign is not to exceed 48 ' x 14 ' , and further, that it must be landscaped to meet building department requirements and that the landscaping must he maintained or the variance will be revisited immediately. The motion passed unanimously. 4 .5 Petitioner/Owner: Michael L. Thomas; property located at 280 Bryan Rd . PUBLIC BEARING LU-41-86 - Land Use Plan Amendment request to amend the certified land use from low (5 ) residential and low (10 ) residential to commercial . Richard Brooks, Architect-Planner, presented a conceptual site plan and described the "office barges" . Mayor Bertino opened the public hearing. Hearing no one speak in favor or opposition, the Mayor closed the public hearing . In response to Mayor Bertino' s assumption that there will be no floating offices, and every structure will be on dry land or pilings , Michael Thomas stepped forward to state that it has not been firmly established that there will be no floating elements, but that , whether floating or on piling, it will fully conform to City of Dania building standards . Noting that the question is not pertinent to this particular land use amendment request, Building Official Maxwell commented that when a site plan is brought back for approval , he would .A• =P' prefer to see it on piling rather than floating. A motion was made by Commissioner Hirsch , seconded by Commissioner Cook to approve the land use plan amendment (LU-41-86 ) to change from low (5 ) residential and low (10 ) residential to commercial . The motion passed unanimously. ADMINISTRATIVE ORDINANCES (Second & Final Reading) 4 .6 An ordinance amending Section 22-5 of the 1980 Code of Ordinances entitled "Pavement, Improvement and Use of Drainage Swales" by adding a subsection (I ) thereto prohibiting the placement of objects in swale areas within the public right-of-way of streets, or other public rights-of-way owned or controlled by the City of. Dania. AND 4 .7 An ordinance amending Sections 13 .68 and 13 .69 of Article IV, Chapter 13 of the 1980 Code of Ordinances entitled "Garbage and Trash" , to amend the definition of "small business" and to amend the services and charges for services provided by the City. City Manager Jewell requested that items 4 .6 and 4 .7 be continued until the next meeting so that some changes can be made before second and final reading. L Regular Commission Meeting 4 October 28 , 1986 Commissioner Cook called for a workshop and an attorney representing Seacoast Sanitation seconded the request for a workshop to have the opportunity to work with the Commission on the trash ordinance . i A motion was made by Vice Mayor Byrd, seconded by Commissioner j Cook to continue the second and final reading of the ordinances j contained in agenda items 4 .6 and 4 .7 until the next regular meeting of November 11 , 1986 , and to workshop both items in the interim. The motion passed 3-1 , with Commissioner Hirsch voting no. It was generally agreed that when a workshop date is i decided upon, the City Manager is to notify the Commissioners , Seacoast Sanitation and any other interested parties . 5 . SITE PLAN REQUESTS - none 6 . EXPENDITURE REQUESTS - none i 7 . SPECIAL REQUESTS - none 8 . APPOINTMENTS - none I 9 . DISCUSSION { ADDENDUM ITEM: j 9 .1 Discussion of recreational impact fees. Mayor Bertino Mayor Bertino described the excellent efforts of local civic organizations as well as the city' s recreational department in providing recreational activities for the youth and adults of I the City of Dania . He said that the city is spending approximately $425 ,000 per year on recreation, and yet more C needs to be done . Mayor Bertino suggested that at the rapid ! '" rate the city is growing, an impact fee on new construction for recreational purposes should be considered. City Attorney Adler was instructed to prepare an ordinance ' addressing an impact fee for recreational purposes to be workshopped as soon as possible. A member of the Dania Optimist Club expressed appreciation to the City Commission for its help and encouragement, described several outstanding achievements of the Optimist Club, and spoke in support of Mayor Bertino' s suggestion. 10. CITIZENS' COMMENTS No verbal or written requests for Citizens' Comments for this night' s meeting were received. j 11 . COMMISSION COMMENT i 12 . 1 Commissioner Cook announced that the traffic light at 5th Ave. and Sheridan St . is now on . Commissioner Cook commented on problems regarding young men j swimming in the canal at NW 14th Way. City Manager Jewell said 1 he would follow up on that , noting that a parcel of property 1 there belongs to the County. 12 .2 Commissioner Hirsch - no comment . `^ 12 .3 Commissioner McElyea - absent . j 5 October 28 , 1986 Regular Commission Meeting 1 12.4 Vice Mayor Byrd asked the City Clerk or City Manager to poll the Dania Industrial Advisory Board members to see whether there is a full complement of members. He stressed the need for that I Board to meet regularly. Vice Mayor Byrd commented on progress regarding a fair share of Tourist Development dollars for Dania and asked that this be placed on the next workshop agenda for discussion. Vice Mayor Byrd also asked that an ordinance declaring Martin Luther King, Jr. ' s birthday a legal holiday be considered. He asked City Attorney Adler to have the ordinance ready for the next regular meeting.
