BIDS 3. 1 Receipt of bids for the Demucking of Two (2 ) Pads, approximately 1900 sq . ft . each . (Closing 8 : 15 p .m. ) A motion was made by Commissioner Hirsch, seconded by Commissioner Cook to close the time for receipt of bids . The motion passed unanimously . Acting City Manager Mullikin advised the Commission that only one bid was received . She explained that this bid is connected with the Project IMPAC Grant and that this is the second time it has been advertised for bid due to the wait for prevailing wage scale information from the County . A motion was made by Commissioner Cook, seconded by Commissioner McElyea to direct Acting City Manager Mullikin to open the bid . The motion I passed unanimously . Acting City Manager Mullikin opened and read the sealed bid ? i received from Butch ' s Trucking & Equip . Inc ., 4510 SW 30 St . , Hollywood, F1 . in the amount of $9, 695 .00. A motion was made by Vice Mayor Byrd, seconded by Commissioner Cook to remand the bid to the City Manager for recommendation at � the next regular meeting of July 22, 1986. The motion passed 4-1, Commissioner Hirsch opposing . i Regular Commission Meeting 2 July 8, 1986 f a 3. 2 Request to advertise for bids for Paving Project at Dania Beach & waive the posting of the performance bond . Acting City Manager Mullikin explained that the Commission is empowered by State Statute to waive the performance bond for this particular project since it is a small job, and for expediency purposes, she requested permission to advertise for bids for the paving and restriping at Dania Beach, waiving the posting of the performance bond . i A motion was made by Commissioner Cook, seconded by Commissioner McElyea to authorize the City Manager to advertise for bids for k the Paving Project at Dania Beach and to waive the posting of the performance bond . DISCUSSION $' 9. 1 Consideration and possible action regarding Ordinance enacting ` new provisions for the collection of Parking Fees for Dania ° Beach . The title of an ordinance repealing Sections 6-32, 6-33, 6-33. 1, 6-34, 6-35, 6-37, 6-38 and 6-39 of Chapter 6 of the 1980 Code of Ordinances of the City of Dania , and enacting new provisions for the collection of parking fees for Dania Beach was read for first reading by Mayor Bertino . City Attorney Adler described the revisions made to the old beach parking ordinance, explaining that he had removed the 4 references to parking gates, and that he left in the provisions for $ . 50/hour parking fees and $5 . 00 permit ( sticker) fees for citizens of Dania, removing the excess language relating to t permit fe00)for senior citizens of Dania since the fee was the During discussion, City Attorney Adler asked for direction regarding the fees, whether or not to increase the $5.00 permit fee, whether or not to offer any discount to Dania senior citizens, and what evidence of residency to require . A motion was made by Vice Mayor Byrd, seconded by Commissioner Hirsch to direct the City Manager to make a recommendation and hold a workshop on the matter . After City Attorney Adler advised that the old ordinance contained references to parking gates that the courts declared unconstitutional , the motion and 1 spcnnd wprp withdrawn . i Commissioner McElyea commented on the paragraph providing that any veteran of the U .S .A. classified as disabled by the V.A . shall be issued a free parking permit, and questioned whether it should specify that the disabled veteran be a Dania resident . After further discussion, he agreed that the disabled veteran j I' need not be a Dania resident . L Commissioner McElyea commented on the paragraph providing that no duplicates be issued for lost or stolen stickers, expressing Regular Commission Meeting 3 July 8, 1986 rt - _1 i f the feeling that if a citizen could prove that he had one, a duplicate should be issued . After discussion, it was agreed that it should be left to the City Manager ' s discretion . A motion was made by Commissioner Cook, seconded by Commissioner McElyea to adopt the ordinance on first reading and direct the City Attorney to change paragraph ( e ) of Sec. 6-33 to reflect that duplicate parking stickers will be issued for lost or stolen parking stickers at the discretion of the City Manager and that paragraph (c ) of Sec . 6-33 refer to all disabled veterans of the U .S .A. During discussion of the motion, Vice Mayor Byrd stated that he was not opposed to the ordinance, but again recommended that the Commission first get a recommendation from the City Manager and j then proceed with Commission input . The motion to pass on first reading and make specified changes to the ordinance before second reading passed on the following roll call vote : Commissioner Cook -yes Vice Mayor Byrd-no Commissioner Hirsch-yes Mayor Bertino-yes { Commissioner McElyea-yes 10. CITIZENS ' COMMENTS i 10. 1 Request by Mr . Paul Piccirillo for Commission direction on performance bond on dredge and fill project on Stirling Rd . & 12th Ave . Paul Piccirillo stepped forward to explain that , although the Commission approved his dredge and fill operation back on December 17th, he has been unable to provide the $410, 000 surety bond called for in the agreement . He read a quotation from the ordinance recently adopted by the Commission regarding excavation performance bonds and requested that the City accept the deed to the property as a sign of good faith . City Attorney Adler advised Mr . Piccirillo that the land can be put up as collateral for the performance bond but that he still needs to submit the signed performance bond . As Mr . Piccirillo s ^� did not fully understand what was required , City Attorney Adler explained that the performance bond could be defined as a written pledge to fulfill the obligations pertaining to the excavation project and the mortgage deed and note as the collateral to ensure the performance of that pledge or bond . During discussion of this item, Commissioner McElyea asked Building Official Maxwell to investigate and report on the status of similar excavation projects currently going on re proper performance bonds in place . 11 . ADMINISTRATIVE REPORTS 11 . 1 Acting City Manager Mullikin reported that the FEC crossing at NW 1st St . has been repaired, and that the Beach Blvd . crossing will be closed on July 14th - July 16th for repairs . She also reported that the U. S . 1 Landscaping Protect for Downtown Redevelopment has been advertised for receipt of bids at the July 22nd Regular Commission Meeting . She then requested an all -day workshop be scheduled for review r of the 1986-87 budget . The workshop was set for Monday, July 14, 1986, at 9 : 00 a .m . Acting City Manager Mullikin was asked to make sure City Manager Jewell would be able to attend the budget workshop and, if not , to notify the Commissioners and reschedule the workshop for the 17th . Regular Commission Meeting 4 July 8, 1986 11 .2 City Attorney Adler asked for Commission direction regarding a problem with a construction shed in the southeast part of the city . Commissioner Hirsch said he would like to have the trailer removed and an ordinance drawn up restricting the size of a trailer on a residential lot . In response to a request for an opinion re the legality of having the construction trailer removed, City Attorney Adler said that it is in violation of the zoning code since it is not a permitted use under single-family residential zoning . Building Official Maxwell stated that as a general course, a 60-day temporary permit is issued on construction trailers, with no size restrictions, and that there is no clear definition of "construction trailer ." During discussion , the Commissioners agreed that the trailer, mammoth in size, carpeted , and with sliding doors, carries the appearance of a sales office rather than a construction trailer. A motion was made by Commissioner Hirsch, seconded by Commissioner McElyea to instruct the City Building Official to revoke the trailer license and to instruct the City Attorney to write the appropriate letter and to further instruct the City 1 Attorney to prepare an ordinance providing for the issuance of construction trailer permits, setting the fees, defining construction trailers, and restricting the size to 8 ' x12 ' in a single-family residential area . The motion passed unanimously . 12. COMMISSION COMMENT i 12 . 1 Commissioner Cook asked about the progress of the light at ` Sheridan and 5th Ave . Acting City Manager Mullikin reported that the contract for the installation was signed this day and said she would check the contract and get back to Commissioner Cook with the estimated completion date . 12 .2 Commissioner Hirsch asked City Clerk Mullikin to contact the new accountants with reference to two year projections on the ad valorem tax base . Commissioner Hirsch commented that he had referred a question regarding the hospitalization plan brought up by a member of the Fire Dept . to City Clerk Mullikin . He then asked City Clerk Mullikin to investigate the plan ' s coverage in this particular case and report on it . Commissioner Hirsch asked Acting City Manager Mullikin about the i whereabouts of the City Work Crews for the past two weeks . 12 . 3 Commissioner McElyea commented that the City Work Crews have been on the West Side working on the Community Development Project . Vice Mayor Byrd reported on the progress of the housing project . � t 12. 5 Mayor Bertino commented on a letter received from Code Enforcement Board Attorney, Kathy Molchan, regarding a problem i with one of the board appointments . It was agreed that a Special Meeting be set immediately I following the Budget Workshop scheduled for Monday, July 14th, to address the Code Enforcement Board appointment . Regular Commission Meeting 5 July 8, 1986 i \ 1 Mayor Bertino announced that Reverend Van Arsdale is planning to leave the Community and commented on his excellent work in the past as the Police and Fire Chaplain . Mayor Bertino requested City Attorney Adler to look into revising the code of ordinances to put a square footage minimum for rental apartment construction .
