An ordinance amending the City' s Certified Land Use Plan Map
from Commercial to Residential 25 on a parcel of land bounded
on the N by a line approx. 600 ' N/o and parallel to Sheridan
St . , the S by Sheridan St. , the E by No. Dixie Hwy. and the W
by the city limits of the City of Hollywood was read for first
reading by City Attorney Adler.
1 . 11 ( RZ-70-85 ) A rezoning request from C-3 (Commercial ) to RM-2
(Residential ) . Petitioner/Owner: Henry Graham for Liberia
Economic and Social Development, Inc. Property located at 8
Liberty Terrace.
An ordinance rezoning Lots 1-20 , Blk. 1 ; Lots 1-7 , Blk. 3 ; Lots
4-9 , Blk. 2; and all of Blk. 4 , of Liberty Heights from C-3 to
RM-2 zoning classification was read for first reading by City
Attorney Adler.
A motion was made by Commissioner Cook , seconded by Vice Mayor Byrd
to approve the consent agenda with the exception of item 1 .5 . The
motion passed on the following roll call vote:

1 .5 An ordinance amending Section 5. 22 of Article 5 , of. Chapter 28 ,
of the City Code of Ordinances to provide changes in height
regulations was read for first reading by City Attorney Adler.
Vice Mayor Byrd spoke in opposition to the proposed changes to
the present height ordinance.
A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to adopt the ordinance to provide changes
in height regulations on first reading. The motion passed on
the following roll call vote:

Roxanne Knight stepped forward to present a "Welcome Back"

4 .1 (LU-43-85) - A Land Use Plan Amendment to amend the Dania Land E
Use Plan from Commercial to Irregular Residential (49 dwelling
units per acre) ; Petitioner/Owner - Wilson C. Atkinson , III ,
Trustee. Property located at approximately 351 Sheridan St .
between SE 2nd Ave. and SE 5th Ave.

An ordinance amending the City' s Certified Land Use Plan Map
from Commercial to Irregular (49 ) Residential , on a parcel of
land containing 4 .9507 acres+, legally described as the E 1/2
of the SE 1/4 of the SW 1/4 of the SE 1/4 of Section 3 ,
Township 51 South, Range 42 East, less the South 50 feet
thereof, was read for second and final reading by City Attorney
Adler.
Mr. Atkinson stepped forward to request that the ordinance be
passed subject to recertification at the Broward County
Planning Council level .
Mayor Bertino opened the public hearing. Hearing Mr. Atkinson
respond to questions raised by Gloria Daly regarding an
alternate plan in the event the A.C .L. F . failed , the Mayor
closed the public hearing.
A motion was made by Commissioner Cook , seconded by
Commissioner Hirsch to adopt the ordinance amending the Dania
Land Use Plan (LU-43-85) on second and final reading , subject
to recertification by the Broward County Planning Council. The i
motion passed on the following roll call vote:

Variance Requests
4 .2 (VA-46-85) - A Variance Request in a RD 6000 Duplex district to
construct a 6 ' wooden fence (4 ' fence allowed) in front and
street side setback area; Petitioner/Owner: Clifford Iacino;
located at 830 NW 13th Ave. w
The petitioner/owner was not in attendance. Building Official
Maxwell reported that Mr. Iacino requested the variance request
be withdrawn.
A motion was made by Commissioner Hirsch , seconded by
Commissioner McElyea to withdraw variance request VA-46-85 at
the petitioner' s request. The motion passed unanimously.

9 .1 Appointment of Voting Delegate for the Florida League of Cities
59th Annual Convention, held at the Diplomat Hotel October
10-12th 1985 . (Continued from 8/27/85 )
A motion was made by Commissioner Cook, seconded by
Commissioner Hirsch to appoint Mayor Bertino as Voting Delegate
for the Florida League of Cities . The motion passed

unanimously.

A motion was made by Commissioner Cook, seconded by
Commissioner Hirsch to appoint Vice Mayor Byrd as Alternate j
Voting Delegate for the Florida League of Cities . Vice Mayor
Byrd declined the appointment as he expects to be out of town
on the date of the Convention and the motion and second were
withdrawn.
A motion was then made by Vice Mayor Byrd, seconded by rf
j Commissioner McElyea to appoint Commissioner Cook as Alternate I
Voting Delegate for the Florida League of Cities . The motion f
passed unanimously.

9 .2 Discussion and possible action regarding the status of Acting
Fire Chief Thomas Grammer.
A motion was made by Commissioner Cook, seconded by

Commissioner Hirsch to adopt a resolution appointing Thomas
Grammer Fire Chief .

During discussion of the motion, City Attorney Adler read the ,
title of the resolution appointing Thomas Grammer Fire Chief at
j an annual salary of $43 ,014 .40 . The motion passed on the

10 . DISCUSSION
10 .1 Discussion and possible action on vacation of that portion of
Park Row (now known as SW 2nd Terrace) ; that portion of Pine
St. (now known as SW 2nd P1. ) . (Continued from 8/27/85 )
Mayor Bertino announced that more time is needed by the City
Attorney and City Manager to consider the vacation of the
property commonly known as Mullikin Park.
A motion was made by Commissioner Hirsch , seconded by
Commissioner McElyea to continue this item until the next
regular Commission meeting of - eptember 24 , 1985 . The motion

10 .2 Reconsideration of vote denying Variance Request VA-45-85 on
8/27/85 . Commissioner Hirsch. A Variance Request to construct
a 100 sq. ft. off-site pole sign ( 50 sq. ft. on-site sign
allowed) on a parcel which currently contains one existing pole
sign; Petitioner: Marine Conventions, Inc. ; Owner: George
Filipi; located at 167 N . Federal Hwy. on the SE corner of Fed.
Hwy. and NW 2nd St. i

Commissioner Hirsch explained that, being on the prevailing
side of the vote to deny, he exercised his right to reagenda
because the vote was gotten so quickly the petitioner did not
have the opportunity to state that he would be interested in a
50 sq. ft. sign.
Mayor Bertino, indicating interest shown on the part of the
citizenry, and having the consent of his fellow Commissioners,
announced his intention to open a public hearing on the matter.
Peter Colaianni , representing Marine Conversions , Inc. , stepped
forward to state the reasons for the original petition ,
explaining that there is already a pole sign, belonging to Mr.
Filipi , on the SE corner of the off-site location and they
proposed to place the sign on the opposite side of the
property. They had requested a 100 sq. ft. sign to identify
the Harbour Towne Marina project (a joint venture in which the
City of Dania is a partner) and the present and anticipated
marine related tenants. When asked by Commissioner Hirsch if
the request is for a 50 sq. ft. sign, the petitioner responded
that they will accept whatever the Commission and people of
Dania will allow.

� Discussion of the sign ordinance in relation to varying
sizes and the legality of off-site signs ensued.
Mayor Bertino opened a public hearing. Hearing Gloria Daly,

Kurt Ely and Audrey Cassese speak in opposition to allowing an
off-site sign, the Mayor closed the public hearing.
In response to Vice Mayor Byrd' s inquiry, City Attorney Adler
L attested to the legality of reconsidering the variance request
and granting less than originally requested.

A motion was made by Commissioner Cook seconded
Commissioner McElyea to refer the matter back to by
P&Z Board
for consideration of a variance for a 50 sq. ft. sign on an
off-site location.

During discussion of the motion, Mayor Bertino pointed out the
City' s joint partnership status in the marina project and the
obvious benefits to the City with its success . He suggested
that, since the sign presently located on the property in
question is in poor condition, perhaps the petitioner should be
required to place both signs on one pole. He also sug
gested
the petitioner should be required to stipulate the location of
the Community Center on the sign.
The motion to refer the matter back to the P&Z Board passed on
a 4 to 1 vote.
11 . ADMINISTRATIVE REPORTS
11 .1 City Manager Jewell - no comment.
11 .2 City Attorney Adler - no comment .
12. COMMISSION COMMENT
12 . 1 Commissioner Cook asked City Manager Jewell for a status report
on the light at 5th Ave. and Sheridan.

12 .2 Commissioner Hirsch welcomed Peggy Goodman back from an
extensive trip.
12 .3 Commissioner McElyea also commented on the light at 5th Ave
and Sheridan and asked City Manager Jewell to comment on the.
D.O.T. situation. City Manager Jewell explained that it is a
funding problem and promised an updated report at the next
Commission meeting .
12 .4 Vice Mayor Byrd, as the City' s Representive to Community
Development, reported that during the past year, the City has
received some $520 ,000 in Federal Funds from Community
Development, and has prospects of receiving some $400 ,000
during the next year' s funding. He called for a workshop to
discuss the City' s
y participation and contributions to capital
improvement projects.
12 .5 Mayor Bertino agreed that a workshop to discuss the concept of
capital improvements should be held .
13 . CITIZENS ' COMMENTS
No verbal or written requests for citizens' comments for this
night' s meeting were received.
