ANNOUNCEMENT Announcement by Bobbie Grace, regarding Dania Day, May 11 , 1985 ! 4 Bobbie Grace announced Dania Day, to be held at Modello Park on May 11 , 1985 , beginning at 12:00 noon and urged all Dania i residents, families and friends to attend and participate. 1 . PUBLIC HEARINGS Ordinances (Second and Final Reading) 2 .1 (PZ-59-84; Plat approval for "Bryan Oaks" plat, property located at 180 Bryan Road , petitioner Jan C. Hansen, 4 .20 Acres. ) (Continued from 4/9/85 Regular Commission Meeting . ) A motion was made by Vice-Mayor Byrd, seconded by I Commissioner Cook to continue the second and final reading of the ordinance approving the plat of "Bryan Oaks" until the next regular Commission meeting of May 14 , 1985 . The motion passed unanimously. * (At this time, Addendum items 2 .6 and 2 .7 were addressed . ) 2 .2 ( PL-16-85; Plat approval for "300 Sheridan" plat; Property located at 300 ( East) Sheridan St . , Petitioner M.E. Berry II , 4 .9507 Acres . ) Barry Willis , of Berry & Calvin , stepped forward to request j approval for "300 Sheridan" plat. The Planning and Zoning Board recommended approval provided that the petitioner lives up to commitments regarding easements requested. Mayor Bertino opened the public hearing. Hearing no one speak in favor or opposition, the Mayor closed the public hearing . An ordinance approving the plat of "300 Sheridan" was read for second and final reading by City Attorney Adler. f A motion was made by Commissioner Cook, seconded by E Commissioner McElyea to adopt the ordinance on second and final reading approving the Plat of "300 Sheridan" plat . Smith & f Associates. (9 .083 + Acres) Craig A. Smith stepped forward to request plat approval for "Village Marina" plat . The Planning and Zoning Board recommended approval subject to the following conditions: 1 ) FDOT verification of Griffin Road right-of-way needs to be secured; 2) the bearings on the west line of plat do not agree with bearings on adjacent property and should be corrected; and 3) utility easements may be required . An ordinance approving the plat of "Village Marina" was read for second and final reading by City Attorney Adler. Mayor Bertino opened the public hearing . Hearing no one i speak in favor or opposition, the Mayor closed the public hearing. i A motion was made by Vice-Mayor Byrd, seconded by Commissioner McElyea , to adopt the ordinance on second and final reading approving the plat of "Village Marina" subject to verification by City Engineer that conditions have been satisfied . The motion passed on the following roll call vote: Commissioner Cook-yes Vice-Mayor Byrd-yes Commissioner McElyea-yes Mayor Bertino-yes Regular Meeting 2 April 23 , 1985 i 2 .4 (RZ-22-85) ; Rezoning from IG ( Industrial) to C-2 (Commercial ) for property located at 1610 Griffin Road; Petitioner Michael L. Thomas, Trustee ( 11 . 2 + Acres) . A motion was made by Commissioner Cook, seconded by Vice-Mayor Byrd to continue this item until the next regular Commission meeting of May 14 , 1985 . The motion passed ' unanimously. Variances i 2 . 5 VA-20-85; Variance to allow use of a 55 foot trailer as a test facility for the property located at 1100 NE 7 Avenue,- petitioner Antilles Food Corp. The President of Antilles Food Corp, introduced Jim Pullum, representating the tenant test facility, who explained the proposed use of the trailer for which the variance is requested. He said that his company inspects petroleum products , a maximum of a quart for testing purposes, and requires the trailer for additional research lab space . The Planning and Zoning Board recommended approval based on a one year trial and after one year petitioner must appear before the Board to continue this use . Mayor Bertino opened the public hearing . In response to a citizen' s question regarding quantities to be involved after expansion , Mr. Pullum estimated a maximum of 8 quarts , which would be returned after testing. Hearing Bob Mikes and Kurt Ely object to the use of a trailer for this purpose , the Mayor closed the public hearing . During discussion, the petitioner assured that all fire safety precautions have been taken and that after a recent inspection of the present facility, the City Fire Inspector noted no particular hazard . A motion was made by Commissioner McElyea , seconded by Vice-Mayor Byrd to table this item until the next regular Commission meeting of May 14 , 1985 , and to have the Building Department and Code Enforcement Officer inspect the trailer in the interim regarding required permits. The motion passed unanimously. ADDENDUM ITEMS: * 2 .6 (RZ-14-85; Rezoning from RD-6000 (duplex) to C-2 (Commercial ) property located at 222 SW 2nd Terrace ; petitioner Fay M. Wishart. ) * 2 .7 (RZ-15-85; Rezoning from IG ( Industrial) to C-2 (Commercial ) , property located at 1125 NE 7th Ave. ; petitioner George L. Farmer. ) City Manager Marant explained that addendum items 2.6 and 2. 7 were placed on the agenda because they had been advertised in error for public hearing on this night but that the first reading of both items was continued at the last meeting until j May 14th. 4 A motion was made by Vice-Mayor Byrd, seconded by Commissioner Cook to continue first readings of rezoning requests RZ-14-85 and RZ-15-85 until the Commission meeting scheduled for May 14 , 1985 . The motion passed unanimously. f , i 3. SITE PLANS - None I 4 . BIDS - None i I Regular Meeting 3 April 23 , 1985 J r 5 . OCCUPATIONAL LICENSE 5 . 1 Request for Occupational license by Mr. Arthur P. Browner, Browner Antiques & Gallery, Inc . , for the purpose of an Auction located at Alex' s Flamingo Groves , 236 North Federal Highway. Arthur P. Browner stepped forward to explain his request for occupational license to run an auction at property located at I 222 N. Fed. Hwy. next to Alex' s Flamingo Groves on April 26th and 27th, 1985 . A motion was made by Vice-Mayor Byrd, seconded by Commissioner Cook to grant the occupational license to Browner Antiques & Gallery, Inc . to run an auction subject to the recommendations of the Police Department . The motion passed unanimously. 6 . PRESENTATIONS - None 7 . APPOINTMENTS - None 8 . PROCLAMATIONS ADDENDUM ITEM: 8 .1 Mayor Bertino announced the issuance of a proclamation proclaiming the week of May 5-11 , 1985 , as "Small Business week" . 9 . DISCUSSION ADDENDUM ITEM: 9 . 1 Approval of recommendations by the Community Development Block Grant Committee. Kurt Ely, Chairman of the Community Development Block Grant Committee , stepped forward to present the committee ' s recommendations for the llth year funding. He described the status of the "PROJECT IMPAC" community development at the County level and the status of the City' s land acquisition, street improvement and resurfacing loth year block grant projects . The Block Grant Committee recommended the projects to be t submitted for llth year block grant funding in the following order of priority: 1 ) To continue NW 1st Street improvements (begun in the loth year program) from NW 8th Avenue west to Bryan Road. 2 ) IMPAC style revitalization project in neighborhood bounded by Griffin Rd. and NW 3rd St. between NW 4th Ave. and NW 9th Ave. 3 ) IMPAC style revitalization project in neighborhood bounded by Dania Beach Blvd . & SW 1st St . between NW 5th Ave. and NW 8th Ave. Grant proposal to include request for funding a full time Code Enforcement Officer. 4 ) Crystal Lakes One Stop Social Service Center - request j funding to provide Dania' s share of three party agreement for two years of operating cost to keep Center operated by L. E.S. j j - $20,000 . for the llth year and an obligation out of the i 12th year funds of an additional $20 ,000 . A motion was made by Commissioner Cook , seconded by jCommissioner McElyea to approve the Community Development Block Grant Committee recommendations. ! !. l Regular Meeting 4 April 23 , 1985 i II T7 r During discussion , a concerned citizen, Brenda Miller, stepped forward to voice a complaint that her suggestions to the block grant committee for possible funding of a particular project in southwest Dania were not taken seriously. She requested that she be considered for an appointment to the block grant committee next year. In response , Mr. Ely explained that at the committee meetings, the reasons for acceptability or unacceptability by the County of certain projects were outlined in detail . After discussion, the motion to accept the recommendations passed on the following roll call vote : Commissioner Cook-yes Vice-Mayor Byrd-yes Commissioner McElyea-yes Mayor Bertino-yes 10 . ADMINISTRATIVE REPORTS 10 . 1 City Manager Marant commented on a letter received from Mr. Peterson of the South Fla . Regional Planning Council indicating an upcoming meeting between the Council and the City' s Staff regarding the choosing of a regional hazardous waste site. City Manager Marant requested that a resolution be drawn up indicating the City of Dania' s objections to the i site being located where currently planned . A motion was made by Commissioner Cook , seconded by Commissioner McElyea to direct the City Attorney to draw up the resolution as requested . The motion passed unanimously. j City Manager Marant reported that he has requested City Attorney Adler and Building Official Maxwell to sit in on Planning and Zoning Board meetings . City Manager Marant also reported that guidelines in the Building Department are being tightened such that advertisements will no longer be placed until complete i information is supplied by developers and contractors . * (At this time , City Manager Marant addressed the citizens' i comments agenda. ) 10 .2 City Attorney Adler - no comment . 11 . COMMISSION COMMENT ** 11 . 1 Commissioner Cook yielded her time to Constance Carpenter for Citizens ' Comments . Commissioner Cook congratulated Mayor Bertino on being elected to the Board of Directors of the Broward League of Cities . 11 .2 Commissioner Hirsch - absent . 11 .3 Commissioner McElyea commented on the widened Dixie Highway. 11 .4 Vice-Mayor Byrd commented on growth needs of the City' s Building Department. At this time the Pasquariello a occupational license issue was also discussed . 11 .5 Mayor Bertino - no comment. S I 12. CITIZENS' COMMENTS Constance Carpenter to speak regarding parking at the beach. ** City Manager Marant reported that since the Seafair Restaurant is now open, Staff will be able to finalize Beach parking plans . He explained that the lot being utilized by Seafair was part of the Regular Meeting 5 April 23 , 1985 i n � r D.O.T. right-of-way, not owned by the City. He said that within the next 30 days , a comprehensive overview of Beach rehabilitation plans will be submitted to the Commission. ** Constance Carpenter expressed her concerns about the parking problem at the Beach and voiced her objection to receiving a parking ticket when she had a parking permit but could not find a permitted or metered space . She also suggested some other areas of concern regarding beach traffic. This Regular Commission Meeting was then adjourned .
