no compensation as legal counsel to the Dania Code

be reimbursed by the Dept . of Transportation for this
{ project and that a complete financing package will be
presented to the Commission before a bid on this project j

VARIANCES
4. 1 PZ-20-84, MICHAEL L . THOMAS, 1601 GRIFFIN ROAD;
(CONTINUED FROM OCTOBER 23, 1984 MEETING) .
Ross Beckerman, Attorney for the petitioner, stepped
forward to explain the variance request relating to the
hotel height restrictions and required number of parking
spaces, stressing the point that the petitioner has
withdrawn the portion of the original variance request
relating to the size and percentage of parking spaces ,
fully complying with the Dania parking ordinance. t

Mr . Beckerman referred to a packet hand delivered on
November 8th to the Commission and Building Official
Maxwell containing a Letter of explanation, a copy of
the plan submitted, the developer ' s September 7th
calculations, and a memo from the architects giving
specific comparisons with what they have done in Miami .
He announced that an agreement has since been reached
with the Hilton Hotel and documents are about to be
executed.
Mayor Byrd opened the public hearing. Hearing Gloria

A motion was made by Commissioner DonLy, seconded by
Vice-Mayor Bertino to approve variance request PZ-20-84,
stipulating approval for a building of 97. 1 ' in height
contingent upon FAA approval and stipulating approval
for a reduction of required parking spaces to 460 spaces
I to be provided contingent upon 633 spaces being the
j required number of parking spaces required by the City
of Dania when final plans are reviewed (as calculated by
the deveLoper ' s calculations of September 7, 1984) . d

Henry Graham described LES, Inc . ' s Liberty Heights
project and requested a Letter extending the City ' s
support in concept of LES, Inc . ' s plans to initiate a
Land use plan amendment and rezoning, for submittal to
the County by LES, Inc .
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Cook to grant the request and deliver to
LES, Inc . a Letter of support from the City of Dania
I concerning their efforts to purchase the Liberty Heights
(� property . The motion passed unanimously .
10. 2 Commission discussion and action regarding Commission
1 Meeting scheduled for December 25, 1984 ( Christmas Day) .
Mayor Byrd reminded the Commissioners that the National

League of Cities Meeting in Indianapolis conflicts with
the scheduled regular Commission meeting of November 27,
1984.

To accommodate the needs of the petitioners re the
County ' s schedule for Land use plan amendments , it was
agreed that Duke & Duke and Pag Bros . Builders will j
receive letters for submittal to the County �
acknowledging the passage by the City of the Land use
changes and zoning changes on first reading and stating
the December 11th date for final adoption .
A motion was made by Commissioner DonLy, seconded by

Vice-Mayor Bertino to call the November 27th meeting to
order, notifying all petitioners in advance that no
business wiLL be conducted at that meeting due to the f
Lack of a quorum, to continue the meeting until December
11 , 1984, and to determine at the December 11th meeting I
the business for the December 25th meeting, but not to
advertise any business for the December 25th meeting
without direction from administration . The motion
passed unanimously .

j 11 . 1 CITY MANAGER MARANT reported that per Lab inspections of
1 October 19th , the THM ' s are now at acceptable levels .
He reported that construction at the water plant is
expected to be completed by January 1st .
DEPUTY CITY MANAGER JEWELL announced that the McLaleuca
area will have no water service for about an hour during f
early afternoon on November 14th due to switching over
water Lines in conjunction with NW 10th Street .

11 . 2 CITY ATTORNEY ADLER reported that due to the passage by

(TEFRA) , a compliance amendment to the General Employees
Pension Board ordinance is required by December 31st ,
and recommended J . Stephen Palmquist , Consultant , of
Kruse O ' Connor & Ling Inc . to do the work .
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner DonLy to authorize administration to
appropriate the funds and commission J . Stephen
Palmquist , of Kruse O ' Connor & Ling Inc . , to prepare the
